Box 9277 Corpus Christi, Texas 78469 Subject: Amendment No.4 - Programmed Water Line Service Life Extension (#8610) City-Wide Water Distribution System Repair and Replacement - ID/IQ Procurement Dear Jeff: In response to a City request we are proposing a contract amendment to the Programmed Water Line Service Life Extension (#8610) which includes, design phase services, and permitting services for USACE, TxDOT and GLO Design Phase Services The design phase services are to prepare two (2) plan and profile sheets showing the relocation of an existing water line and the rehabilitation of an existing wastewater line on Shoreline Blvd., from Pearl Street to Coastal Street. The P & P sheets will be included in the City's project, North Beach Improvements (#E12127 & #E12129). Permitting Services The permitting services are required for City Wide Water Distribution System Improvements (#E16294) Delivery Order No. 1 - Cayo Del Oso crossing. The delivery order is being created to replace an existing 8-inch waterline with either a new 8-inch or a new 12-inch waterline across the Cayo Del Oso. The waterline crossing is located adjacent to SPID. which is under TxDOT jurisdiction and the Cayo del, which is under the USACE/GLO jurisdiction. To assist the City with these tasks we propose to provide engineering services, as outlined below. I. SCOPE OF SERVICES: Design Phase Services (North Beach Improvements (#E12127 &#E12129) NE will provide design services for the relocation of an existing water line and the rehabilitation of an existing wastewater line on Shoreline Blvd., from Pearl Street to Coastal Street. The deliverable to the City will be a plan and profile sheet or sheets (as required) of Shoreline Blvd from Pearl to Coastal Street, showing the water and wastewater design. We will also provide quantities for inclusion in the project's bid proposal. Additionally, services do not include coordination with other design professionals currently designing improvements within the same project limits. The design services also do not include construction administration with the exception of what may be required to clarify or answer any questions specifically related to the design of the water and wastewater portions of project. Additional Services (City Wide Water Distribution System improvements(0E16294) U.S. Army Corps of Engineers Nation Wide Permit NE will conduct a wetland delineation/inspection of the proposed work areas and work corridor for the proposed B-inch or 12-inch water transmission main for Delivery Order No. 1, coordinate with the USAGE, prepare a Nation Wide Permit application and assist in pursuit of USACE authorization for the impacts associated with proposed 8-inch or 12-inch water line. The following tasks will be performed; Task 1 - Review Existing Site Information and Conduct Wetland Delineation and Habitat Characterization Existing site information, including recent and historical aerial photography, U.S. Fish and Wildlife Service (USFWS) National Wetlands Inventory Maps, U.S. Geological Survey (USGS) topographic maps, USGS Geological Survey National Hydrography Data Set, U.S. Department of Agriculture (USDA) Natural Resources Conservation Service Soils Data, and Federal Emergency Management Act (FEMA) Floodplain Maps will be reviewed to assess current site conditions. NE will conduct wetland delineation within the proposed work corridor in accordance with the 1987 U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual and Regional Supplement. If requested, NE will provide a draft wetland delineation report to Client for review and comment. After receiving approval from Client, NE will submit the delineation report to USAGE with a request for a preliminary jurisdictional determination or verified determination. NE will coordinate with USACE in attempt to attain a preliminary jurisdictional determination or verified delineation. This task includes up to two site visits with USAGE and responding to minor questions and requests for additional information. Additional fees may be required if significant requests for additional field work or information are made. Task 2 - Prepare USACE Permit Request and Coordination of Permit Issuance NE will prepare a Pre-construction Notification (PCN) for applicable USAGE Regional General Permit (RGP) and/or Nationwide Permits (NWP)for a new water pipeline installation and submit the PCN to USAGE with a request for concurrence. The PCN will include a cover ---- --letter, permit application form (ENG Farm 4345), permit drawings, a wetland delineation report, and photo log. NE will coordinate with USAGE in attempt to obtain concurrence from USACE that the project is eligible for authorization under an RGP and/or NWP. If USAGE determines that the project is not eligible for authorization under an RGP and/or NWP, additional fees may be required to pursue an Individual Permit(IP). NE will coordinate with USAGE in attempt to facilitate issuance of the permit. This task includes responding to minor information requests by USACE. If comments received require additional studies and/or field work, additional fees may be required. Page 2 of 3 Amend. No. 4 Exhibit A Page 2 of 4 Task 3 - Post Construction Survey: NE will conduct a post-construction survey and prepare a letter report for the OWNER's review and comment. After receiving approval from the owner, A/E will submit the post- construction survey letter report to the USACE. NE will coordinate with the USACE in an attempt to attain approval of the survey. The post-construction letter report will include: 1) description of the physical habitat in the project area, both prior to and after construction, 2) a description of re-vegetated types and trends, 3) vegetation/open water coverage, 4) water depths, 5) noted fish and wildlife use, and 6) photographic documentation of the project area. This task will include one site visit to the project area to document the vegetative growth along the construction ROW. Texas DOT Permit NE will coordinate with the TxDOT and prepare a permit application for the proposed 8-inch or 12-inch water line within and across their right-of-way. Texas General Land Office Authorization NE will coordinate with the TGLO and prepare an authorization to construct the proposed 8- inch or 12-inch water line within their jurisdictional area inside the TxDOT ROW. II. SCHEDULE: The schedule for the design phase and permitting services will be determined once the NE contract has been renewed. III. FEE: For services authorized by the Director of Engineering Services, the City will pay the AE a not- to-exceed fee as per the attached fee table.
