the dilapidated/substandard structures at 110 Josephine St. known as 106
Josephine St. and 102 Josephine St., 2212 Ruth St., and 1216 Martin Luther
King Dr., owned by Markman Brothers Investments Corpus Christi LLC.
Whereas, the Building Standards Board (the "Board") held a public hearing on
May 26, 2022, at 1:30pm regarding substandard structures located at 110 Josephine
Street known as 106 Josephine Street and 102 Josephine Street and after making
certain findings ordered the structure or premises be removed or demolished by the
owner, lien holder or mortgagee, within thirty (30) days pursuant to the attached Final
Order of the Building Standards Board Case No. V174378-021522 and V175058-
022422;
Whereas, the Building Standards Board (the "Board") held a public hearing on
June 23, 2022, at 1:30pm regarding substandard structures located at 2212 Ruth St and
en making certain findings ordered the structures or premises be removed or
demolished by the owner, lien holder or mortgagee, within thirty (30) days pursuant to
the attached Final Order of the Building Standards Board Case No. V171798-010422;
Whereas, the Building Standards Board (the "Board") held a public hearing on
July 28, 2022, at 1:30pm regarding substandard structures located at 1216 Martin
Luther King Dr and after making certain findings ordered the structure or premises be
removed or demolished by the owner, lien holder or mortgagee, within thirty (30) days
pursuant to the attached Final Order of the Building Standards Board Case No.
V177320-033022;
Whereas, Markman Brothers Investments Corpus Christi LLC, the owner of the
structures at 110 Josephine Street, (the "Appellant") filed a written notice of appeal of
the Board's order with the City Secretary's Office on June 15, 2022, in accordance with
Section 13-24 (a) City of Corpus Christi Code of Ordinances (the "Code") and Article VI,
Section 2 of the City Charter (the "Charter");
Whereas, Markman Brothers Investments Corpus Christi LLC, the owner of the
structures at 2212 Ruth Street, (the "Appellant") filed a written notice of appeal of the
Board's order with the City Secretary's Office on July 11, 2022, in accordance with
Section 13-24 (a) City of Corpus Christi Code of Ordinances (the "Code") and Article VI,
Section 2 of the City Charter (the "Charter");
Whereas, Markman Brothers Investments Corpus Christi LLC, the owner of the
structures at 1216 Martin Luther King Dr, (the "Appellant") filed a written notice of
appeal of the Board's order with the City Secretary's Office on August 23, 2022, in
accordance with Section 13-24 (a) City of Corpus Christi Code of Ordinances (the
"Code") and Article VI, Section 2 of the City Charter (the "Charter");
Whereas, the filing of the appeals stayed the Board's orders;
Whereas, Section 13-24(a) of the Code and Article VI, Section 2 of the Charter
authorize the City Council to hear Appeals of the Board's decision; therefore, this
Council properly has jurisdiction of these appeals;

Whereas, after hearing the evidence, the City Council makes the following
findings related to the substandard buildings located at 1216 Martin Luther King Dr,
2212 Ruth Steet, and 110 Josephine Street known as 106 Josephine Street and 102
Josephine Street:
(1) the decision of the Board was not erroneous, and
(2) that the decision of the Board would not cause undue hardship.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. The Council finds and declares the recitals in the above paragraphs are
true and correct.
SECTION 2. The Final Order of the Building Standards Board of Appeals, Case No.
V174378-021522, for 110 Josephine Street aka 106 Josephine Street is upheld.
SECTION 3. The Final Order of the Building Standards Board of Appeals, Case No.
V174378-022422, for 110 Josephine Street aka 102 Josephine Street is upheld.
SECTION 4. The Final Order of the Building Standards Board of Appeals, Case No.
V171798-010422, for 2212 Ruth Street is upheld.
SECTION 5. The Final Order of the Building Standards Board of Appeals, Case No.
V177320-033022, for 1216 Martin Luther King Drive is upheld.
SECTION 6. The Appellant's appeals are hereby denied.
SECTION 7. This final decision of the City may be personally delivered to the owner,
mailed to the owner by first class mail with certified return receipt requested, or
delivered to the owner by the United States Postal Service using signature confirmation
service.
SECTION 8. The City may vacate, secure, remove, or demolish the buildings or
relocate the building occupants if the action ordered by the Board is not taken by
October 21, 2022.
