("Consultant"), agree to the following amendments to the Contract for Professional Services for Home Road Improvements Ayers Street to Port Avenue BOND 2012(Project No. El 2100): Original Contract January 29, 2013 Motion No. M2013-021 $244,362.50 Amendment No. 1 August 16, 2013 Administrative Approved $17,000.00 Amendment No. 2 August 26, 2014 Ordinance No. 030264 $104,000.00 Amendment No. 3 August 23, 2016 Administrative Approved $21,030.00 Amendment No. 4 October 13, 2016 Administrative Approved $47,074.00 Amendment No. 5 December 27, 2016 Administrative Approved $40,880.00 In the Original Contract, Exhibit "A", Section I. Scope of Services shall be amended as set forth in the attached Amendment No. 6, Exhibit"A". In the Original Contract, Section III. Fees shall be amended based on the modified scope of services in the attached Amendment No. 6, Exhibit "A" for a fee not to exceed $42,516.00, for a total restated fee not to exceed $516,862.50. All other terms and conditions of the January 29, 2013 Contract for Professional Services between the City and Consultant,and of any amendments to that contract,which are not specifically addressed herein shall remain in full force and effect. Box 9277 Corpus Christi,TX 78469-9277 Re: Request for Contract Amendment No.6 Horne Road Improvements-Ayers Street to Port Avenue(City Project E12100) Bond 2012 Program Dear Mr. Edmonds: Naismith Engineering, Inc.(NEI)respectfully submits this request for an amendment to our contract for engineering and related services on the above referenced project. As you are aware,there have been several things that have occurred on the project where the City has requested that we provide services outside the scope of our original contract and previously approved amendments. Some of these additional services resulted from the City's decision to terminate the original construction contract with Salinas Construction Technologies, Ltd. (Salinas) and letting a new construction contract with Clark Pipeline Services,J.V.(Clark),while others resulted from changes requested by City personnel. We believe we have faithfully assisted the City with these additional requested services and that these additional services have allowed the City to keep this project progressing toward completion. This letter outlines the nature and extent of the additional services we have provided and presents our request for a contract amendment, broken out by several categories of additional work, Item One-Construction Inspection and Administration(Clark Contract—Extended Time of Construction) The original Clark Construction Contract was for the period from August 15, 2015 through January 29, 2016. The contractor did not finish within the original timeline and the construction period continued through March, 2016. The final major item(force main)was completed on Thursday,March 3rd. The remaining work includes some minor paperwork and verification that punch list items have been addressed. During this extended construction period NEI provided construction administration services along with construction inspection services. The total costs incurred during this period was$27,476.00.An additional$2,500.00 was required for closeout. Director of Capital Programs City of Corpus Christi February 1,2017 Page 2 Item Two-Bond Claim Assistance(To Be Completed in Future) It is our understanding that the City will be submitting a claim to the surety requesting payment under the performance bond.We will provide support to the City during the execution of the claim. Mr.Grant Jackson served as the project Principal, Mr. Willie Rivera served as the Project Engineer and Mr. Marcos Luna served as the project inspector. They will be available to assist with any documentation which may be required for the process. Estimated Fee--Item Two Senior Project Manager 60 Hrs @ $175/Hr $10,500.00 Administrative Assistant 8 Hrs @$75/Hr $ 600.00 Construction Inspector 16 Hrs @ $90/Hr $ 1,440.00 Item Two Sub-Total $12,540.00 Total Item One and Two $42,516.00 NEI believes that we have aggressively worked with the City to keep this project moving and have not used the fact that these services were outside the scope of our amended contract as an excuse to delay the project. However,we also believe that we are due compensation for these additional services. Based on the items outlined above, we are hereby requesting that the City approve an amendment to our contract in the amount of$42,516.00 to our existing contract amount of$474,346.50 for a total restated fee of$516,862.50.
