§ KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES §
Del Mar College, a political subdivision of the State of Texas ("Grantor"), whose address
is 101 Baldwin Boulevard, Corpus Christi, Texas 78404, for and in consideration of the
sum of One and No/100 Dollar ($1.00) paid by the City of Corpus Christi, a Texas
home-rule municipal corporation ("Grantee"), whose address is 1201 Leopard Street,
Corpus Christi, Texas, 78401, the receipt of which is acknowledged, has granted, sold,
and conveyed and by these presents does grant, sell, and convey to the Grantee, its
successors, legal representatives, permitted assigns and franchisees, the free and
uninterrupted use, liberty, privilege, and easement of going in, on, over, under, and
along a certain tract of land situated in Nueces County, Texas, and being described as
follows:
Field note description of a public access easement over and across a
portion of a 38.94 Acre Tract of Land, described in a Special Warranty
Deed, recorded in Document No. 2013046270, Official Public Records of
Nueces County, Texas; said 38.94 Acre Tract being a portion of Lots 12
and 13, Section 21, Flour Bluff and Encinal Farm and Garden Tracts, as
shown on the map recorded in Volume A, Pages 41-43, Official Deed and
Map Records of Nueces County, Texas which descriptions are attached to
and incorporated in this document as "Exhibit A" and depicted on the field
notes location map attached to and incorporated in this document as
"Exhibit B," the exhibits collectively being referred to and known as the
"Premises."
Together with the free ingress, egress, and regress to and for the Grantee, all for the
purpose of erecting, constructing, installing, laying, replacing, servicing, repairing, using,
maintaining, inspecting, reconstructing, modifying, removing, operating and keeping a
off-road multi-use trail including bicycle facility in, on, over, under, and along the
Premises.
TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above
to the Grantee, its successors, legal representatives, permitted assigns, and
franchisees, for the proper and public use as a public access easement and for so long
as used for such purposes and, if the use of said public access easement be ever
abandoned, then, in that event, the aforesaid rights and privileges shall cease.
The duration of the easement is perpetual, subject to the termination provisions in the
Terms hereof.

With written consent of the City Manager of the City of Corpus Christi, this easement
terminates upon the granting of a public access easement for off-road multi-use trail by
Del Mar College that serves the purpose of the easement herein.
GRANTOR
The person signing this public access easement conveyance as Grantor, or signing on
behalf of the Grantor, represents, warrants, and guarantees that they are the Grantor or
have the authority to act on behalf of the Grantor for the purpose and consideration
stated.

Warranty Deed from 6702 Yorktown, LLC to Del Mar College District, as recorded in Document No. 2013046270, Official
Public Records of Nueces County,Texas;said 0.59 Acre Tract,being more fully described by metes and bounds as follows:
Beginning, at a 5/8 Inch Iron Rod Found, on the Northeast Right-of-Way line of Yorktown Boulevard, a public
roadway,for the West corner of the said 38.94 Acre Tract and this Easement;
Thence,North 28°37'45" East, with the Northwest boundary line of the said 38.94 Acre Tract, 1285.60 Feet, to a 5/8
Inch Iron Rod Found,for the North corner of the said 38.94 Acre Tract and this Easement;
Thence, South 61°18'22" East, with the Northeast boundary line of the said 38.94 Acre Tract, 20.00 Feet, to the East
corner of this Easement;
Thence,South 28°37'45"West,parallel with the Northwest boundary line of the said 38.94 Acre Tract, 1285.60 Feet,to
