PUBLIC COMMENT - AUDIENCE AND PRESENTER SOCIAL DISTANCING AND PUBLIC TESTIMONY AND PUBLIC HEARING INPUT AT PUBLIC MEETINGS OF THE CITY COUNCIL. To reduce the chance of COVID-19 transmission, public meetings will be held in a manner intended to separate,to the maximum practical extent, audience and presenters from personal contact with members of Community, City Staff, and City Council. This meeting will be broadcast at cctexas.com/services/council meeting-agendas-minutes-video. Public testimony and public hearing input for Public Comment and all items on the agenda at public meetings of the City Council should be provided in written format and presented to the City Secretary and/or designee no later than five minutes after the start of each meeting of the City Council. Testimony and/or public input shall be in accordance with the City Secretary's instructions, which shall be posted on the City Secretary's door and on the City website, and allow for electronic submission. CITY MANAGER'S COMMENTS/ UPDATE ON CITY OPERATIONS: Mayor McComb referred to City Manager's Comments.City Manager Peter Zanoni reported on the following topics: 1)Financial Updates.2)The City's credit rating was upgraded despite the economic downturn;the utility revenue bond has been upgraded and the City's credit worthiness is in the highest rate category;the upgrade will help keep the City's interest rates low as we borrow money to improve our water and City of Corpus Christi Page 2 Printed on 6/19/2020 City Council Meeting Minutes June 16,2020 sewer systems,as well as capital maintenance;the low interest rate will also help the City to refinance about$23 million in existing debt.3)Financial Policies are reviewed annually as the City develops a budget; reserve requirements;funding levels and street maintenance;Capital Improvement Plan;and beach maintenance funding and hotel occupancy tax funds.4) Northwest Boulevard Corridor plan in Calalien includes three schools and shopping attractions;the corridor covers the 3 mile stretch from Interstate 69 to CR73;will provide opportunities to improve safety and influence future public investment;the City is partnering with TXDOT to get it done;and a survey can be completed online at corridorscc.com. Visit Corpus Christi CEO Brett Oetting presented information on the following topics: Billboards;Strategic Plan 2021-2024;Timeline;Scenario Models& Assessment Tool;and Assessment Date. a. GOVERNMENT ACTIONS RELATED TO CORONA VIRUS Director of Public Health District Annette Rodriguez presented an update on COVID 19: COVID-19 testing;additional testing capacity; notable cases in Nueces County;and public health prevention strategies. CONSENT AGENDA: (ITEMS 3 - 15) Approval of the Consent Agenda Mayor McComb referred to the Consent Agenda.City Manager Peter Zanoni requested that Item 3 be postponed due to the passing of Charles Kaffie,the husband of United Way CEO Libby Aveyrt. Council members requested that Item 4 be pulled for individual consideration. There were no comments from the Council. A motion was made by Council Member Molina,seconded by Council Member Guajardo to approve the Consent Agenda with the exception of Items 3 and 4. This Emergency Ordinance was withdrawn. 4. One-Reading Ordinance approving an agreement between the City of Corpus Christi and the Corpus Christi Business and Job Development Corporation in an amount up to$500,000 for Type A funding of arterial and collector streets within the City; approving a Chapter 380 agreement with the United Corpus Christi Chamber of Commerce in an amount up to $500,000 to administer a utility assistance program for small businesses in Corpus Christi impacted by the COVID-19 pandemic; appropriating an amount up to$500,000 from the unreserved fund balance of the Business and Job Development Fund for use on the arterial and collector street improvements; amending the operating and capital budget. Mayor McComb referred to Item 4. Chief Financial Officer Constance Sanchez presented information on the following topics: this program will help support small businesses experiencing hardship due to COVID-19 by providing a one-time$500 utility bill credit to qualified small businesses;the Port of Corpus Christi has committed$250,000 and will give a$500 cash match to qualifying businesses;the eligibility requirements are as follows: must employ 3 to 20 full or part-time employees; must have been in business for at least 12 months;gross revenue of no more than a million dollars;must be located in Corpus Christi; loss of 25%revenue beginning March 1,2020 as compared to this time last year;and businesses must remain open for at least three months after accepting this grant award. Council Members,City Manager Peter Zanoni and Chief Financial Officer Sanchez discussed the following topics: a Council Member's concern that$500 is not going to keep a business open;about 1,600 small businesses could qualify;this money is not only for businesses with delinquent accounts;a Council Member's concern that some small business owners can't afford to get a loan and become more in debt;$500 is a lot of money to some businesses by helping pay for their utility bills;the$500 is to assist small businesses,not to bail them out;the small businesses must be a commercial account;the mom-and-pop businesses are the ones hurting the most;and a Council Member's comment that some small business owners work alone without any other staff. Council Member Barrera made a motion to amend the 380 Agreement to employ no more than 20 employees,seconded by Council Member Guajardo. The motion carried by a unanimous vote. Council Member Guajardo made a motion to approve this ordinance as presented,seconded by Council Member Barrera. Ordinance closing, abandoning and vacating an unimproved 1.8-acre portion of Starry Road out of Flour Bluff and Encinal Farm and Garden Tracts for development of a new subdivision. (District 5) This Ordinance was passed on second reading on the consent agenda. Enactment No: 032138 8. Ordinance accepting a grant in the amount of$228,129.00 from the