additional one-year options, with M & S Tree Service, LLC, of Taft,
Texas, for palm tree trimming services in an amount not to exceed
$267,592.00 and a potential amount not to exceed $668,980.00 if the
options are exercised, with FY 2022 funding of $133,796.00 from the
General Fund.
WHEREAS, State law provides that, if a competitive sealed bidding requirement
applies to a contract for goods or services, the contract must be awarded to the lowest
responsive, responsible bidder or to the bidder who provides the best value, pursuant to
Texas Local Government Code §252.043(a);
WHEREAS, the City notified all bidders for Palm Tree Trimming Services Bid No.
3891 that a contract would be awarded to the lowest responsive, responsible bidder;
WHEREAS, the City Council finds that the lowest responsive, responsible bidder
is M & S Tree Service, LLC, of Taft, Texas; and
WHEREAS, in the event the lowest responsive, responsible bidder fails to execute
the awarded contract or fails to perform under the contract as to any services, the City
Manager, or his designee, is authorized to execute a service agreement for the remaining
contract term with the next lowest bidder in Bid No. 3891, in succession, to secure
necessary replacement palm tree trimming services, as a matter of public safety, to keep
City roadways and sidewalks clear at all times; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. The City Council finds that the foregoing preamble language stated in this
resolution is true and correct and adopts such findings for all intents and purposes
expressed in this resolution.
SECTION 2. The City Manager or his designee ("City Manager") is authorized to execute
a two-year service agreement with M & S Tree Service, LLC ("Contractor"), in an amount
not to exceed $267,592.00, with such agreement having up to three additional one-year
options to renew at the amount stated in Bid No. 3891. Furthermore, in the event the
Contractor fails to execute the service agreement or fails to perform under the executed
agreement, the City Manager is authorized to execute a replacement service agreement
for the remainder of the contract term in accordance with the language stated in the
preamble of this resolution.

I, the Director of Financial Services of the City of Corpus Christi, Texas (or his/her duly
authorized representative), hereby certify to the City Council and other appropriate officers that
the money required for the current fiscal year's portion of the contract, agreement, obligation
or expenditure described below is in the Treasury to the credit of the Fund specified below, from
which it is to be drawn, and has not been appropriated for any other purpose. Future payments
are subject to annual appropriation by the City Council.
