THE CITY COUNCIL. To reduce the chance of COVID-19 transmission, public
meetings will be held in a manner intended to separate, to the maximum practical
extent, audience and presenters from personal contact with members of
Community, City Staff, and City Council. This meeting will be broadcast at
cctexas.com/services/council meeting -agendas -minutes -video. Public testimony
and public hearing input for Public Comment and all items on the agenda at
public meetings of the City Council should be provided in written format and
presented to the City Secretary and/or designee no later than five minutes after
the start of each meeting of the City Council. Testimony and/or public input shall
be in accordance with the City Secretary's instructions, which shall be posted
on the City Secretary's door and on the City website, and allow for electronic
submission. The written public testimony shall be provided to members of City
Council prior to voting on measures for that meeting. Written testimony shall be
limited in accordance with the City Secretary requirements and shall be placed
into the record of each meeting. This testimony shall serve as the required public
testimony pursuant to Texas Government Code 551.007 and shall constitute a
public hearing for purposes of any public hearing requirement under law. The
meeting may be held telephonically or via videoconference. The public may

CAPTION:
One -reading Ordinance canvassing returns and declaring the results of the Runoff Election held
on December 15, 2020 in the City of Corpus Christi for the purpose of electing the Mayor and

SUMMARY:
To canvass the returns of the December 15, 2020 runoff election. Upon completion of the
canvass, the election results become official.
ALTERNATIVES:
None.
FISCAL IMPACT:
Based on the most recent final actuals for the 2018 general election and 2018 runoff election,
and because of the unknowns related to the COVID-19 pandemic, in FY 2021, staff has
budgeted a conservative amount of $200,000 for the general election and $150,000 for the
runoff election, if necessary.

Award of Construction Contract
Cole Park Pier Improvements
CAPTION:
One -reading ordinance awarding a construction contract to JM Davidson Ltd. for Cole Park Pier
Improvements, located in Council District 2, in an amount not to exceed $7,542,527.00;
appropriating $4,415,430.00 from the Type B Sales Tax Fund, $1,250,000.00 from the Community
Enrichment Fund, and $1,877,097.00 from the General Fund unreserved fund balance (to be
reimbursed to the General Fund after a deductive change order is executed) and amending the
operating and capital budgets.
SUMMARY:
This item awards a construction contract for Cole Park Pier Improvements and authorizes a change
order to de -scope aspects of the project. The project includes demolition of the existing pier,
construction of the new pier, and park improvements.
BACKGROUND AND PURPOSE:
Cole Park is one of the City's busiest regional parks and is highly used by residents and
visitors. Cole Park Pier was constructed in 1971 and is widely used for general recreation and
fishing. The pier was constructed with driven concrete piling with precast concrete caps that support
the precast walkway and fishing pier. In April 2018, the pier was closed for public access due to
public safety concerns from the pier's structural integrity. The pier structure subsequently
experienced a partial collapse of the first few concrete walkway panels connecting the pier to the
shoreline.
On July 23, 2018, Council passed a motion of direction to include $1,288,000.00 on the Bond 2018
program for splash pads and shade structures. During a subsequent Council workshop on August
10, 2018, Council passed a motion of direction to re -purpose the splash pad and shade structure
funds for restoration and improvements of the Cole Park and Dimitt fishing piers. The approved
funding for Bond 2018 was insufficient to complete the projects and additional funding would have
to be identified. The Bond 2018 brochure clearly stated that the approved Bond funding was partial
for project completion.
Since Bond 2018 approval, staff has been working to identify supplemental funding to complete
both pier projects. The Type A Board has pledged funds for the project. The Parks and Recreation
Department has also identified Community Enrichment Funds that can be utilized for the project.
Grant funding options were explored but the City was unable to identify any material source of
funding.
On February 11, 2020, City Council awarded a contract to Jacobs Engineering Group, Inc., for
preliminary design of the Cole Park Pier improvements and an amendment on July 21, 2020 to
complete the project design. Bids were opened were opened on December 9, 2020. The low bid
was submitted by JM Davidson, Ltd of Aransas Pass, TX in an amount of $7,542,527.00. The low
bid exceeds the available funding for the project. Staff has determined that the low bid is competitive
and recommends awarding the contract to JM Davidson. To complete the full scope of the project
as bid, an additional $2.2 million of funding would be required.
Due to the insufficient funds available to complete the full scope, staff is recommending that the
contract be awarded with the understanding that a deductive change order will be negotiated prior
to issuing the notice to proceed. The deductive change order has a value of $2.2 million less any
additional funds that may be identified prior to issuance of the notice to proceed early next year.
The change order will not shorten the length or materially change the pier structure itself. It will
however, remove, most of the proposed land side improvements and many of the architectural
features if additional funds are not identified.
PROJECT TIMELINE:
2021

