City Secretary Huerta announced that citizens would be able to make public comment in-person beginning June 8. Written comments and phone-in comments would still be accepted. G. CITY MANAGER'S COMMENTS/ UPDATE ON CITY OPERATIONS: Mayor Guajardo referred to City Manager's Comments. Due to expected heavy rains, Animal Care Services Program Manager Joel Skidmore, gave an update that Vector Control spraying will begin tonight and provided the spraying schedule for the rest of the week. If it rains, spraying cannot be performed and the schedule is adjusted by one day. Council Members and Mr. Skidmore discussed the following topics: the Texas Department of State Health Services (DSHS) guidelines regulate mosquito spraying due to weather and wind; the Vector Control map is available on the City's website to see when areas will be sprayed; and traps are placed in the river area since these are heavy breeding grounds. a. Police Memorial Week City Manager Zanoni reported National Police Memorial Week is May 9th to May 15th, and recognized the passing of Officer Alan D. McCollum and Senior Officer Charlie Williams. b. Open Air Arts Evening -Arts and Cultural Commission Event at Heritage Park City Manager Zanoni reported the Open Air Arts Event will take place on Friday, May 14th from 6 p.m. to 9 p.m. at Heritage Park. c. Second Quarter FY 2021 Budget Report City Manager Zanoni reported on the Second Quarter FY 2021 Budget Report as follows: presentation overview; general fund revenues; general fund expenses; general fund initiatives; water fund revenues; wastewater fund revenues; HOT tax revenue; City of Corpus Christi Page 2 Printed on 5/13/2021 City Council Meeting Minutes May 11,2021 Development Services revenue; Capital Improvement Program; summary; and next steps. Animal Care Advisory Committee City Manager Zanoni said that staff requested that appointments be postponed and brought back at a later date. Coastal Bend Council of Governments Council Member Smith made a motion to reappoint Council Members Molina and Hunter, seconded by Council Member Pusley. Council Member Smith nominated Council Members Roland Barrera and Gil Hernandez. Council Member Molina made a motion to appoint Council Members Barrera and Hernandez, seconded by Council Member Pusley and passed unanimously. Corpus Christi Convention &Visitors Bureau Mayor Guajardo nominated Ramon Pineda (At-Large). Council Member Molina made a motion to appoint Ramon Pineda (At-Large), seconded by Council Member Pusley and passed unanimously. Sister City Committee Council Member Molina nominated Michael Crowley (District 4). Council Member Barrera nominated Terri Cissi Whipple (District 3). Council Member Hernandez nominated Scott A. Lawson (District 5). Due to a tie, Council Member Hernandez made a motion to table this Board appointment to the next meeting, seconded by Council Member Lerma and passed unanimously. The Minutes were approved on the consent agenda. 3. 21-0559 One-Reading Ordinance authorizing City Manager or designee to execute the Contract with Texas Department of State Health Services which provides $18,073,609 for COVID-19 Vaccination services provided December 1 2020 through June 30, 2024 to be used to increase, train, and monitor vaccine sites and providers; appropriating the funds in the No. 1066 Grant Fund; authorizing the Corpus Christi-Nueces County Public Health District Director to contract with third parties for the provision of services under the Contract; and authorizing use of Contract funds to pay pre-award costs which total approximately $20,000. Enactment No:032430 Consent-Contracts and Procurement 10. 21-0484 Motion authorizing a three-year service agreement with Great South Texas Corp dba Computer Solutions of San Antonio, Texas, in an amount of$126,866.69 for the Oso Wastewater Treatment Plant Network Upgrade, effective upon issuance of a notice to proceed, with FY 2021 funding available in the Wastewater Capital Fund. Chief Information Officer of Information Technology Peter Collins presented information on the following topics: audio/visual upgrade; equipment; and Council Chambers upgrade. City Manager Peter Zanoni stated that Council meetings will be held in the 6th floor conference room during the Council Chambers upgrade. Enactment No: M2021-097 14. 21-0477 Motion authorizing a three-year supply agreement with Ferguson Enterprises, LLC, of Corpus Christi, Texas, in an amount not to exceed $77,217.05, to purchase manhole covers for the City Warehouse as a central distribution point for the Utilities Department, with funding in FY 2021 in an amount of$8,579.67 available through the Stores Fund. Enactment No: M2021-098 15. 21-0371 Resolution authorizing a three-year service agreement with two one-year extension options with Concentra Health Services, Inc., to provide employee health care management and operation for the City's employer-sponsored Wellness Clinic in an amount not to exceed $2,623,835.00 for a three-year period, or$4,598,999 if both one-year extension options are exercised, with funding budgeted in the Fire, Police and Citicare Health Benefits funds. Enactment No: 032431 Consent-Capital Projects 16. 21-0486 Motion authorizing the approval of Amendment No. 1 to a professional services contract with Govind Development, LLC, Corpus Christi, Texas for design bid, and construction phase services for the reconstruction of Calallen Drive from Red Bird Lane to Burning Tree Lane, located in Council District 1, in an amount of$205,102.85 for a total contract value not to exceed $254,602.85, with FY 2021 funding available from the Bond 2018 Proposition A, Storm Water, Wastewater, Water, and Gas Capital Funds. This Motion was passed on the consent agenda. Enactment No M2021-100 18. 