("Consultant"), agree to the following amendments to the Contract for Professional Services for Yorktown Boulevard from Everhart Road to Staples Street BOND 2014 (Project No. El 3096): Original Contract February 18, 2014 Ordinance No. 030095 $990,929.00 Amendment No. 1 February 3, 2015 Administrative Approval $0.00 Amendment No. 2 August 2, 2016 Administrative Approval $35,405.00 Amendment No. 3 June 29, 2018 Administrative Approval $20,818.00 Amendment No. 4 November 6, 2018 Administrative Approval $13,843.00 In the Original Contract, Exhibit "A", Section I. Scope of Services shall be amended as set forth in the attached Amendment No. 5, Exhibit "A". In the Original Contract, Section III shall be amended based on the modified scope of services in the attached Amendment No. 5, Exhibit "A" for a fee not to exceed $12,131.00, for a total restated fee not to exceed $1,073,126.00. All other terms and conditions of the February 18, 2014 Contract for Professional Services between the City and Consultant, and of any amendments to that contract,which are not specifically addressed herein shall remain in full force and effect. Box 9277 Corpus Christi,TX 78469 RE: Yorktown Boulevard—Everhart Road to Staples Street BOND 2014 (Project No. E13096) Amendment No. 5 Dear Mr. Edmonds, Freese and Nichols, Inc. (FNI)would respectfully request your consideration of our proposed Amendment#5 for Yorktown Boulevard—Everhart Road to Staples Street BOND 2014(City Project No. E13096). This amendment is requesting approval to develop pavement selection criteria in support of future street improvement projects. FNI will provide the City with recommended pavement selection criteria based on reconstruction and maintenance costs on City Street projects. The criteria will consider the key features of street maintenance and include recommendations to replace the City's current approach on pavement selection. The recommended policy will include a decision matrix to assist the City in determining the recommended type of pavement to be used on City streets to provide the lowest whole-life cost to the City meeting the performance goals established by the City. The scope will include the following: 1. Policy Determination- FNI will attend one (1) kick-off meeting with City staff to discuss key policy issues and to collect information necessary to evaluate pavement selection criteria.Anticipated criteria include: a. Initial construction cost, b. Maintenance costs, c. Street classification d. Service life expectancy, and e. Performance goals 2. Construction Cost Evaluation—FNI will collect and review available bid tabulations for street construction and reconstruction. City will provide and organize the data needed. 3. Maintenance Cost Evaluation- FNI will collect and review Street Preventative Maintenance Program (SPMP) pricing data for Citywide street projects within the last three (3)years. City will provide and organize the data needed. 4. Whole-Life Cost Analysis-FNI will perform whole-life cost analysis using various pavements sections and street classifications. 5. Develop Decision Matrix Tool -FNI will develop a pavement selection decision matrix that will factor the criteria identified in Task 1 and provide the City a tool to select the preferred pavement to provide the lowest whole-life cost meeting performance goals. Draft Letter Report- FNI will prepare a draft letter report(3-5 pages)that documents the basis and approach for the development and implementation of the City's Pavement Selection Criteria. The letter report will summarize the data collected,whole life cost analysis methodology,and recommendations for pavement selection criteria. a. FNI will provide the City with one(1) hard copy and one (1)electronic file of the draft letter report. b. Meet with City to receive comments on draft letter report 7. Final Letter Report-Upon receipt of the City's final comments, FNI will finalize the letter report and deliver one (1) hard copy and one(1)electronic file to the City. 8. Meetings-FNI will attend up to two (2) meetings with the City to facilitate project coordination. The City staff will: a) Assign a project manager to oversee the project b) Provide all bid tabulations and Street Preventative Maintenance Program (SPMP) pricing data for prior three(3)years c) Provide all relevant data or guidance required to support the Pavement Selection Criteria Schedule Date Activity Fee Kick-off meeting, data review, and cost Within 2 weeks of Notice to Proceed analysis $7,108 Submit draft letter report for City review $9,762 Within 4 weeks of Notice to Proceed and comment Within 2 weeks of receipt of City comments on draft submittal Submit final letter report $4,018 Total Fee $20,888 Amendment No.5 revises project scope for Yorktown Boulevard—Everhart Road to Staples Street BOND 2014(City Project No. E13096)as follows: • In the original contract, Exhibit "A", Part III. Fees, Section B.