Project schedule reflects City Council award in December 2020 with anticipated completion by
August 31, 2021. The contract completion date was originally scheduled for July 31, 2021 but JM
Davidson, Ltd has indicated that it would not be possible to meet that schedule with the precast
concrete manufacturing timeline. The contractor's anticipated completion date is August 30, 2021.
That is beyond the contract period of performance, however, the contractor has stated that he has
included liquidated damages in his bid and is willing to credit the City for those anticipated liquidated
damages as part of the change order if the completion date is adjusted.
COMPETITIVE SOLICITATION PROCESS
The Contracts and Procurement Department issued a Request for Bids. On December 9, 2020,
the City received bids from three bidders. The City analyzed the bids in accordance with the contract
documents and determined JM Davidson, Ltd. is the lowest responsive and responsible bidder. JM
Davidson has previously completed the Shoreline Protection project for Port Aransas Marina
Association, Replace Fishing Pier Project for Texas Parks and Wildlife and Marina and Docks
Survey, Repair and Redesign Project for University of Texas Marine Institute and other projects in
Texas. A summary of the bids is provided below:

ALTERNATIVES:
Council could reject the bids and re -advertise; however, that is not likely to produce a lower bid.
The design could be altered prior to re -advertising to better target available funds. Either of those
options will delay the Cole Park Pier project.
FISCAL IMPACT:
The fiscal impact in FY 2021 is an amount of $7,542,527.00 with funding available from the General
Fund, Type B Sales Tax Fund, and Community Enrichment Fund. Of the $7,542,527.00,
$1,877,097.00 from the General Fund unreserved fund balance will be reimbursed to the General
Fund after a deductive change order is executed.
FUNDING DETAIL:
Capital Improvement Program shows the funds for the projects will be funded through Community
Enrichment Funds, G.O. Bond and Grant Funds and Type A/B Sales Tax. Funds from G.O. Bond
and Grant funds were not available. There was a shortage of funds from Type A/B Sales Tax than
anticipated. The shortfall of funds will be funded from the unreserved fund balance of the General
Fund until a deductive change order is executed.

WHEREAS, on November 8, 2016, residents of the City of Corpus Christi (the
"City") passed Proposition 1, Adopt Type B Sales Tax to Replace Expiring Portion of Type
A Sales Tax, which authorized the adoption of a sales and use tax to be administered by
a Type B Corporation at the rate of one-eighth of one percent to be imposed for 20 years
with use of the proceeds for (1) 50% to the promotion and development of new and
expanded enterprises to the full extent allowed by Texas law, (2) $500,000 annually for
affordable housing, and (3) the balance of the proceeds for the construction, maintenance
and repair of arterial and collector streets and roads;
WHEREAS, the 1/8th cent sales tax authorized by passage of Proposition 1 was
subsequently enacted by the City Council and filed with the State Comptroller of Texas,
effective April 1, 2018, to be administered by the Corpus Christi B Corporation Board;
WHEREAS, the Board has determined that it is in the best interest of the citizens
of the City that Type B sales tax funds be used to pay for a certain public improvement,
namely the Cole Park Pier;
WHEREAS, the Project is consistent with the purposes for which the Type B sales
tax was created and approved by the voters of the City;
WHEREAS, Cole Park is a premiere park in the City, which enhances the City's
ability to attract tourism and business development;
WHEREAS, the pier in its current state of disrepair has become a blight on Cole
Park and a detriment to the economic development and tourist value of Cole Park,
necessitating demolition of the structure; and
WHERAS, demolition of the existing pier and construction of a new pier will serve
to beautify Cole Park, increase safety, and attract visitors, thereby enhancing the value
of Cole Park as a facility that promotes new or expanded business development;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. The City Council specifically finds that the foregoing statements included in
the preamble of this ordinance are true and correct and adopts such findings for all intents
and purposes related to the authorization of this project.
SECTION 2. That funds in the amount of $4,415,430.00 are appropriated from the
Type B Sales Tax Fund No. 1146 for the construction of a new Cole Park Pier (the
"Project").
SECTION 3. That funds in the amount of $1,250,000.00 are appropriated from the
Community Enrichment Fund No. 4720 for the Project.
SECTION 4. That funds in the amount of $1,877,097.00 are appropriated from the
unreserved fund balance of the General Fund No. 1020 for the Project.
SECTION 5. That the FY2020-21 Operating Budget and Capital Budget adopted by
Ordinance No. 032203 are amended to increase expenditures by $7,542,527.00.
SECTION 6. That the City Manager or designee is authorized to execute a construction
contract for Cole Park Pier Improvements in the amount not to exceed $7,542,527.00
with JM Davidson Ltd.
SECTION 7. Upon written request of the Mayor or five City Council members, copy
attached, the City Council: (1) finds and declares an emergency due to the need for
immediate action necessary for the efficient and effective administration of City affairs
and (2) suspends the Charter rule that requires consideration of and voting upon
ordinances at two regular meetings so that this ordinance is passed and takes effect upon
first reading as an emergency measure on this 22nd day of December, 2020.

To provide recreational, social and cultural programs and activities. Various park playground equipment has exceeded its life expectancy and are
requiring removal from the playgrounds. Replacement will provide continued recreation opportunities for the children of the community.

