AMENDMENT NO. 5
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas, hereinafter called "CITY," and Freese and Nichols, Inc. hereinafter
called "ENGINEER," agree to the following amendment to the Contract for Professional Services for
South Staples Street from Brawner Parkway to Kostoryz Road (Bond 2012) (Project No. El 2095)
as authorized and administratively amended by:
Original Contract January 29, 2013 Motion No. M2013-017 $731,030.00
Amendment No. 1 July 11, 2014 Administrative Approval $49,537.00
Amendment No. 2 January 23, 2015 Administrative Approval $39,154.00
Amendment No. 3 April 25, 2016 Administrative Approval $37,454.00
Amendment No. 4 October 13, 2016 Administrative Approval $49,883.00
EXHIBIT A, SECTION 1. SCOPE OF SERVICES, PART A. BASIC SERVICES shall be modified as
shown below.
2. Design Phase: "ENGINEER" will provide additional design services needed and more fully
described in "Exhibit A".
3. Bid Phase: "ENGINEER" will provide bid phase services and more fully described in "Exhibit A".
EXHIBIT A, SECTION 1. SCOPE OF SERVICES, PART B. ADDITIONAL SERVICES shall be modified
as shown below.
10. Traffic Control: "ENGINEER" will provide traffic control plan and more fully described in "Exhibit
A".
EXHIBIT A, SECTION 3. FEES, PART B. SUMMARY OF FEES shall be modified by the attached
Summary of Fees as shown in the attached Exhibit A for an additional fee not to exceed $42,769 for a
total restated fee not to exceed $949,827.
All other terms and conditions of the January 29, 2013 contract between the "CITY" and "ENGINEER"
and of any amendments to that contract which are not specifically addressed herein shall remain in full
force and effect.

City Project No. E12095-Amendment#5
Dear Mr. Edmonds,
At the request of your staff, Freese and Nichols, Inc. is pleased to submit our contract amendment#5 for
South Staples Street from Brawner Parkway to Kostoryz Road. This amendment includes additional
design effort for the following items:
1. Additional design of a 12"wastewater force main
a. Item includes plan and profile design and replacement of approximately 500 linear feet
of 12" C900 PVC wastewater force main. The City Utility Department requested that the
wastewater force main be relocated to avoid having the force main located beneath the
new curb and gutter of the redesigned roadway.
2. Additional design effort for the 6" high pressure gas line and 6"distribution gas line within the
project limits.
a. This item includes detailed design PS&E of approximately 4,900 linear feet of 6" high
pressure gas line and approximately 800 liner feet of 6" polyethylene gas distribution
line. These lines were initially planned to be replaced by City forces. As part of the
project redesign, the City has requested that the contractor construct these lines as part
of a new additive alternate bid. FNI will participate in three (3) additional meetings with
the City and Gas Department to coordinate the construction of these lines.
3. Revised traffic control plan (TCP) and construction sequencing
a. Item includes additional redesign and phasing of the traffic control plan sequencing and
detailed traffic control design changes. The changes to the TCP were requested by the
City to facilitate the City/contractor construction of the 6" high pressure gas line and 6"
distribution gas line within the project limits and to minimize impacts to Ray High
School. The TCP was redesigned and reconfigured to accommodate the gas line
construction. The 6" high pressure line must be constructed in a continuous operation
as there are no isolation valves within the project limits.

4. Add Bid Phase Services. Amendment#4 previously deleted the Bid Phase Services.
a. As part of the project redesign,Amendment#4 deleted the amount for bid phase
services. This amendment proposes to add bid phase services back into the contract.
Bid phase services will include the:
i. Participate in the pre-bid conference and provide a meeting agenda for critical
construction activities and elements impacted the project.
ii. Assist the City in solicitation of bids by identification of prospective bidders,and
review of bids by solicited interests.
iii. Review all pre-bid questions and submissions concerning the bid documents and
prepare,in the City's format,for the Engineering Services'approval,any
addenda or other revisions necessary to inform contractors of approved
changes prior to bidding.
iv. Attend bid opening,analyze bids,evaluate, prepare bid tabulation,and make
recommendation concerning award of the contract.
v. In the event the lowest responsible bidder's bid exceeds the project budget as
revised by the Engineering Services in accordance with the A/E's design phase
estimate required above,the Engineer will,at its expense,confer with City staff
and make such revisions to the bid documents as the City staff deems necessary
to re-advertise that particular portion of the Project for bids.
Freese and Nichols, Inc.respectfully requests a contract amendment in the amount of$42,769.00 to
address the aforementioned items.
