E. PUBLIC COMMENT- AUDIENCE AND PRESENTER SOCIAL DISTANCING AND
PUBLIC TESTIMONY AND PUBLIC HEARING INPUT AT PUBLIC MEETINGS OF
THE CITY COUNCIL.To reduce the chance of COVID-19 transmission, public
meetings will be held in a manner intended to separate,to the maximum practical
extent, audience and presenters from personal contact with members of
Community, City Staff, and City Council.This meeting will be broadcast at
cctexas.com/services/council meeting-agendas-minutes-video. Public testimony
and public hearing input for Public Comment and all items on the agenda at
public meetings of the City Council should be provided in written format and
presented to the City Secretary and/or designee no later than five minutes after
the start of each meeting of the City Council.Testimony and/or public input shall
be in accordance with the City Secretary's instructions, which shall be posted on
the City Secretary's door and on the City website, and allow for electronic
submission.The written public testimony shall be provided to members of City
Council prior to voting on measures for that meeting.Written testimony shall be
limited in accordance with the City Secretary requirements and shall be placed
into the record of each meeting.This testimony shall serve as the required public
testimony pursuant to Texas Government Code 551.007 and shall constitute a
public hearing for purposes of any public hearing requirement under law.The
meeting may be held telephonically or via videoconference.The public may

F. CITY MANAGER'S COMMENTS I UPDATE ON CITY OPERATIONS:
Mayor McComb referred to City Manager's Comments.City Manager Peter
2anoni reported on the following topics: Bay Ltd.laid off a large number of
employees due to the pandemic. The City is two years behind on bond-funded
street maintenance program. Bay agreed to hire back staff to expedite the
street work. The work should be completed by August 2021.
a. GOVERNMENT ACTIONS RELATED TO CORONA VIRUS
Director of Public Health District Annette Rodriguez presented an update on
COVID 19: COVID-19 statistics for the U.S.and Texas;mortality count by month;

PCR and serology positive cases per age group; 16 to 25 and 30 to 40 year
olds=super spreaders;pharmacy prescriptions;health district phone bank;
convalescent plasma donation;and offers for testing supplies.
Council Members,City Manager Peter Zanoni and Director of Public Health
District Annette Rodriguez discussed the following topics: physicians do not
feel comfortable using corticoid steroids at this time;the statistics will be
posted on the City's website;the Department of State Health Services will take
over the contact tracing if the City has more than 50 per day;a Council
Member's concern that the delay in getting test results is inadequate for
contact tracing;standing orders are put in place for nursing homes and jails
moving testing over to pre-treatment;vitamins are being offered to individuals
who test positive to COVID-19;a Council Member reported that business
owners are offering the use of their facilities for storage;the health district is in
need of analyzing 750 test kits;no word from the Governor on another stay at
home order;people are being told to stay home until their results come back;
a Council Member's concern about schools re-opening;and the Mayor and City
Manager had a meeting with the superintendents concerning the plan for
school starting back up,including charter,public schools and colleges.

1. Regular Meeting of June 23, 2020
A motion was made by Council Member Molina,seconded by Council Member
Roy that the Minutes be approved. The motion carried by a unanimous vote.

Mayor McComb referred to the Consent Agenda. Council members requested
that Items 16 and 18 be pulled for individual consideration. City Manager Peter
Zanoni requested that Item 11 be withdrawn from the agenda.
There were no comments from the Council.
A motion was made by Council Member Garza,seconded by Council Member
Guajardo to approve the Consent Agenda with the exception of Items 11,16

off-site repairs to Peterbilt vehicles and equipment for Asset
Management, effective upon issuance of notice to proceed, with FY 2020
funding in the amount of$218,250.00 available in the Fleet Maintenance
Service Fund.

Mayor McComb referred to Item 16.
Director of Engineering Services Jeff Edmonds presented information on the
following topics: cross section;Lindale area;and typical road bond project
cost breakdown.
Council Members and Director of Engineering Services Jeff Edmonds discussed
the following topics: a Council Member's concern regarding the funding
process;the bond projects usually get started with limited information and
information is sometimes unknown until the design process begins;the
timeline for the project to be fully contracted is approximately six to eight
weeks;a Council Member's request for additional construction to be done from
Reid Drive to Glazebrook Drive;and an additional$800,000 will need to be
identified for that construction.
Council Member Molina made a motion to approve this motion,seconded by
Council Member Smith. This Motion was passed and approved with the
following vote:

17. Resolution amending Financial Budgetary Policies adopted by
Resolution 031821 and providing financial policy direction on preparation
of the annual budgets.

