Nueces County Public Health District effective 90 days after notice;
authorizing agreements with Health Service Providers for the provision of
health services; and authorizing the creation of the City of Corpus Christi
Health Department
WHEREAS, the Corpus Christi-Nueces County Public Health District (District)
has not operated as a true district;
WHEREAS, District revenues are independently managed by the City of Corpus
Christi (City) and Nueces County (County);
WHEREAS, the workforce for the District consists of City employees and County
employees;
WHEREAS, the differences in City and County philosophies, performance
measures, and employee benefits cause morale and operational problems;
WHEREAS, the City and County have duplicative internal and external District
services including Human Resources, Legal, and Animal Control;
WHEREAS, the duplicative internal and external services are not efficient;
WHEREAS, District management of City and County employees creates a
liability that neither the City nor County can directly manage;
WHEREAS, the Reformation of the Cooperative Agreement to operate a Public
Health District (Agreement) does not provide for sufficient financial or performance
accountability;
WHEREAS, Chapter 121 Health Districts are better suited for smaller, rural
communities that need to pool and centralize resources;
WHEREAS, the District has not added any new members since its inception;
WHEREAS, the City has sufficient resources to provide the health services for
Corpus Christi residents;
WHEREAS, the District has failed to effectively collaborate with other health care
providers and academia to form a coordinated effort on public health initiatives;
WHEREAS, the Nueces County Hospital District provides health care to indigent
and low-income residents;
WHEREAS, the Affordable Care Act and other changes in the law have made
health care services more available to indigent and low-income residents;
WHEREAS, the City's withdrawal from District will enable the City to manage
liability better;

WHEREAS, the City's withdraw from the District will enable the City to provide
better financial and performance accountability;
WHEREAS, the City's withdrawal from District will enable the City to pursue the
provision of health services to Corpus Christi residents more efficiently and effectively;
WHEREAS, the City's withdrawal from the District will enable the City to more
effectively collaborate with other health care providers and academia to form a
coordinated effort on public health initiatives;
WHEREAS, the Reformation of the Cooperative Agreement to operate a Public
Health District, ARTICLE V. Section 2 provides "Members may withdraw from the
Health District upon not less than 90 days written notice to all other members, with the
understanding that all services provided to the withdrawing member as the result of
membership in the Health District shall cease to that member.";
WHEREAS, all City employee Public Health District positions will be eliminated,
and new positions will be created within the new City Health Department effective 90
days after written notice of withdrawal is provided to Nueces County;
WHEREAS, creation of the City Health Department enables the City to create a
high performing, results -oriented organization that will be universally respected by
citizens, professional partners, and peer agencies; and
WHEREAS, future City Council action may be brought to address budgetary
issues, appropriations, personnel, services provided, and other measures related to the
City's provision of health services.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, THAT:
SECTION 1. The City of Corpus Christi (City) withdraws from the Corpus Christi-
Nueces County Public Health District (District) effective 90 days after written notice is
provided to Nueces County pursuant to the Reformation of the Cooperative Agreement
to operate a Public Health District as amended and Texas Health and Safety Code,
Chapter 121.
SECTION 2. The City Manager is authorized to give written notice to Nueces County of
the City's withdrawal from the District.
SECTION 3. The City Manager or designee is authorized to negotiate and execute
agreements with the District, Nueces County, Nueces County Hospital District, and any
other Health Care Provider to provide health services to the extent funding is
unnecessary or available from a third party or does not otherwise require an
appropriation of City funds, including agreements related to the Health Authority, use of
City facilities, and the provision of health services. The City Manager or designee is

further authorized to assign any grants, payments, contracts, or other legal instruments
to the extent not prohibited by said instrument.
SECTION 4. The City Manager or designee is authorized to create the City of Corpus
Christi Health Department.