21-0262 Motion awarding a professional services contract to HDR Engineering, Inc., Corpus Christi, Texas, for design, bid, and construction phase services for the reconstruction of Wooldridge Road from Everhart Road to Cascade Drive, located in Council District 5, in an amount of$357,767.95, with FY 2021 funding available from the Bond 2018 Proposition A, Storm Water, Wastewater, Water, and Gas Capital Funds. Enactment No. M2021-101 19. 21-0157 Resolution awarding a construction contract to EMR Elevator, Inc., Corpus Christi, Texas, to upgrade the freight elevator for the La Retama Library, located in Council District 1, in an amount of$226,420.00 with FY 2021 funding available from the Bond 2018, Proposition D Fund, and updating the scope of work in the FY 2020-2021 Capital Improvement Program. Enactment No: 032432 General Consent Items 20. 21-0483 Motion authorizing an agreement with the United Corpus Christi Chamber of Commerce Foundation (UCCCF) for the acceptance of a commissioned mural to be placed at the Cole Park Amphitheater as the final project of Leadership Corpus Christi, Class 49, a program of UCCCF. Mayor Guajardo referred to Item 20. Interim Director of Parks Recreation Sarah Munoz presented information on the following topics: Leadership Corpus Christi; mural donation; mural design; design recommendation; and staff recommends approval. PUBLIC HEARINGS: (ITEM 21j 21. 21-0433 Ordinance authorizing a Wastewater Lift Station, Gravity and Force Main Line Construction and Reimbursement Agreement for up to $2,041,201.17 with Mostaghasi Investment Trust to construct a new Wastewater Lift Station, Gravity and Force Main for a proposed residential and commercial development located west of the U.S. Highway 77 (1-69) and County Road 52 Intersection with a completion date of within 24 months; transferring $372,704.89 from the Water Arterial Transmission and Grid Main Trust Fund, $83,339.25 from the Water Distribution Main Trust Fund, and $101,793.65 from the Wastewater Collection Line Trust Fund to the Wastewater Trunk System Trust Fund; appropriating $1,772,500.78 from the Wastewater Trunk System Trust Fund; transferring of future revenue of$268,700.39 collectively from Water and Wastewater lot and acreage fees and pro rate fees to the Wastewater Trunk System Trust Fund; authorizing appropriation of$268,700.39 from the Wastewater Trunk System Trust Fund to reimburse the Developer per the agreement. (District 1) Mayor Guajardo referred to Item 21. Director of Development Services Al Raymond stated that the purpose of this item is to authorize a wastewater lift station construction and reimbursement agreement with Mostaghasi Investment Trust for up to $2,041,201.17 to construct a new Wastewater Lift Station. Director Raymond presented information on the following topics: River Ridge Unit 4; project map; waste water master plan; trust fund balance; and staff recommends approval. Council Members, Director Raymond, City Manager Peter Zanoni and City Attorney Miles Risley discussed the following topics: the trust fund will be depleted if this item is approved; one of the most significant policy issues that Council recently approved was the impact fee study as an alternative way to fund infrastructure; the trust fund has generated $34 million over the last 40 years, less than $1 million a year for new infrastructure; the City of Corpus Christi is the only city with this type of trust fund system; City of Corpus Christi Page 9 Printed on 5/13/2021 City Council Meeting Minutes May 11,2021 a Council Member's concern that the trust fund is depleted; trust fund money is going out based on which projects are encumbered first; a Council Member's request that staff prioritize "shovel-ready" projects for trust fund reimbursements; the City Council has authority to effectuate a policy regarding project prioritization at the time the extension comes before City Council; and Council Members' concern that County Road 52 is not designed to handle heavy traffic. Mayor Guajardo opened the public hearing. No public comments were submitted. Mayor Guajardo closed the public hearing. Council Member Pusley made a motion to approve the ordinance, seconded by Council Member Lerma. LEGISLATIVE UPDATE: Mayor Guajardo referred to the Legislative Update. Director of Intergovernmental Relations Tammy Embrey gave a brief update on actions that have taken place at the State Capitol. All Bills for House consideration have to be heard by Friday. A Council Member and Director Embrey discussed the following topics: a Council Member received a call from a concerned citizen regarding House Bill 4146 (water supplies); in response to a Council Member's concern of HB1698 and HB781, which would raise the license fees in Nueces County, Ms. Embrey said the Bills never received a hearing in the House or the Senate, so they remain dead in the process. N. INDIVIDUAL CONSIDERATION ITEMS: (ITEM 22 - 23) 22. 21-0525 Resolution authorizing a two-year service agreement with HUB Parking Technology USA, Inc. of Houston, Texas, in an amount of$170,517.93 for installation and upgrade of the Parking Operations DataPark equipment at the Corpus Christi International Airport, effective upon issuance of a notice to proceed, with FY 2021 funding available in the Airport Fund. Mayor Guajardo referred to Item 22. Council Members, Director Smith, City Manager Peter Zanoni and Deputy Director of Aviation Tyler Miller discussed the following topics: American Airline passengers won't be required to carry their luggage to the TSA screening, but the United Airlines passengers will; the City is working on removing the police department and animal care services from managing the parking meters; and a Council Member's request to keep the Capital Improvement Program (CIP) up to date. Council Member Hernandez made a motion to approve Items 22 and 23, seconded by Council Member Smith. This Resolution was passed and approved with the following vote: Aye: 9- Mayor Guajardo, Council Member Barrera, Council Member Hernandez, Council Member Hunter, Council Member Lerma, Council Member Martinez, Council Member Molina, Council Member Pusley and Council Member Smith Abstained: 0 Enactment No 032433 23. 