18. Resolution authorizing developer participation agreement with Walker
Holdings and Development, LLC to reimburse developer up to
$698,177.56 for construction of Silverado Drive, Emory Drive and
stormwater drainage channel improvements as part of a City initiated
effort to incentivize single-family housing in Calallen near Steel Dynamics
plant in nearby Sinton, Texas. (District 1)
Mayor McComb referred to Item 18.
City Secretary Huerta announced that Council Member Roy would be recusing
himself from the vote.

Director of Development Services Al Raymond presented information on the
following topics: master preliminary plat; location and zoning map;project
map streets;project map drainage;vicinity map to Steel Dynamics;and staffs
recommendation.
Council Members,City Manager Peter Zanoni,Developer of Walker Holdings
Lance Walker,Director Raymond,and Mike Johnston with Development
Services discussed the following topics: the Unified Development Code has
prohibitive language and gives the City latitude for participation agreements;a
Council Member's concern that the City develop a formal policy regarding
vacant land;at least 50%of Steel Dynamics workforce will live In Corpus
Christi,and in particular the Calallen area,and the other 60%will live in the
Rockport area;housing development in the Calallen area is more challenging
because of the storm water run off and drainage situations;the City's financial
participation will help with the drainage and road conditions;Calallen has
some great amenities such as school districts and parks;there is ample fire
and police protection nearby;if public improvement district options were
considered for funding of this project when discussing it with the developer;
public improvement district's place an additional assessment on the home;the
concrete roads constructed by the developer were an exception to the UDC;
5699,000 is a lot of money for a small number of lots;what is the total plan for
the acreage,and are the drainage channels temporary or permanent;the
homes will range from 5200,000 to 5280,000,the school system is strong,and
there are shopping and amenities nearby;the layout of the subdivision is nice
with more cul-de-sacs and all brick homes;an HEB could be built on Northwest
Blvd.in the future;this is a one time investment for the City;everyone needs to
play by the same rules for projects;Development Services is in the process of
updating and amending the UDC;the UDC does not prohibit funding of
residential collector streets;the focus is being in compliance with the state
regulations,but the UDC is just for guideline purposes and has no enforcement;
and the money is coming from the bonds not the budget
Council Member Barrera made a motion to approve this resolution,seconded

South Texas Botanical Gardens&Nature Center-Oso Creek Loop Trail.

topics: the final approval from Texas Parks and Wildlife will be sometime
between September and April.

20. Ordinance changing the name of William Street to Lomax Street located
in City Council District 1. (Requires at least 3/4 majority vote for approval)
Mayor McComb deviated from the agenda and referred to Item 20.
Director of Public Works Department Richard Martinez presented information
on the following topics: section 7 of the City policy;only one objection from
the Landmark Commission;and the requester agreed to pay the cost of
replacing all the street signs.
Mayor McComb opened the public hearing. The following individual submitted
written public comment,which was read into the record:

the following topics: a Council Member Is in support of this Item,but it goes
against the Council policy;a Council Member's request to preserve the history
by having a ceremonial street name placard with the existing street name;the
street name would be legally changed to Lomax,but the placard would be an
honorary sign;the street name"William"is not named after the founder of the
City of Corpus Christi;and it is unknown who William Street was named after.

19. Special Board Meeting of the Corpus Christi Housing Finance
Corporation regarding the redevelopment of the Ward Building.

L. RECONVENE COUNCIL MEETING
Q. BRIEFINGS: (ITEM 221
22. Introduction presentation on the potential of a new Tax Increment
Reinvestment Zone
Mayor McComb referred to Item 22.
Director of Finance and Business Analysis Heather Hulbert presented
information on the following topics: project overview;project aerial view;
project master plan;TIRZ parameters;townhome elevation;townhome
example;and next steps.
Council Members,City Manager Peter Zanoni,Director Hulbert,Travis James
with TXP,and TIRZ Developer Roberto Santos Williams discussed the following
topics: this TIRZ was petitioned for a single developer;the board will be
composed of landowners and taxing entity representatives;a Council
Member's request to fund the development with a Public Improvement District
rather than a TIRZ;the board would be represented by the developer,but the
City Council will still make the ultimate decisions;this is a no risk development
for the City;if the developer does not perform,the City is not required to
reimburse them;$29,000 is the tax amount collected,but the baseline value is
about$2 million;$11.8 million is the City's participation over a 20 year period if
the development occurs;a Council Member's concern about administrative
costa as seen in TIRZ 84 and TIRZ's should be used for revitalization not for
green field development;the dollars generated by creating this TIRZ is for road
infrastructure; roads would be beyond the development of the housing;the
money in this TIRZ would be used for public infrastructure only;due diligence
regarding the financial strength of the developer;a Council Members concern
if the value of TIRZ's are geared towards commercial development and not
residential;does the land lose its agricultural exemption if a TIRZ is created;
the developer has to build his project in order for there to be new tax growth;
does the agricultural value or the market value go into the TIRZ;the currant
agricultural exemption would be lifted step by step or phase by phase;and a

Council Member's concern that the creation of TIRZ's is taking away money
from the whole community.

