HomeMy WebLinkAbout032311 ORD - 12/22/2020One -reading ordinance awarding a construction contract to JM Davidson Ltd. for Cole Park Pier Improvements, located in Council District 2, in an amount not to exceed $7,542,527.00; appropriating $4,415,430.00 from the Type B Sales Tax Fund, $1,250,000.00 from the Community Enrichment Fund, and $1,877,097.00 from the General Fund unreserved fund balance (to be reimbursed to the General Fund after a deductive change order is executed) and amending the operating and capital budgets. WHEREAS, on November 8, 2016, residents of the City of Corpus Christi (the "City") passed Proposition 1, Adopt Type B Sales Tax to Replace Expiring Portion of Type A Sales Tax, which authorized the adoption of a sales and use tax to be administered by a Type B Corporation at the rate of one-eighth of one percent to be imposed for 20 years with use of the proceeds for (1) 50% to the promotion and development of new and expanded enterprises to the full extent allowed by Texas law, (2) $500,000 annually for affordable housing, and (3) the balance of the proceeds for the construction, maintenance and repair of arterial and collector streets and roads; WHEREAS, the 1/8th cent sales tax authorized by passage of Proposition 1 was subsequently enacted by the City Council and filed with the State Comptroller of Texas, effective April 1, 2018, to be administered by the Corpus Christi B Corporation Board; WHEREAS, the Board has determined that it is in the best interest of the citizens of the City that Type B sales tax funds be used to pay for a certain public improvement, namely the Cole Park Pier; WHEREAS, the Project is consistent with the purposes for which the Type B sales tax was created and approved by the voters of the City; WHEREAS, Cole Park is a premiere park in the City, which enhances the City's ability to attract tourism and business development; WHEREAS, the pier in its current state of disrepair has become a blight on Cole Park and a detriment to the economic development and tourist value of Cole Park, necessitating demolition of the structure; and WHERAS, demolition of the existing pier and construction of a new pier will serve to beautify Cole Park, increase safety, and attract visitors, thereby enhancing the value of Cole Park as a facility that promotes new or expanded business development; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Council specifically finds that the foregoing statements included in the preamble of this ordinance are true and correct and adopts such findings for all intents and purposes related to the authorization of this project. 032311 SCANNED SECTION 2. That funds in the amount of $4,415,430.00 are appropriated from the Type B Sales Tax Fund No. 1146 for the construction of a new Cole Park Pier (the "Project"). SECTION 3. That funds in the amount of $1,250,000.00 are appropriated from the Community Enrichment Fund No. 4720 for the Project. SECTION 4. That funds in the amount of $1,877,097.00 are appropriated from the unreserved fund balance of the General Fund No. 1020 for the Project. SECTION 5. That the FY2020-21 Operating Budget and Capital Budget adopted by Ordinance No. 032203 are amended to increase expenditures by $7,542,527.00. SECTION 6. That the City Manager or designee is authorized to execute a construction contract for Cole Park Pier Improvements in the amount not to exceed $7,542,527.00 with JM Davidson Ltd. SECTION 7. Upon written request of the Mayor or five City Council members, copy attached, the City Council: (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure on this 22nd day of December, 2020.