21-0214 Ordinance awarding a construction contract to Teal Construction, Inc., Corpus Christi, Texas, for the Corpus Christi International Airport Transportation Security Administration (TSA) Security Equipment Consolidation Project to relocate the existing TSA baggage screening equipment, in an amount of$564,202.00 and appropriating funds from the Federal Aviation Administration (FAA) Coronavirus Aid, Relief, and Economic Security (CARES) Act and amending the FY 2020-2021 budget by increasing revenues and expenditures. See Item 22 for vote. O. FIRST READING ORDINANCES: (ITEM 24) 24. 21-0518 Ordinance annexing London Pirate Road (formerly County Road 33), from FM 43 (Weber Road) to the North approximately 1.027 miles, being approximately 3.733 acres of land, into the territorial limits of the City of Corpus Christi increasing the area to 489 sq. miles; and approving a service plan. Mayor Guajardo referred to Item 24. Director of Planning & Environmental Services Daniel McGinn presented information on the following topics: background; aerial overview of annexation tract; annexation tract; and annexation schedule. Council Members, Director McGinn and Director of Public Works and Streets Richard Martinez discussed the following topics: the official requestor for the annexation is the county; the county and the city split the cost of$200,000 to improve County Road 33; this City of Corpus Christi Page 11 Printed on 5/13/2021 City Council Meeting Minutes May 11,2021 road will require additional construction work in the future; the subdivision to the right of the road was annexed into the city, so it's all city property; and other sections of the road have not been improved currently, but is a work in progress. Director of Finance Heather Hurlbert presented information on the following topics: overview; highlights of the American Rescue Plan; state and local fiscal recovery funds; broad definition of allowable uses; summary of COVID related funding received; nature of funding and methodology; replace revenue lost due to COVID; potential infrastructure projects; and next steps. Council Members, Director Hurlbert and City Manager Peter Zanoni discussed the following topics: in response to a Council Member's interest in providing funding to non-profit organizations, City Manager Zanoni stated that during the early stages of the pandemic non-profit organizations did receive funding, but the financial help they'll need will be recurring, so the City believes it would be a better business decision to use this one-time funding on the projects mentioned; the $10 million in grant monitoring would be for tenants, landlords, etc.; a Council Member's recommendation that a good portion of the funding should go to utilities in order to prevent rates from increasing; and a Council Member's request to give a small allocation of funds to specific non-profit organizations. We have personally been dealing with this issue in my neighborhood for nearly 2 years now.The other neighbors even longer. I've contacted all branches of the city: code enforcement, Police, Game Wardens, Urban biologists, Animal Control, and the Health Department. I have received some help and some have spoken to this neighbor. While this neighbor continues to deny that she is feeding the seagulls, all of the neighbors around them have seen it. Currently, feeding seagulls and animals is not illegal, and to be honest, it will probably be hard to enforce. Our main issue is the excessive bird droppings and noise. Reading the municipal code, "Noise nuisance means any loud, irritating, vexing or disturbing sound originating from a nearby property under separate ownership which causes injury, discomfort, or distress of a person of reasonable nervous sensibilities, or any sound that exceeds the maximum permitted sound levels specified in section 31-3." The noise is very discomforting. The birds are not there all day, but we do see them every evening. When around, they squawk, in hopes the neighbors come out to feed. I think our biggest help was from the Urban Biologist assigned by the Director of Texas parks and wildlife. He talked to this neighbor and it appears that she has reduced or stopped feeding the seagulls, but as a result of feeding, they still linger around on the house and nearby. We want to remain somewhat anonymous, so we don't draw unwanted attention to our neighborhood. Please relay this message to the Mayor and Council and confirm reciept. Thank you. It seemed to have stopped for a bit but then it seems like either she has them trained to keep coming back or she is feeding them again. She likes to stand on her back porch with an ice scooper and scoop food out of a big bag and feed them. Other than that we have looked into putting up the bird spikes on top of our covered parking to see if that would stop them but haven't yet. We did order some bird repellant that we have put up for the pigeons that like to nest in the covered area and it seems to work for them so we were going to put some on that on top to see if it would work for the seagulls also before trying the spikes.