Mayor McComb,members of the City Council thank y'all for having me here for public comment;My
name is Oscar Dodier and I am a concerned Corpus Christi Native.
On Tuesday May 12th,the Mayor and the City Council voted an ordinance of continuation of the local
state of Disaster as related to COVID 19...pursuant to the Texas Government Code 418.108 the"Texas
Disaster Act"with the mayor designated as the Emergency Management Director of the City of Corpus
Christi.
Over several weeks, up until Friday,June 12`1,2020 Corpus Christi Convention and Visitors Bureau Along
with the Mayors Office has resourced over 13 major sponsors and 15 partners that have helped to fund
the the 4th of July Bing Bang Celebration and fireworks show. Currently on the event Facebook page
there are 6,560 likes for the hashtag#BIGBANGCC;a significant number of citizens interested in
participating in this public gathering.

Just a few days later on Friday,June 19t a News Release was sent out via City of Corpus General Email
address noting that the Mayor's 4th of July Big Bang Celebration was still on,with informal note for the
public to"watch the show from their vehicle".
Later on that same day, Friday,June 19`",2020 the Conrad Blutcher Institute in association with Texas,
A&M University Corpus Christi published this article stating that "A surge in positive cases of COVID19 in

close to Houston. This may be the most alarming trend for South Texas.Also noted in this article is that
"data obtained from cell phones shows the number of people going to restaurants,grocery stores and
malls has returned to pre pandemic Ievels...[COVID19] "is now being seen across ALL AGES"..."at this
point everyone is getting it".
On Monday,June 22"Nueces County Judge Barbara Canales and county commissioners issued
resolution AI-12138(vote pending 6-25-2020) regarding mandating wearing a face covering at
all county facilities and mandating social distancing of 6 ft.as well. Noting that"transmission of COVID-
19 has not dissipated but remains a significant threat to the health and safety of the residents of
Nueces County".
Which is why I:
make a motion to amend todays agenda to allow a vote on safeguarding citizen attendees of the City
of Corpus Christ Mayor's the 4*of July Big Bang Celebration by mandating that all observers and
participants stay inside their vehicles to properly social distance while also wearing math.

If no amendment or discussion is possible then I remind the council that personal injury lawsuits are
based upon negligence,which creates legal liability when a party had a duty of care to an individual,
failed to reasonably exercise that care,and that failure of care caused an injury. Premises liability is
rooted in negligence when an injury is claimed to have been caused by an unsafe or defective
condition on someone's property that the property owner knew or should have known presented a
risk of injury to visitors.Generally,a property owner owes a duty of care to all visitors on its property.
In this case the TRANSMISSION OF COVID 19 BETWEEN NON SOCIALLY DISTANT citizens and resulting
infections and hospitalizations represent a major risk to public health at this July 4th Event.
A simple,general email is arguably NOT"reasonable care"to prevent a visitor's injury during a
pandemic, during a locally declared state of Disaster.

My comment to the city council and Judge Canales:We had stay at home orders,gyms were closed, everyone did
curbside,etc.when the virus had not even yet reached the coastal bend (we were not experiencing community spread).
How is it possible that now, when the cases are increasing exponentially,we do not shut it down?We are playing with
fire and playing with peoples lives for the sake of the economy. Unacceptable. Please! Implement stay at home orders,
close gyms,close dine-in restaurants.This is the time to make a difference and stop the spread by taking it seriously. If
we do this for a few weeks, it will have a greater impact than maintaining stage 2 or 3 of re-opening,dragging it out, and
having more cases and deaths.

We have always gone fishing under the causeway bridge.in march 2020. To bring my Son with us. He
immediately caught on .the RV'S there. He asked. Do they not have to pay rent. Like the rest of us do. How is
the sanitation. That was our 1st . Recognized visit. To may . 2020. He saw the same RV'S. Are still there. Do
they pay rent ..?. The beaches make us buy our passes. To say. We went out june 26.2020. The same RV'S
are parked under the causeway bridge. Are we just ignoring this problem . Again there is so much trash. Along
the area. Even with them picking it up .. is it a safe area. With these people inhabiting it. Like this is their area.

