The road parallels the Flour Bluff shore with the Laguna Madre, hence its name: Laguna Shores Road. As part of the Bond 2018 program, voters approved a full depth street reconstruction of Laguna Shores Road that included widening and elevating the street to protect against inundation and wave action. Water and wastewater utilities improvements were also included in the scope. The street reconstruction project started in October 2020. The record-breaking low temperatures experienced in Corpus from February 14-20, 2021 resulted in large number of main breaks and unprecedented demands on the water distribution system. One such rupture affected the 24" primary feed to the Island and resulted in significant challenges maintaining the water supply to the Island. These circumstances have led to a re- evaluation of the water utilities included in the Laguna Shores construction project. Originally, water and wastewater lines were designed to be mounted above-ground on bridge structures at three channel crossings under Laguna Shores Rd: O'Neill Channel, Beasley Channel, and Van Galen Channel. Utilities now feels that the aboveground crossings would be too vulnerable and should be converted to underground directionally drilled construction to protect the water and wastewater lines from extreme weather and salt spray. Additionally, the water lines included in the design need to be upsized to better support the supply of water to the Island. The proposed changes include extending a new 18" water line south from an existing 18" water line at SPID to just south of Knickerbocker Street. The new transmission main would allow a future extension to the south that will enhance the ability to reliably serve the Island. It will also provide a more robust distribution network that would better support new development in Flour Bluff. Including these water and wastewater system upgrades in the ongoing Laguna Shores Road project will ultimately improve utility system reliability and increase water flow to the Island. In addition, executing these needed water system improvements now rather than several years in the future will reduce the costs of construction and allow us to avoid the traffic disruption of a future construction project within the same footprint. The new work is estimated to cost $1.4M. Engineering Services feels this represents fair and reasonable compensation for the new work. Since the construction project is already underway,these changes must be implemented via change order. Texas Local Government Code 252.048 limits construction change orders to 25%.An emergency declaration allows the City to waive the requirement to bid that work out. There would be no way to bid that work and execute it separately without significant cost and schedule impacts to the current construction project. Exhibits illustrating the proposed plan and a cost proposal are attached to this memo. ACTIONS TAKEN: 1. City Staff engaged LJA Engineering (Design Engineer) to develop plans for installing lines underground and adding the 18"water line. 2. LJA Engineering and Mako Contracting (Construction Contractor)prepared a preliminary cost proposal that is being negotiated by City staff. FUTURE ACTIONS: 1. Authorize staff to execute a change order with Mako Contracting to incorporate utility system improvements into the Laguna Shores Rd construction project. CONTRACT AUTHORITY: The City Manager is authorized to approve contracts in excess of$50,000 by Charter Art. X, Sec. 2(a) in case of an emergency, but such action must be reported to the Councl. Additionally, The Local Government Code 252.022(a) exempts this contract or procurement from State's competitive bidding requirements because it is necessary: 1. to preserve the property of the municipality; and 2. to preserve or protect the public health or safety of the municipality's residents. FUNDING: The estimated construction cost is $1,400,000.00. Funding sources: 1. Water 2020 Capital Fund 4099 - 500030 $1,000,000 2. Wastewater Capital Reserve Fund 4510 - 500030 $ 400,000 RECOMMENDATION: It is recommended that: 1. staff be authorized to administratively secure the contractors for this repair effort and adjust the budget as needed to ensure completion of the required repairs; and 2. an emergency be declared and the City's Charter Art. X, Sec. 2(a) be invoked to protect the public health or safety of the municipality's residents, preserve the property of the municipality and to avoid undue additional cost to the City.
