PUBLIC COMMENT- AUDIENCE AND PRESENTER SOCIAL DISTANCING AND PUBLIC TESTIMONY AND PUBLIC HEARING INPUT AT PUBLIC MEETINGS OF THE CITY COUNCIL.To reduce the chance of COVID-19 transmission, public meetings will be held in a manner intended to separate,to the maximum practical extent, audience and presenters from personal contact with members of Community, City Staff, and City Council. This meeting will be broadcast at cctexas.com/services/council meeting-agendas-minutes-video. One-Reading Ordinance authorizing the acceptance of a grant from the Department of Justice for the FY 2020 Coronavirus Emergency Supplemental Funding Program in an amount of$521,426.00 to fund overtime, equipment, and supplies related to the public safety response to Coronavirus for the Police and Fire Departments; and appropriating $260,731.00 in the Police Grants Fund and $260,695.00 in the Fire Grants Fund. This Ordinance was passed on emergency on the consent agenda. Enactment No:032121 3. One-Reading Ordinance authorizing the acceptance of a grant in an amount of$121,850.26 from the Public Health and Social Services Emergency Fund to respond to coronavirus; and appropriating $121,850.26 into Fire Grant Fund. A Council Member and Chief Financial Officer Constance Sanchez discussed the following topics: there is a general fund for economic development and loans are paid back to the City,the City will then reimburse the Type A Corporation for the amount of the re-paid loans in three years. Ordinance authorizing the transfer of$590,000.00 from the Sanitary Sewer Collection Line Trust Fund, $310,000.00 from the Water Distribution Main Trust Fund and $375,000.00 from the Water Arterial Transmission and Grid Main Trust Fund to the Sanitary Sewer Trunk Main Trust Fund to meet the funding obligation for a Wastewater Force Main and Lift Station Construction and Reimbursement Agreement with Tamez Development approved by Council on February 18, 2020. Ordinance abandoning and vacating a utility easement (5,469 square feet), with dimensions of 10-foot wide for approximately 108-feet and a 20-foot wide for approximately 220-feet, out of Block B-2E, in Cullen Place, located at 542 Airline Road for the construction of a new carwash business on the property. (District 4) This Ordinance was passed on second reading on the consent agenda. Enactment No: 032127 9. Ordinance authorizing the resale of 30 properties for$253,545.00 which were foreclosed upon for failure to pay ad valorem taxes, of which the City shall receive$29,268.51 plus $55,116.93 for partial payment of City paving and demolition liens. Ordinance appropriating $3,550,000 from the Public Works reserves fund balance to the Public Works General Fund Operating Budget; amending the FY 2020 Public Works Arterial and Collector Street Preventative Maintenance Program (SPMP) Budget from $3,440,000 to - $6,990,000 and approving the general work plan for FY 2020 for a total amended budget of$6,990,000; with funding available from the FY 2020 Street, Stormwater, Water and Wastewater Funds. A Council Member and Animal Care Program Services Manager Joel Skidmore discussed the following topics: a Council Member's concern regarding how to authorize the purchasing of supplies;and that the contract amount is over what was previously used for the vaccines. Council Member Guajardo made a motion to approve the motion,seconded by Council Member Barrera. Resolution authorizing four construction contracts totaling $13,718,317.62 for the Residential Street Rebuild Program as follows: for street reconstruction with Rovan Texas LLC in an amount of $4,540,292.03, for street rehabilitation with JE Construction Service in an amount of$3,081,597.49, Haas-Anderson Construction Ltd. in an amount of$3,131,483.15, and Haas-Anderson Construction Ltd. in an amount of$2,964,944.95, located City-wide, with funding available from the Street Bond 2018 Program and FY2020 Storm Water, Wastewater, Water and Gas Funds. Mayor McComb referred to Item 17. Council Members,Director of Engineering Services Jeff Edmonds,Assistant City Attorney Janet Whitehead and Capital Improvement Program Manager Kamil Taras discussed the following topics: there were no bids received on Base Bid C;staff recommends awarding Base Bid C to JE Construction Services,LLC because 1)they submitted a competitive bid on Base Bid E and 2)the necessity of preserving the public health and safety of residents;all streets are considered health and safety concerns in dealing with public safety vehicles;the law is for all contracts over$50,000 to be bid unless there is an exception which is to preserve or protect public safety and health;a Council Member was in favor of the resolution with the exception of Base Bid C;JE Construction agreed to postpone the work and hold the pricing until January 2021;there is a benefit to giving JE Construction the bid,as well as avoiding a lawsuit;there will be new bids on some of the residential streets;a Council Member commended City Manager Zanoni for good management on this project;where does the funding come from if there are change orders and if its not part of the contract;and Council Members have not been provided with change orders in the last year. Resolution approving FY 2020-2021 grant application for the Beach Cleaning and Maintenance Assistance Program from the Texas General Land Office for an estimated amount of$70,000 to provide beach cleaning and maintenance on North Padre Island and Mustang Island. Assistant Director of Development Services Mike Dice presented information on the following topics: the purpose of this item is to allow for the construction of single family homes and commercial properties along Yorktown Road;aerial overview;zoning pattern;and Planning Commission's and staff's recommendation. Nueces County will reimburse the City for the costs of lifeguard services, equipment and supplies at a cost of $40,700 to be appropriated into the General Fund. My water bill for May was$308.56 with charges of$137.90 for waste water. Winter averaging was reinstated but that will not be reflected in the billing until after June 1. We have been charged for sewer use on all the water used for several years. I do not believe the city should be able to charge us for something we did