State of Texas Governor's Homeland Security Grants Division for Operation Stonegarden for border security; and appropriating $228,129.00 in the Police Grants Fund. This Ordinance was passed on second reading on the consent agenda. Enactment No: 032139 9. Ordinance authorizing the acceptance of a grant from the Office of the Attorney General-Office of Juvenile Justice and Delinquency Prevention for the Internet Crimes Against Children (ICAC) Task Force program, in the amount of$10,000.00 to purchase equipment and supplies for the City of Corpus Christi Page 6 Printed on 6/19/2020 City Council Meeting Minutes June 16,2020 ICAC program within the Police Department; and appropriating the $10,000.00 in the Police Grants Fund. Ordinance authorizing acceptance of$15,000 grant from the Coastal Bend Regional Advisory Council for the City's WebEOC operations; and appropriating $15,000 into Fire Grant Fund. This Ordinance was passed on second reading on the consent agenda. Enactment No:032141 11. Ordinance authorizing the Interlocal Agreement with Nueces County for City Lifeguard Services. The City will provide 4 lifeguards at the public beach within Nueces County Padre Balli Park from 3 lifeguard stands dispersed between Access Roads 5 and 6 for the period of May 22 through September 7, 2020. Nueces County will reimburse the City for the costs of lifeguard services, equipment and supplies at a cost of $40,700 to be appropriated into the General Fund. This Ordinance was passed on second reading on the consent agenda. Enactment No:032142 Consent-Contracts and Procurement 12. Resolution authorizing a three-year service agreement with Siddons-Martin Emergency Group in an amount not to exceed $1,200,000.00 to provide fire apparatus parts and maintenance services for the Corpus Christi Fire Department (CCFD), upon notice to proceed, with FY 2020 funding in an amount of$100,000.00 available through the General Fund. This Resolution was passed on the consent agenda. Enactment No: 032143 13. Motion authorizing the purchase of two Ford F350 trucks with air conditioned animal control units from Silsbee Ford, Inc, in an amount of $123,137.92, for Animal Care Services (ACS), effective upon issuance of letter of acceptance with FY 2020 funding available through the General Fund in the amount of$123,137.92. This Motion was passed on the consent agenda. Enactment No: M2020-102 14. Executive session pursuant to Texas Government Code § 551.074 (Personnel Matters) to deliberate the appointment, employment, evaluation, reassignment, duties or discipline of City Auditor. The Council went into Executive Session at 1:37 p.m. The Council returned from Executive Session at 2:06 p.m. Council Member Smith made the following motion,seconded by Council Member Barrera. Motion to authorize Kimberly Houston,Interim City Auditor,to have until September 30,2020 to become certified as a Certified Internal Auditor as a result of testing sites being closed because of the COVID-19 pandemic.She shall automatically be considered the City Auditor at such time as she obtains her Certification as a Certified Internal Auditor. Ordinance authorizing a Professional Services Agreement for design services with Lockwood, Andrews & Newman, Inc. for the North Beach Navigable Canal project in an amount not to exceed $508,988 for Phase I services which include a determination of the project scope and limits and whether or not the canal will function as a major drainage facility and be navigable, located in City Council District 1, with funding available from financial reserves within the Storm Water Capital Funds. Mayor McComb referred to Item 18. Director of Engineering Services Jeff Edmonds presented information on the following topics: North Beach navigable canal; project location; project vicinity; navigable canal exhibit;and project scope. Council Members,Director Edmonds and City Manager Peter Zanoni and Business Group Director of Lockwood,Andrews&Newman,Inc.(LAN)Steve Gilbreath discussed the following topics: the status of North Beach canal project going forward;a pre-bid conference for this project was well attended, but there were no bidders; LAN was the only firm that submitted their qualifications;the presentation outlined the scope of project,but it was not delineated in the scope of the agreement;the purpose of two phases 1)the first phase is for the design study;and 2)the second phase is for staff to figure out if it will work out as they hoped;staff recommends doing it incrementally;can this project be completed in less than six months;this project is not going to be reimbursed by the TIRZ#4 fund;and half of the funds are reserved for phase two. Police officers are often called upon to intervene in situations for which they have little training and few resources, such as housing homeless folks.The police need comprehensive crisis management training.On average, police officers in the US receive 8 hours of crisis management training compared to 112 hours of firearm training.This ratio greatly increases the likelihood officers will use lethal force. Police funding needs to be diverted to strengthening programs for communities of color, providing resources for homelessness, and increasing services for people with mental illnesses.This will decrease the number of situations in which the police are called upon to intervene and better serve these communities in the long run. In the short term, measures like strangleholds need to be banned and police need to exhaust all measures before using lethal force. Like other small businesses, nonprofits have cut budgets with a grim outlook toward the rest of the year. Fundraisers have been cancelled and donations are down. While the economy is slowly reopening, donations are expected to remain low because donors can't give until they've rebuilt their own businesses or family finances. This program is aimed at smaller agencies that provide human services, educational services, business support or job training. Eligible nonprofits must provide services within the city limits and have a local governing Board. Preference will be given to those that do not receive significant government dollars. Many local nonprofit leaders have cut staff or reduced hours, taken pay cuts, limited programming and in extreme cases, are considering whether they can keep their doors open. Nonprofits play a crucial role, often providing services that otherwise would be expected of government. They do so with dedicated staff despite limited budgets and modest wages. Many nonprofits host their largest fundraisers in the spring. 