I have two topics I wish to comment on and ask for assistance in. First, as the concern for COVID 19 rises and Corpus
Christi is hit hard; we are asking police to do things that may harm the already tenuous light they are seen in. Texans are
generally smart and able to come up with ways to stay safe. As you cannot cure stupid or stop a virus,we should treat
all of our citizens as essential and allow them to pursue the right to happiness by returning to work. They can submit
plans to keep people safe. We need our rights restored. I have written to Governor Abbot and other elected officials
regarding this and advocating for local control as locals know how much people are in need.
Also, before our police feel unwanted here in our great state of Texas,we need to make sure they know how much they
are appreciated for all they do. Please let them know we support them and without them would have to defend
ourselves as Texans are willing to do. Police are better trained for this. Can we start locally and find ways to improve
communication with the loud generation that do not appear to have correct facts but we can all do better. We need to
work together and make sure that we have good police officers and keep the good ones that we have. Please let me
know if I can help in this endeavor.

As a retired healthcare worker, I am concerned about the comments on local news channels related to expending funds
to prepare the old Spohn Memorial Hospital to function as an alternative location for ICU beds for Covid-19 patients. As
you should know,such a renovation will be costly and not completed in time to serve the immediate needs of the
county and region.
It would make more sense to ask Gov.Abbott to request the Army Corps of Engineers to build a temporary hospital, as
we have seen them do in other cities in a very short time.

Yesterday Sunday the 12 of July,the flea market was open at the old greyhound race track with many many people
there also there was some kind of motorcycle club doing some riding around in the parking lot.There had to have been
at least 200 people and not all with masks. People are not listening to the crowd size recommendations,the mask

A-weighted sound level means the sound pressure level in decibels as measured on a sound level meter using
the A-weighting network. The level so read is designated dB(A) or dBA.
Entertainment district means the downtown, bayfront, and port areas delineated in the entertainment district
map, a copy of which is incorporated by reference and is on file with the city secretary's office.
Noise nuisance means any loud, irritating, vexing or disturbing sound originating from a nearby property
under separate ownership which causes injury, discomfort, or distress of a person of reasonable nervous
sensibilities, or any sound that exceeds the maximum permitted sound levels specified in section 31-3.
Nonresidential property shall mean any real property that is not included in the definition of residential
property as defined in this section. Without limitation, the term includes properties that have been developed
other than as residential properties, properties that are undeveloped, and properties that are devoted to public
purposes, such as public streets and parks.
Residential property shall mean any real property developed and used for human habitation that contains
living facilities, including provisions for sleeping, eating, cooking, and sanitation, unless such premises are
actually occupied and used primarily for purposes other than human habitation.
Sound level means the weighted sound pressure level obtained by the use of a sound level meter and
frequency weighting network as specified in American National Standards Institute specifications for sound level
meters. If the frequency weighting employed is not indicated, the A-weighting shall apply.
Sound level meter means an instrument which is used to measure sound pressure levels.

• Sec. 31-2. - Noise nuisance enumeration.
(a)
The following acts. among others not hereinafter enumerated, are declared to be "noise nuisances," and are
unlawful and in violation of the provisions of this chapter when such acts are done or accomplished or carried on
in such a manner, or with such volume, intensity, or with continued duration, so as to annoy, to distress, or to
disturb the quiet, comfort, or repose of a person of reasonable nervous sensibilities, within the vicinity or hearing
thereof, or so as to endanger or injure the safety or health of humans or animals, or so as to interfere with the
physical well being of humans or animals, or so as to endanger or injure personal or real property:
(1)
The playing or permitting or causing the playing of any radio, television, drum, juke box, musical instrument,
sound amplifier or similar device which produces, reproduces, or amplifies sound.
(2)
The keeping of any animal, fowl, or bird, which makes frequent or long, continued noise.
(3)
The continued or frequent sounding of any horn or other signal device on any automobile or vehicle, motorcycle,
bus or other vehicle. except as a danger signal.
(4)
The discharge into the open air of the exhaust of any steam engine, stationary intemal combustion engine,
automobile, motorcycle, or other motor vehicle or boat, except through a properly installed muffler or other
device which prevents loud or explosive noises therefrom.
(5)
The crying, calling, or shouting, in person or by a mechanical device, or the use of any whistle, rattle, bell, gong,
clapper, hammer, drum, horn, loudspeaker or phonograph with or without an amplifier, hand organ, or other
devices or instruments, musical or otherwise.
(6)
The raucous shouting, whistling, yelling, singing, hooting, or crying of peddlers, hawkers, vendors or any other
persons.
(7)
The creation of any unreasonably loud, disturbing, and unnecessary noise on any street or sidewalk adjacent to
any school, hospital, or court which is in session.

