HomeMy WebLinkAboutC2019-709 - 7/23/2019 - Approved SECOND AMENDMENT TO THE HOME SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND ACCESSIBLE HOUSING RESOURCES, INC. This Second Amendment ("Second Amendment") is made by and between the City of Corpus Christi ("City") and Accessible Housing Resources, Inc. ("Subrecipient") WHEREAS, the City and the Subrecipient executed an agreement dated July 23, 2019 which was approved by the City Council for the purpose of utilizing the City's FY2019-20 Home Investment Partnership Program ("HOME") Program funds (the "Agreement"); WHEREAS, the Subrecipient has timely requested an extension of the termination dates in order to complete the project contemplated under the Agreement; and WHEREAS, the parties desire to execute this Second Amendment to express their mutual desire to reaffirm all terms, conditions, and covenants stated in the original Agreement and to extend the construction compliance and termination dates of the Agreement. Section 1. By execution of this instrument, the parties agree to reaffirm and continue in force all terms, conditions, and covenants stated in the original Agreement, as may be amended by the execution of this Second Amendment. Section 2. Article 2, Grant Period, Subsection (a), of the Agreement is amended by deleting the date "September 30, 2022" and inserting the date "September 30, 2023." Section 3. Article 2, Subsection 2.3, of the Agreement is amended by replacing Exhibit "A", with the Updated Project Budget attached hereto and incorporated herein by reference as Exhibit "A". Section 4. Article 2, Subsection 2.4, of the Agreement is amended by replacing Exhibit "B", with the Updated Timeline for Goals and Expenditures attached hereto and incorporated herein as Exhibit "B". Section 5. Article 2, Subsection 2 .5, of the Agreement is amended by deleting the date " September 1, 2021" and inserting the date "September 1, 2023." Section 6. By execution of this Second Amendment, the parties agree to revise and extend the rental assistance, rental deposit and utility deposit assistance program and termination dates stated in the original Agreement. All other terms, conditions, and covenants of the Agreement not changed by this Second Amendment remain the same and in full force and effect.
