A/E Amendment No.4
Dear Mr. Edmonds,
This letter is our request to amend the original contract to include extra work for the following items.
Some of these task items were removed from the original contract scope as part of Contract Amendment
No. 2 as compensation for previous extra work but are necessary to support the construction and
warranty phases of the project. Also, additional engineering and revisions to the drainage system plans
will be required to accommodate a 48" water transmission main that will not be relocated. Following are
the tasks that are associated with this proposed Contract Amendment:
Construction Administration Phase (Time & Materials). The A/E will perform construction contract
administration to include the following:
a) Participate in one pre-construction meeting conference and provide input on critical
construction activities and elements impacted by the project, which should be brought to
the Contractor's attention.
b) Review Contractor submittals and operating and maintenance manuals for conformance to
contract documents.
c) Review and interpret field and laboratory tests.
d) Provide interpretations and clarifications of the contract documents for the Contractor, as
requested by the City's authorized representative.
e) Make regular visits to the site of the Project(estimated at 1 hour per week for 65 weeks)to
confer with the City project inspector and Contractor to observe the general progress and
quality of work, and to determine, in general, if the work is being done in accordance with
the contract documents. This will not be confused with the project representative
observation or continuous monitoring of the progress of construction.
1. The presence or duties of Engineer's personnel at a construction site, whether as
onsite representatives or otherwise, do not make Engineer or Engineer's
personnel in any way responsible for those duties that belong to Owner and/or
the construction Contractors or other entities, and do not relieve the construction
Contractors or any other entity of their obligations, duties, and responsibilities,
including, but not limited to, all construction methods, means, techniques,
sequences, and procedures necessary for coordinating and completing all
portions of the construction work in accordance with the construction Contract

any construction Contractor or other entity or their employees in connection with
their work or any health or safety precautions and are not contractually obligated
under this Agreement to inspect a city construction Contractor, its
subcontractors,or the personnel of any or either of them, for health and safety
concerns.
3. The presence of Engineer's personnel at a construction site is for the Engineer to
provide the Owner with review and input regarding whether the completed
construction work will conform generally to the construction documents and
whether the integrity of the design concept as reflected in the construction
documents has been implemented and preserved by the construction
Contractor(s). Engineer neither guarantees the performance of the construction
Contractor(s) nor assumes responsibility for construction Contractor's failure to
perform work in accordance with the construction documents.

two (2) months of final acceptance of the project. All drawings shall be CADD drawn using
dwg format in AutoCAD, and graphics data will be in dxf format with each layer being
provided in a separate file. Attribute data will be provided in ASCII format in tabular form.
All electronic data will be compatible with the City GIS system.
The City staff will:
a) Prepare applications/estimates for payments to Contractor.
b) Conduct the final acceptance inspection with the Engineer.
c) Provide Engineer the construction"red-line"drawings.
Revisions to Construction Drawings (Lump Sum Feel. The A/E will perform additional engineering and
provide revisions to the drainage system plans that are needed to accommodate a 48" water
transmission main that will not be relocated.Based on available information, the existing waterline is
in conflict with the flowline of the proposed ditch by approximately 2 inches but must be confirmed
at a later date. The redesign is based on regrading approximately 700 LF of ditch upstream of the
water transmission line crossing and constructing a protective concrete slab over the water
transmission line. The redesign includes adding supplemental sheet 38A which will provide a revised
detail of the proposed ditch crossing the water transmission line as well as a detail of the protective
concrete slab. In addition, the SET's at approximately Lt. Sta. 39+25 will be eliminated and replaced
with continuous dual 6' x 3' box culverts so that the ditch can be filled in. Any other redesign that
may be required due to differing site conditions may require an alternate design solution as well and
a corresponding adjustment to the Scope and Fee.