2. Many corporate dollars were redirected to COVID response, thus drying up a usually reliable revenue stream for nonprofits. 3. For those events rescheduled for the fall, many corporations have already committed to events at that time of year and will not be able to extend more money for others; and in other situations, fundraising events (walkathons, Casino Night, golf events) that companies do for specific organizations have been cancelled as well. In general, nonprofits are planning for a drop in donations from companies and individuals because of the economic impact of the pandemic. This proposed collaboration can provide a measure of stability to the nonprofits in our community to allow them to continue serving the public good, particularly those smaller organizations with less capacity to access state and federal funding sources. However, in a building built to hold 300 children, we can only serve 60 in order to maintain distancing and safety guidelines. The Boys & Girls Club is a business and like all businesses must bring in enough income to meet operating expenses. Without our fundraisers and membership fees, the operating budget has taken a drastic hit from which we may not recover. As people begin to return to work, they need a safe place for their children; we are that place. Now the persistence of the virus and lack of mandates on protective measures has suppressed business even though they are allowed to be open. In other words this isn't over and won't be for some time. Nationally on average half of retail tenants have been able to pay their rent this Summer. Even a fraction of that will doom our local real estate market and your property tax base. Maybe it's not that bad here, maybe. For my part I've collected about 80%of rent the last three months, I've heard of one small landlord that was higher. Everyone else is lower, many much lower. Talking to my bankruptcy lawyer last week about a tenant bankruptcy he commented that several of his landlord clients are getting 30%or less of rent. So in this context what good will a $1000 do? 1. Every little bit helps. I for one have been furiously renegotiating leases and coming up with ways to help my tenants adapt. I bought a huge number of take-out reserved parking space signs and gave them out for free to my tenants. That's something I resisted allowing them to do four months ago but is now essential for a host of businesses to have. My lease doesn't require me to do it,just like you aren't required to support small business, but I realized by making an investment in their businesses I was making one in mine. Your$1000 may be the money that helps someone set up online sales, or buys a point of sale system they can use for curbside, or lets them stay open another month until customers return. 1 2. It's their money. This sales tax is paid by small retail and service businesses. Usually the deal is they all pay and get customers in the form of new plants or primary job businesses. That's a good deal but right now with business expansions on hold we need to support the people who pay the tax in the first place so when things do improve they are still there. 3. Most important is psychological. It shows you see them, recognize their importance,and value them. The closet way to describe the frame of mind of my tenants right now is of a family after a death. Some are in denial, some despair,and some enraged.This vote tells them you notice that they are in distress and want to help. That is just as important as the value of the money. The fact I've spent every day working to help my tenants rather than sit back and bemoan something I can't control is why I can explain so many of mine are doing better than others. That's a lesson for you as well. You can't save everyone but you can certainly try to save as many as you can. Trying has a positive impact, ignoring the problem will not make it go away. Just as I have I am sure you will find it pays dividends. Every retail tenant that survives this will pay sales tax,a utility bill,and the property tax associated with their rent. These grants represent less than 1%of the city's annual budget and are to be used to help a significant portion of your tax base. Every job it saves is one less you will have to work or incentivize to be created in the future. It's a good investment. I urge you to pass it. The only alteration I would consider is dropping the employee requirement so mom and pop retailers can access it. I have a number of businesses that are either run entirely by an individual,a couple,or operate without traditional employees. For instance half of hair salons,and a good chunk of nail salons, dance/exercise studios, and small retailers wouldn't meet the threshold you've laid out. I understand not wanting to subsidize "work from home"type businesses that don't have property,sales, or utility tax/bill footprint which I imagine is the source of the restriction. The mandate to shut down businesses in an effort to slow the spread of Covid-19 has done severe harm to businesses of all sizes but particularly to locally owned small business. Many will never reopen. Those that are opening are struggling with debts that accumulated during the closure from back rent to utilities. A grant of any size could be the difference in keeping the lights on or going dark permanently. We operate Hardknocks Sport Grill. Even when we were allowed to open for carry out only our revenue plunged 85%. Our fixed cost of operation didn't drop 85%. Today have water, gas, electric bills, back rent, taxes to pay.
