Scope of Services shall be amended as set forth in the attached Amendment No. 2, Exhibit"A". , In the Original Contract, Section III. Fees shall be amended based on the amended scope of services in the attached Amendment No. 2, Exhibit"A"for a fee not to exceed $10,500.00,for a total restated fee not to exceed $365,025.00. Director of Engineering Services City of Corpus Christi 1201 Leopard Street Corpus Christi, Texas 78401 Reference: Amendment 2 to Bond 2014 Alameda Street- Kinney to Lipan (Project No. E13086) Dear Mr. Edmonds: The level of effort provided by LAN during the construction phase of the above referenced project has been significantly higher than had been earmarked in the original construction administration phase scope-of-work. It is for this reason we respectfully request consideration for an amendment to our contract for additional services rendered. According to the executed contract with the City, LAN's original scope-of-work for the Construction Administration Phase of the Bond 2014 Alameda Street- Kinney to Lipan Project was limited to the following hours: • PM 21 Hours • EIT 52 Hours • TECH 36 Hours • ADMIN 16 Hours Of the 52 EIT hours, 16 hours were for review of contractor submittals; 8 for responding to contractor RFI's and providing clarifications and 12 for preparing change orders. 3 hours per week for periodic site visits was also earmarked. The total budget for the Construction Administration Phase was $22,500. Expanded Construction Administration Phase Services The level of effort provided by LAN during the construction phase has been significantly higher than had been earmarked in the original construction administration phase scope-of-work as noted below: • Contractor Proposed Deviation: The Contractor requested that a Tapping Sleeve&Valve be allowed in lieu of cutting in a tee and valve for the water line in Lipan Street. LAN has communicated and coordinated with the Contractor&the City via e-mails and phone calls to discuss and validate the proposed deviation; cost review and follow-up recommendations were included. • Unforeseen Sanitary Sewer Manhole: An existing sanitary sewer manhole was buried and covered over by pavement in Mussett Street. This manhole was not shown on the City's existing utility maps and was discovered by the Contractor during excavation activities. Follow-up included phone calls and e-malls with City staff; and discussions with the Contractor and the City's project contract representative. • Differing Site Conditions Discovered During Excavation: LAN has responded to the Contractor's discovery of differing site conditions, communicating with the City and Contractor via phone calls, e-mails, In-person discussions and site visit to observe actual conditions and provide recommended solutions. Thus, as can be seen from the summary bullets above, LAN has been providing a level of involvement that has exceeded the level of effort desalbed in the original contract budget. However, the value that LAN has brought to this construction phase effort has been noteworthy and has added significant value to the outcome of the project. Therefore, LAN would like to capture the costs associated with these professional services by requesting that the City approve an amendment for additional services for an "Expanded Construction Administration Phase"effort which will be in addition to the original$22,500 budget for Construction AdmInistration. The expanded effort resulted in an additional 5 hours per week average,for the first 14 weeks of the project, at an average rate of$150 per hour which equals$10.500.00. _.....................Summar/ LAN understands the constraints Involved with executing Bond-funded projects. Given the value- added effort that LAN has made during the Construction Administration Phase of this project, we respectfully request approval of this proposal and amendment to our contract for the lump sum amount of 10,500.00.
