AMENDMENT NO. 2 TO DOWNTOWN DEVELOPMENT REIMBURSEMENT
AGREEMENT FOR NUECES BREWING COMPANY WITH THIRD COAST
BEER, L.L.C.
Whereas, on May 15, 2018, the Corpus Christi Tax Increment Reinvestment
Zone No. 3 (the "TIRZ #3") authorized a Downtown Development
Reimbursement Agreement between the City of Corpus Christi, as an agent of
the TIRZ #3 and Third Coast Beer, L.L.C. (the "Developer") regarding the
Development at 401 Water Street (the "Agreement"); and
Whereas, the Developer has requested an amendment extending the deadline
for completion of the Project until the end of June 2019 to allow the Developer
time to complete the necessary work to open the business;
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1) Paragraph (a) of Section 3 of the Agreement is hereby amended as
follows:
"(a) The Developer constructs all of the Improvements on the Property on or
before June 30, 2019 (the "Completion Date") in accordance with Exhibit A
and the City's building codes and policies."
2) All other terms and conditions of the previously executed Agreement and
any previous amendments between the parties which are not inconsistent
herewith shall continue in full force and effect. This Amendment becomes
effective upon execution by all parties.