not use. Winter averaging should have never stopped. In the past I have paid over$200.00 per month for waste water. I did not have time to protest because I was Legal Guardian for my mother who had alzheimers disease and that kept me very busy. I feel the city owes all of us many thousands of dollars. The city has now established what our waste water use is. After the system is revised to bill us with averaging in effect, at the least, we should each receive a refund for March, April and May of the overage we were charged for waste water. That will not make what has been charged for the last several years right but it will be a help to everyone. I wont even mention the numerous petty thefts from our lots and cars.lt is getting worse!!! It is getting more frequent!!! It is not being resolved despite the best efforts of our excellent men and women in blue who patrol and respond to events. It's not enough.A more proactive approach is required. My wife and I have lived here for 1 1/2 years. During this time frame, this will be the third time and/or incident I have reached out to the city Code Enforcement regarding this matter. Code Enforcement contacted the properties management company, explained the issues with the property and each time the company sends someone to trim the trees. That is great for a temporary fix but as soon as the tree branches grow, we are right back to where we began. Our Cliff House community is largely populated by an elderly aged, retired population who takes pleasure in walking our Bayfront, sitting by the pool, and enjoying our little piece of the Gulf Coast. But every time they walk out to enjoy these amenities, these amenities are compromised by individuals who are naked and having sex, using foul language, vulgar smells of feces and urine, trash and debris in our front yard as well as having individuals rifle through our trash bins. On one occasion we have had an individual sleeping in our vestibule. I am a retired police officer from the City of Corpus Christi and currently an officer with Corpus Christi ISD Police Department. I say this only because The Cliff House community has embraced my wife and I and have often expressed their pleasure of having an officer live amongst them. Having been a lifelong public servant, I feel it is my responsibility to assure they can enjoy their retirement, our city, and their amenities without feeling uncomfortable and unsafe each time they leave our community. I have, on several occasions, asked these individuals to leave the area only for them to return the next day. We as a community, will ask that on this occasion you encourage the owner of this property to come up with a long-term solution to these issues we live with. We have done our due diligence by addressing these issues with the correct city departments, city council, as well as the Mayor, what else do we need to do?We cannot cut the trees down ourselves otherwise, they would have been gone a long time ago. The owner of this property does not live in our city or our state for that matter, therefore they do not know what our everyday issues are with their property that is left unkept and an eyesore to our city. Another added issue is the fact that the property is being managed by a company in Canada who feels that cutting tree limbs fixes our issues. I think enough is enough and it is time to hold the owners of this property responsible and stop ignoring those of us that live with these issues in our front yard every day. As you advised I brought my complaint as it related to the unauthorized use of a CCPD directive in a child custody matter to the City Manager. The city Manager referred the matter to the City attorney who turned it over to the police legal advisor.. The one common theme in all of their abbreviated discussions was their collective assertions that they represented the interest of the city and not the complaintant. That seemed odd to me as a citizen for I was working under the assumption that as public officials they worked for me or at the very least had an interest in determining the facts.. I was apparently very mistaken for I have come to discover that as a citizen with a complaint I have no office agency or official to consult for redress of my grievance or concern. To quote the city attorneys office "I should consult a lawyer to represent my interests". Is that what it comes down to? If a citizen is wronged by a city employee through the auspices of their office their only recourse is to hire a lawyer? ,I have been very clear in my dealings with all parties that I have no interest in litigation. At this stage of the game I am less concerned about the outcome of my complaint but rather the process or lack thereof to have that complaint considered by an unbiased third party whose interest is not linked to the city. After almost two months I have yet to receive an answer and I am not sure from whom it will come if it ever will. In Corpus Christi there is no reason for any citizen to register a complaint through the prescribed channels if the system is designed to delay, deflect fault or to defend their own. In the simplest of terms it results in the citizens voice being silenced and opens the door to even further abuse of authority. In short, I had a simple complaint concerning the actions of an individual police officer. Though perhaps insignificant in the grand scheme of things it had the potential of costing a significant sum of money in legal fees to simply assert the rights I had been awarded in court. Fortunately I was able to mitigate the situation though I have no assurance that a similar situation will not occur in the future. What has been made clear to me is that I will be on my own and to expect no assistance from CCPD or the city of Corpus Christi. I would have been better off voicing my concern to the offending officer directly were it not for the potential risk of arrest. Once one becomes accustomed to the practice of abusing their authority or position without consequence the probability of future bad acts only increases. I welcome y'alls advice, counsel or intervention in regards to this yet unresolved or accounted matter. I will be sending a certified mail copy of this email in the following days. 1 Thank You.
