City -Operated Corpus Christi-Nueces County Public Health District and
authorizing extension of the City's withdrawal date to March 1, 2022 to allow for
execution of said amended agreement
WHEREAS, the City and Nueces County entered into an agreement effective April 21, 2009
("Reformation Agreement"), to cooperatively operate the City of Corpus Christi-Nueces County
Texas Public Health District ("Health District"); and
WHEREAS, the original cooperative Reformation Agreement has been amended by the First
Amendment to the Reformed Cooperative Agreement to Operate a Public Health effective September
1, 2013, the Second Amendment to the Reformed Cooperative Agreement to Operate a Public Health
District, effective October 1, 2017;
WHEREAS, on or about October 19, 2021, the City of Corpus Christi approved a resolution
invoking Article V, Section 2 to withdraw from the Health District which states, "Members may
withdraw from the Health District upon not less than 90 days written notice to all other Members, with
the understanding that all services provided to the withdrawing member as the result of membership
in the Health District shall cease to that member";
WHEREAS, the parties executed the Third Amendment to the Reformed Cooperative
Agreement to Operate a Public Health District, effective on January 14, 2022; and
WHEREAS, the City and County are in general agreement on a proposal to amend the
Cooperative Agreement to provide for the City's exclusive management of the Health District.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT:
SECTION 1. The City Manager is authorized to execute the attached Amended Cooperative
Agreement for City -Operated Corpus Christi-Nueces County Public Health District with an
effective date of March 1, 2022.
SECTION 2. The City Manager is authorized to fill in the blanks and otherwise make changes to the
attached Amended Cooperative Agreement for City -Operated Corpus Christi-Nueces County
Public Health District that are necessary to conclude negotiations with Nueces County, to the extent
such changes do not materially increase the City's expenses and/or liability.
SECTION 3. The City Manager is authorized to execute an agreement with Nueces County to provide
for extension of the withdrawal date to March 1, 2022 to allow for execution of an Amended
Cooperative Agreement for City -Operated Corpus Christi-Nueces County Public Health
District. Full execution and effectuation by both parties of said Cooperative Agreement will rescind
the aforementioned withdrawal.
