HomeMy WebLinkAbout032839 RES - 08/30/2022Resolution authorizing a three-year service agreement, with William Charlton, dba Lawn in Order, of Corpus Christi, in an amount not to exceed $91,500.00, for landscaping and grounds maintenance for outlying Police buildings and main Police headquarters, with FY 2022 funding of $7,625.00 from the General Fund. WHEREAS, State law provides that, if a competitive sealed bidding requirement applies to a contract for goods or services, the contract must be awarded to the lowest responsive, responsible bidder or to the bidder who provides the best value, pursuant to Texas Local Government Code §252.043(a); WHEREAS, the City notified all bidders for Bid No. 4174 that a contract would be awarded to the lowest responsive, responsible bidder; WHEREAS, the City finds that the lowest responsive, responsible bidder is William Charlton, dba Lawn in Order, of Corpus Christi; and WHEREAS, in the event the lowest responsive, responsible bidder fails to execute the awarded contract or fails to perform under the contract as to any services, the City Manager, or his designee, is authorized to execute a service agreement for the remaining contract term with the next lowest responsive, responsible bidder in Bid No. 4174, in succession, to secure necessary replacement services at the Police Department headquarters and outlying department locations, as a matter of public health and safety, to keep City property, roadways, and sidewalks clear at all times; now, therefore, Be it resolved by the City Council of the City of Corpus Christi, Texas: Section 1. The City Council specifically finds that the foregoing statements included in the preamble of this resolution are true and correct and adopts such findings for all intents and purposes related to the authorization of this procurement. Section 2. The City Manager, or his designee ("City Manager"), is authorized to execute a three-year service agreement with William Charlton, dba Lawn in Order ("Contractor"), in an amount not to exceed $91,500.00, with FY 2022 funding of $7,625.00 from the General Fund. Furthermore, in the event the Contractor fails to execute the service agreement or fails to perform as required, the City Manager is authorized to execute a replacement service agreement for the remainder of the contract term in accordance with the language stated in the preamble of this resolution.