• Sec. 31-3. - Noise violation decibel readings.
(a)
It shall be unlawful for any person to conduct, permit, allow, or produce a sound that is discernable beyond the
property lines of the property on which the sound is being produced that,when measured with a sound level
meter using the standardized frequency weighting as specified by the American National Standards Institute,
exceeds the applicable dB(A) level listed below for the property on which the sound is received:
(1)
Seventy(70)dB(A) between the hours of 8:01 a.m. and 11:00 p.m. Sunday through Thursday and between the
hours of 7:01 a.m. and 12:00 midnight on Friday and Saturday.
(2)
Sixty (60) dB(A) between the hours of 11:01 p.m. and 8:00 a.m. Sunday through Thursday and between the
hours of 12:01 a.m. and 7:00 a.m.on Friday and Saturday and between the hours of 12:01 a.m. and 8:00 a.m.
on Sunday.
(3)
Eighty-five (85)dB(A)for sound that both originates from and is received on property within the Entertainment
District, at all times.
(b)
The dB(A) levels set forth in this section apply to the property where the sound is being received.Any sound that
when measured at the property where the sound is being received exceeds the dB(A) level set forth in this
section is a violation of this chapter.
(c)
Any sound originating from Cole Park shall not exceed seventy(70) dB(A)when measured from any private
property.

• Sec. 31-4. - Vibration.
It shall be unlawful for any person to create, maintain or cause any ground or airborne vibration which is
perceptible without instruments by a person at any point on any affected property adjoining the property in which
the vibration source is located unless such activity is otherwise regulated under state or federal law.

• Sec. 31-5. - Vehicular mounted sound amplification systems.
It shall be unlawful for any person operating or controlling a motor vehicle in either a public or private place
within the city to operate any sound amplifier which is part of, or connected to, any radio, stereo receiver,
compact disc player, cassette player, or other similar device in the motor vehicle, in such a manner that, when
operated, is audible at a distance of thirty (30) or more feet from the source or, when operated causes a person
to be aware of the vibration accompanying the sound in any location outside the confines of the vehicle emitting
the sound, noise, or vibration.
I live on 2633 Riggan St. It's directly next to the car wash on 2643 Riggan Street. I call up to four times a day
regarding the noise level that goes on at this car wash. It's unbearable.I've been dealing
with this day in and day out there's people who park there at 12 in
the morning and they'll stay there till 3 and I can't handle it
anymore. My landlord has written letters to six different people who
come up under ownership and they have made no response. I am
a mother of a child under a year old and I am desperately asking
you to please take action.

I have some concerns about this item as it relates to the overall development policies of he city.
1. Although allowed by Section 212.071 of the Local Government Code, this reimbursement is
contrary to participation rules set forth in the Unified Development Code (UDC), the
applicable sections quoted below. Only one of these streets is identified on the Urban Transportation
Plan as a collector so per the UDC is not even eligible for city participation.
8.4. City Participation in Streets and Drainage Crossings
8.4.1 A. All Streets
Where the Urban Transportation Plan or project specific traffic analyses indicate the need to construct
new streets or reconstruct existing streets to a level higher than that of a residential collector, the
City may pay additional construction costs with regard to right of way dedication, pavement thickness
and street width greater than those of a minor residential collector street cross-section, provided that
all of the following conditions are satisfied:
2. The UDC has no rules for participating in drainage facilities other than for street crossings. The
drainage ditches here are temporary and as future phases of the development are built, underground
storm sewer systems will replace them. The developer made a choice to start the first phase of the
development on the upstream part of the property. Also, by participating, does this obligate the city to
maintain the ditches should future phases of the development not happen in a timely manner. (this
has happened before and the city ended up maintaining the ditch until that phase got built)
3.The street segments that are being proposed for reimbursement are those from US 77 to where the
residential lots begin. These long entry points were created by past owners who sold off the US 77
frontage_for commercial purposes and reaped the profits of those sales. The current developer was
well aware of these circumstances when he purchased the property and should have accounted for
their costs when pricing the lots.
4.The agenda memo states that this is part of an economic development initiative for the Northwest
area of the City. I'm not sure such an initiative was ever formally approved by the council. The memo
also says it's to incentivize single-family housing in Calallen near the Steel Dynamics Plant in nearby
Sinton, Texas. (District 1). If there is a demand for housing in this area, won't the market respond to
provide without city involvement?
To me this sets a precedent for the city to guide development rather than let market forces control
where the city develops. Are other developments going to be able to get this degree of participation

by just asking? The development community needs to be playing by the same rules for fairness and
equity.
