Kitty Hawk Development, Ltd. ("Grantor"), whose address is 8230 South Staples Street,
Corpus Christi, Texas 78413, for and in consideration of the sum of One and No/100
Dollar ($1.00) paid by the City of Corpus Christi, a Texas home-rule municipal
corporation ("Grantee"), whose address is 1201 Leopard Street, Corpus Christi, Texas,
78401, the receipt of which is acknowledged, has granted, sold, and conveyed and by
these presents does grant, sell, and convey to the Grantee, its successors, legal
representatives, permitted assigns and franchisees, the free and uninterrupted use,
liberty, privilege, and easement of going in, on, over, under, and along a certain tract of
land situated in Nueces County, Texas, and being described as follows:
Field note description of a 50-foot wide temporary utility easement over
and across a portion of Section 31, Laureles Farm Tracts, as shown on
the map recorded in Volume 3, Page 15, Map Records of Nueces County,
Texas, which description is attached to and incorporated in this document
as "Exhibit A" and depicted on the field notes location map attached to
and incorporated in this document as "Exhibit B," the exhibits collectively
being referred to and known as the "Premises."
Together with the free ingress, egress, and regress to and for the Grantee, all for the
purpose of erecting, constructing, installing, laying, replacing, servicing, repairing, using,
maintaining, inspecting, reconstructing, modifying, removing, operating and keeping
utility lines in, on, over, under, and along the Premises, including but not limited to
water, wastewater, storm water, storm water detention, filtration, drainage, and gas, and
together with all lines, pipes, conduits, and other equipment, improvements, and
appurtenances used in the supply and provision of public utilities.
The Grantor will construct a temporary water line in this temporary utility easement in
order to create a water loop in accordance with plans and specifications provided to and
approved by the Grantee's Director of Public Works, or designee (Director).
TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above
to the City of Corpus Christi, its successors, legal representatives, permitted assigns,
and franchisees, for the proper and public use as a temporary utility easement and for
so long as used for such purposes and, if the use of said easement be ever abandoned,
then, in that event, the aforesaid rights and privileges shall cease.

TEMPORARY UTILITY EASEMENT
Field note description of a temporary utility easement out of Section
31, Laureles Farm Tracts, a map of which is recorded in Volume 3, Page
15, Map Records of Nueces County, Texas;
Said temporary utility easement is situated in the city limits of
Corpus Christi, and is described by metes and bounds as follows:
BEGINNING at a point on the boundary line of Kitty Hawk Unit 1 (Volume
68, Page 565, M.R.N.C.T.) from which a 5/8 inch iron rod found marking
a southwest corner of Lot 1, Block 3, said point being the POINT OF
BEGINNING;
THENCE S 35°12'23" W, a distance of 50.00 feet to a point, said point
being the southeast corner of this temporary utility easement;
THENCE 328.44 feet along a curve with a radius of 757.50 feet; cord
bearing N 67°12'53" Wto a point, said point being the southwest corner
of this temporary utility easement;
THENCE N 12°15'20" E a distance of 128.51 feet to a point to a point;
THENCE 136.95 feet along a curve with a radius of 325.00 feet; cord
bearing N 24°19'39" E to a point;
THENCE N 36°23'57" E a distance of 159.00' to a point to a point;
