HomeMy WebLinkAbout032873 RES - 09/20/2022Resolution authorizing a one-year service agreement, with two one- year options, with Xylem Dewatering Solutions, Inc., of Bridgeport, New Jersey, in the amount of $269,950.00, with a potential amount not to exceed $809,850.00 if options are exercised, for the purchase of Godwin pumps, motors, rentals, and services for Corpus Christi Water, with FY 2022 funding of $45,000.00 from the Water and Wastewater Funds. WHEREAS, Xylem Dewatering Solutions, Inc., provides Godwin brand pumps, motors, rentals, and services for the wastewater lift stations, wastewater treatment plants, and storm water pump stations for Corpus Christi Water, such equipment being critical in sustaining the Wastewater and Storm Water Divisions' operational reliability for service; WHEREAS, State law provides that such procurements, as described above, are subject to statutory procurement requirements, including competitive bids, unless an exemption applies; and WHEREAS, the City Council finds that there are three statutory exemptions for this procurement in Local Government Code, Sections 252.022(a)(2), (a)(7)(A), and (a)(7)(D), as this procurement (i) is necessary to preserve or protect the public health or safety of the municipality's residents, (ii) is available from only one source due to patents, copyrights, secret processes, or natural monopolies, and (iii) consists of captive replacement parts or components for equipment. Be it resolved by the City Council of the City of Corpus Christi, Texas: Section 1. The City Council specifically finds that the foregoing statements included in the preamble of this resolution are true and correct and adopts such findings for all intents and purposes related to the authorization of this procurement. Section 2. The City Manager, or his designee, is authorized to execute a one-year service agreement, with two one-year options, with Xylem Dewatering Solutions, Inc., for an amount of $269,950.00 and a potential amount not to exceed $809,850.00 if options are exercised, with FY 2022 funding of $45,000.00 from the Water and Wastewater Funds.
