Distribution, LLC, of Houston in an amount not to exceed $79,276.05
for the purchase and installation of actuators at the Mary Rhodes
Pipeline pump stations for the Utilities Department, with FY 2022
funding available from the Water Fund.
WHEREAS, Scruggs Distribution, LLC, will provide, on behalf of the Utilities
Department, the necessary actuators and installation of the same at the Mary Rhodes
Pipeline pump stations, such actuators being critical in sustaining the department's
operational reliability for service;
WHEREAS, State law provides that such procurements, as outlined above, are
subject to statutory procurement requirements, including competitive bids, unless an
exception applies;
WHEREAS, there is a statutory exception for this procurement in Local
Government Code, Section 252.022(a)(2), as this purchase is necessary to preserve or
protect the public health and safety of the City's residents; and
WHEREAS, there is also a statutory exception for this procurement in Local
Government Code, Section 252.022(a)(7)(A), as this purchase is available from only one
source due to secret processes or patents.
Be it resolved by the City Council of the City of Corpus Christi, Texas:
Section 1. The City Council specifically finds that the foregoing statements included in
the preamble of this resolution are true and correct and adopts such findings for all intents
and purposes related to the authorization of this procurement.
Section 2. The City Manager, or his designee, is authorized to execute a service
agreement with Scruggs Distribution, LLC, of Houston for an amount not to exceed
$79,276.05, to be provided with FY 2022 available from the Water Fund.

the money required for the current fiscal year's portion of the contract, agreement, obligation
or expenditure described below is in the Treasury to the credit of the Fund specified below, from
which it is to be drawn, and has not been appropriated for any other purpose. Future payments
are subject to annual appropriation by the City Council.