Resolution to oppose a Texas Windstorm Insurance Association increase
CAPTION:
Resolution opposing Texas Windstorm Insurance Association rate increase.
SUMMARY:
The Texas Windstorm Insurance Association (TWIA) held a meeting on December 8, 2020 and
voted to implement a 5% rate increase on April 1, 2021. This resolution continues the
opposition the City of Corpus to unnecessary rate increases by TWIA and asks the Governor
and the Texas Legislature to prevent this rate increase from taking effect.
BACKGROUND AND FINDINGS:
The 86th Texas Legislature passed HB 1900 which created a Legislative Funding Oversight
Committee to study TWIA's rate adequacy. It is premature for TWIA to be proposing rate
increases for residential and commercial policies before Texas Department of Insurance
implements these important statutory changes. The committee was appointed but unable to
meet and conduct oversite due to COVID -19 restrictions and legislative rules limitation on
virtual meetings.
TWIA continues to not follow the process set in law for setting windstorm insurance rates.
By law, TWIA is required to consider new rates at the August board meeting. For the second
year in a row, TWIA has been unable to finalize rates at that Board meeting. As TWIA began
to set rates for 2021, they convened the actuarial committee to review the rate adequacy
study before the study was complete. At the August board meeting, TWIA voted not to raise
rates until the full rate adequacy study could be completed with a direction to revisit rates at
that time. Rate uncertainty is unsettling at best for TWIA policy holders during this
unprecedented COVID-19 pandemic.
At the most recent meeting of the actuarial committee, public comment was due on Sunday,
November 29" and the updated rate adequacy study was not released by TWIA until the
afternoon of November 30t" which prevented the public from filing substantive comment on
the report before the committee for consideration. The actuarial committee requested Willis
Towers Watson to gather additional information to before the board meeting on December 8th.
The written public comment period again closed before the updated information that
presented to the board was released to the public for review. In addition, the published
agenda for the December 8th board meeting contained no action item to be considered on
rates. This complete lack of transparency by a public agency is unacceptable.
ALTERNATIVES:
The Council can pass the resolution, or the Council can choose to take no action at this time.
FINANCIAL IMPACT:
There is no financial impact to the City.
RECOMMENDATION:
Staff recommends adoption of this resolution which will send an official message from the City
of Corpus Christi asking the Governor and the Legislature to stop the TWIA rate increase from
taking effect.

Resolution Opposing Texas Windstorm Insurance Association Rate Increase
WHEREAS, the City of Corpus Christi strives to encourage economic development and improve
the quality of life for residents and businesses in the City;
WHEREAS, Hurricane Harvey made landfall as a Category 4 hurricane on the Texas coast on
Friday, August 25, 2017, and battered and drenched Texas for days before finally moving out of
the state. Hurricane Harvey was the first major hurricane to make landfall along the Middle Texas
Coast since Hurricane Celia in 1970;
WHEREAS, Governor Greg Abbott first issued a disaster declaration on Aug. 23, 2017, for
Aransas, Austin, Bee, Brazoria, Calhoun, Chambers, Colorado, DeWitt, Fayette, Fort Bend,
Galveston, Goliad, Gonzales, Harris, Jackson, Jefferson, Jim Wells, Karnes, Kleberg, Lavaca,
Liberty, Live Oak, Matagorda, Nueces, Refugio, San Patricio, Victoria, Waller, Wharton, and
Wilson counties;
WHEREAS, more than three years after the storm, many of the Hurricane Harvey disaster
declared communities are struggling to rebuild;
WHEREAS, Hurricane Hanna made landfall on the south Texas Coast on Saturday July 25,
2020;
WHEREAS, the City of Corpus Christi faces an economic crisis driven by the COVID-19
pandemic along with the downturn of the oil and gas industry. Our small businesses have been
greatly impacted by the recession and we have seen a loss of jobs in our communities;
WHEREAS, the 86th Texas Legislature did act by passing HB1900, which creates a Legislative

WHEREAS, the TWIA Board of Directors voted for no rate increase at its August 2020 meeting;

WHEREAS, TWIA continues to operate in a non -transparent manor and does not comply
with open meetings rules. At the most recent meeting of the actuarial committee, public
comment was due on Sunday, November 29th and the updated rate adequacy study was not
released by TWIA until the afternoon of November 30th which prevented the public from filing
substantive comment on the report before the committee for consideration. The actuarial
committee then requested Willis Towers Watson to gather additional information before the
board meeting on December 8th. The written public comment period for the Board meeting
closed before the updated information presented to the board was released to the public for
review;
WHEREAS, the published agenda for the December 8, 2020 Board meeting included no
action item on a rate increase;
WHEREAS, there are sufficient premiums, assessments, and reinsurance to cover potential
TWIA liabilities for 2021;
NOW THEREFORE BE IT RESOLVED, THAT THE CITY OF CORPUS CHRISTI continues its
opposition to unnecessary increases in windstorm insurance rates and encourages the Governor
of Texas and the 87th Session of the Texas Legislature to take action to stop the Texas Windstorm
Insurance Association from implementing the 5% rate increase that was voted on with no public
notice and comment process from the public. A TWIA rate increase on top of the economic
recession caused by the COVID-19 pandemic would be devastating to our regional economy and
the entire Texas Coast.
