KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES
THAT THE CITY OF CORPUS CHRISTI ("CITY"), a Texas home -rule municipal
corporation of 1201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, does
hereby give notice that the City has and holds a Public Utility Easement across Lot 23,
Block 223, Padre Island -Corpus Christi Section 4, City of Corpus Christi, Nueces
County, Texas, According to Plat therefore recorded in Volume 33, Pages(s) 44-47,
Map Records of Nueces County as follows:
A map showing the location of the Public Utility Easement is
attached and incorporated as Exhibit A.
City hereby objects to the Encroachment as fully described in Exhibit B. By objecting,
the City is not consenting to the Encroachment. The City is not abandoning the Public
Utility Easement, said permanent easement is in full force in perpetuity.
The Public Utility Easement contains a 30" diameter reinforced concrete stormwater
pipe. The City will demolish the house identified in Exhibit B in the event such house
interferes replacement, service, repair, use. maintenance, inspection, reconstruction,
modification, or removal of the 30" diameter reinforced concrete stormwater pipe.
City hereby reserves the rights to free ingress, egress and regress to and for the City
and its franchisees all for the purpose of erecting, constructing, installing, laying,
replacing, servicing, repairing, using, maintaining. inspecting, reconstructing, modifying,
removing, operating and keeping utility lines in. on, over, under, and along the Public
Utility Easement, including but not limited to water, wastewater, storm water, storm
water detention, filtration, drainage, and gas. and together with all lines. pipes, conduits,
and other equipment, improvements, and appurtenances used in the supply and
provision of public utilities.
City herby reserves the right to eliminate any encroachments in the Public Utility
Easement that interfere in any material way or are inconsistent with the rights granted to
the City for the Public Utility Easement as determined by the City in its reasonable
discretion, including the right to clear the public utility easement of all obstructions
located on, over or within said easement through any means deemed reasonable and
appropriate by the City.
City hereby reserves any and all rights and appurtenances pertaining to use of the
Public Utility Easement.
