Home My WebLink About032145 ORD - 06/23/2020 Ordinance authorizing Developer Participation Agreement with MPM Development, LP, to reimburse developer up to $874,000 for oversizing required for a master planned water grid main; authorizing Water Grid Main, Water Distribution Main, Wastewater Trunk Main, and Wastewater Collection Line Extension Construction Reimbursement Agreements with MPM Development, LP to install grid mains, water distribution mains, wastewater trunk main, and wastewater collection lines for a planned residential subdivision with completion within 18 months; appropriating $154,126.23 from the Water Arterial Transmission & Grid Main Trust Fund, $16,673.25 from the Water Distribution Main Trust Fund, $75,706.88 from the Sanitary Sewer Trunk System Main Trust Fund, and $45,607.42 from the Sanitary Sewer Collection Line Trust Fund to reimburse the developer per the agreements. WHEREAS, City Ordinance 032063 amended the City's Water Distribution System Master Water Plan for South of Oso Creek to provide a new alignment of the 16" Grid Main located on County Road 33 requiring oversizing for Kings Landing subdivision; WHEREAS, it is in the best interests of the City to have the water distribution system infrastructure installed by the Developer in conjunction with the Owner's final Plat; WHEREAS, Section 212.071 of the Texas Local Government Code authorizes a municipality to make a contract with a developer of a subdivision or land in the municipality to construct public improvements related to the subdivision or land; WHEREAS, under the UDC, the Developer is eligible for reimbursement of the Developer's costs for the construction of the sanitary sewer trunk main line, water arterial and grid main line, wastewater collection line and water distribution line; WHEREAS,the Developer has submitted an application for reimbursement of the costs for installing the Trunk Main Line, Collection Line, Water Grid Main; and Distribution Line; and WHEREAS, it is to the best interest of the City that the wastewater trunk main line, water arterial and grid main line, wastewater collection line and water distribution line be constructed to its ultimate capacity under the City's applicable Master Plan; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Manager or designee is authorized to execute a developer participation agreement("Agreement")with MPM Development, LP, ("Developer"), for the City's participation of the cost to construct the 16-inch Master Planned Water Arterial Transmission and Grid Main Line in order to complete the Grid Main Loop, between CR-33 and FM-43, in accordance with the adopted Water Master Plan South of Oso Creek, Corpus Christi, Nueces County, Texas. SECTION 2. Funding in the amount of $874,000.00 is appropriated from the No.4010- 21805 Water Fund; Q SECTION 3 . The City Manager or designee is authorized to execute a Water Arterial z Transmission and Grid Main Construction and Reimbursement Agreement, Distribution Main Line Construction and Reimbursement Agreement, Wastewater Trunk Main Line Construction Reimbursement Agreement, and Wastewater Collection Line Extension Q Construction and Reimbursement Agreement attached hereto, with MPM Development, LP for the construction and installation of a 16-inch and a 12-inch water transmission and grid main line, a 8-inch water distribution main line, a 18-inch wastewater trunk main line, and a 032145 12-inch wastewater collection line, for the development of the platted property known as Kings Landing, Corpus Christi, Texas. SECTION 4. Funding in the amount of $154,126.23 is appropriated from the No.4030- 21805 Water Arterial Transmission and Grid Main Trust, and $16,673.25 is appropriated from the No. 4030-21806 Water Distribution Main Trust Fund, $75,706.88 is appropriated from the No.4220-21800 Sanitary Sewer System Trunk Main Trust Fund and $45,607.42 is appropriated from the No. 4220-21801 Sanitary Sewer Collection Line Trust Fund, to reimburse the Developer for the construction of a 16-inch and a 12-inch water transmission and grid main line, a 8-inch water distribution main line, a 18-inch wastewater trunk main line, and a 12-inch wastewater collection line, and construction improvements in accordance with the Agreements.
