AGREEMENT - MOONSHINE AND ALE/WHISKEY RODEO SALOON
Whereas, on July 24, 2018, the Corpus Christi Tax Increment Reinvestment Zone
No. 3 (the "TIRZ #3") authorized a Downtown Development Reimbursement
Agreement between the City of Corpus Christi, as an agent of the TIRZ #3, and
Moonshine Ale Ventures, LLC and Whiskey Rodeo Saloon Ventures, LLC (
collectively, the "Developer") regarding the Development at 301 and 305 N
Chaparral Street (the "Agreement"); and
Whereas, the Developer has requested an amendment extending the deadline for
completion of Phase I of the Project until the end of July 2019 and the deadline for
completion of Phase II of the Project until the end of December 2019 to allow the
Developer time to complete the necessary work to open the business;
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1) Paragraph (a)of Section 3 of the Agreement is hereby amended as follows:
"(a) The Developer constructs all of the Improvements on the Property in
accordance with Exhibit A and the City's building codes and policies by
the completion dates listed below.
(1) For Phase I (Moonshine and Ale) on or before July 31, 2019.
(2) For Phase II (Whiskey Rodeo Saloon) on or before December 31,
2019."
2) All other terms and conditions of the previously executed Agreement and
any previous amendments between the parties which are not inconsistent herewith
shall continue in full force and effect. This Amendment becomes effective upon
execution by all parties.
