Park City Secretary T: -Bay Kring Mayor Pro Tem Jamie L. Barnard called the meeting to order. The Invocation was given by Reverend Bill Warren, of Lexington Baptist City Secretary T. Ray Kring called the roll of those in attendance. Motion by Pat Dunne, seconded by Lozano and passed that the absence of Mayor Ellroy King be excused. Motion by Lozano, seconded by Jos Dunn and passed that the minutes of the regular meeting of February 15, 1961, be approved. ' Mayor Pro Tem Barnard called for the City Manager's Reports. Motion by Jos Duel, seconded my Lozano and passed that the reaommsnda- tions of the City Manager be accepted and approved, as follows: a. That acceptance and final payment of Estimate 913 in the amount of $8,083.22 to Heldsnfsls Brothers for completion of Force Account work in connection with the Grading for South Approach, Unit VI, Tule Lake Lift Bridge project, be approved; b. That acceptance and final payment of Estimate #4 in the amount of 810,661.63 to Price Construction Company for moving and - construction of Buildings and Improvements at the New Joint Railroad Yard, be approved; and c. That the hearing given the abutting property owners on the:Neb Road Street Improvement Assessments be closed, and the assessment roll, as amended in accordance with the Council's decisions to reduce theaaseeaments on'thoss properties sonsd "R-1" which back up to Weber Road to 25% if the property owner wa3.vie th it right to access to Weber Road, and reducing the assessments to 357,,for,thoge pro- perties zoned "R-1" which side on Weber Road, be approved. ORDINANCE NO. 6078 RECEIVING AND ACCEPTING CONSTRUCTION PERFORMED BY HBLDRNPRLS BROTHERS APPLICABLE TO THEIR CONTRACT DATED FEBRUARY 3, 1959, APPROVED BY ORDINANCE NO. 5268, AND EXTENDED ON NOVEMBER 9, 1960, BY ORDINANCE N0. 5964, PROJECT N0. 230-53-5.1, GRADING 1011 SOUTH • Regular Council Meeting February 22, 1961 Page #2 APPROACH, UNIT VI, TULE LAKE BRIDGE; AUTHORIZING THE PAYMENT OF FINAL ESTIMATE NO. 13 DATED FEBRUARY 17, 1961, IN THE AMOUNT OF $8,083.22 FROM NO, 230 BRIDGE FUNDS PREVIOUSLY APPROPRIATED; AND DECLARING AN EMERGENCY. The Charter rule was suspended by the following vote; All Council members voting "Aye" with the exception of Mayor King, Absent. The foregoing ordinance was passed by the following vote: A11 Council members voting "Aye" with the exception of Mayor King, Absent. ORDINANCE NO. 6079 RECEIVING AND ACCEPTING THE CONSTRUCTION OF BUILDINGS AND IMPROVEMENTS AT THE NEW JOINT RAILROAD YARD, PROJECT NO. 230-55-8.8-4, AS PERFORMED BY PRICE CONSTRUCTION COMPANY, CONTRACTORS, UNDER THEIR CONTRACT WITH THE CITY DATED OCTOBER 26, 1960, AUTHORIZED BY ORDINANCE NO. 5938; AUTHORIZING PAYMENT OF FINAL ESTIMATE NO. 4, DATED FEBRUARY 15, 1961, IN THE AMOUNT OF $10,661.63 FROM N0. 230 BRIDGE BOND FUNDS PREVIOUSLY APPROPRIATED; AND DECLARING AN EMERGENCY. The Charter rule was suspended by the following vote: All Council members voting "Aye with the exception of Mayor King, Absent. The foregoing ordinance was passed by the following vote: AllCouncil members voting "Aye" with the excerption of Mayor King, Absent. ORDINANCE NO. 6080 CLOSING THE HEARING GIVEN TO THE REAL AND TRUE OWNERS OF PROPERTY ABUTTING UPON WEBER ROAD FROM THE SOUTHEASTERLY BOUNDARY LINE OF SOUTH STAPLES STREET TO THE NORTHEASTERLY BOUNDARY LINE OF LEXINGTON BOULEVARD AND GOLLIHAR ROAD FROM 120 FEET SOUTHEAST TO 120 FEET NORTHWEST OF WEBER ROAD AS TO SPECIAL BENEFITS TO ACCRUE TO SAID PROPERTY AND THE REAL AND TRUE OWNERS THEREOF BY VIRTUE OF THE IMPROVEMENT OF SAID STREETS WITHIN THE LIMITS DEFINED, AND AS TO ANY ERRORS, AND INVALIDITIES OR IRREGULARITIES IN ANY OF THE PROCEEDINGS OF CONTRACT THEREOF, OVERRULING AND DENYING ALL PROTESTS AND OBJECTIONS OFFERED, EXCEPT THE CHANGES REFLECTED HEREIN, FINDING AND DETERMINING THAT THE PROPERTY ABUTTING UPON SAID STREETS, WITHIN THE LIMITS DEFINED, WILL BE SPECIALLY BENEFITED AND ENHANCED IN VALUE IN EXCESS OF THE AMOUNT OF THE COST OF SAID IMPROVEMENTS PROPOSED TO BE AND AS HEREIN ASSESSED AGAINST SAID PROPERTY ABUTTING UPON A PORTION OF WEBER AD AND GOLLIHAR ROAD, AND LEVYING AN ASSESSMENT FOR THE PAYMENT OF A PORTION OF THE COST OF IMPROVEMENTS ON SAID STREETS, WITHIN SAID LIMITS, FIXING A CHARGE AND LIEN AGAINST THE PROPERTY ABUTTING UPON SAID STREETS AND THE REAL AND TRUE OWNER OR OWNERS THEREOF, PROVIDING FOR THE ISSUANCE OF ASSIGNABLE CERTIFICATES UPON THE COMPLETION AND ACCEPTANCE OF SAID WORK, THE MANNER AND TIME OF PAYMENT AND PROVIDING THE MANNER AND METHOD OF COLLECTION OF SAID ASSESSMENTS AND CERTIFICATES; AND DECLARING AN E i,:,RGENCY. The foregoing ordinance was passed by the following vote: All Council members voting "Aye" with the exception of Mayor King, Absent. tII' • Regular Council Meeting February 22, 1961 Page #3 Mayor Pro Tem Barnard invited anyone in the audience who had business with the Council to come forward and be heard. Harold E. Anderson, 1334 Second Street, stated that he had recently sent a letter to the Council but had not received any answer to it. City Manager Whitney explained to the Council that the letter had come to the City Hall, addressed to Mayor King, and that it had been referred to Kenneth Wainscott, Tax Assessor -Collector for a report, since the letter was in regard to taxes on his property, consisting of approximately 7.5 acres located between Lex- ington and McArdle, and which is the property which the City recently purchased from Mr. Anderson, and that a report on the matter will be presented to the Council at the Monday work session. Ed Williams, attorney, presented in writing his comments and suggestions on the proposed new zoning ordinance, supplementing his remarks made at the public hearing on this matter. He further presented in detail the facts concerning an incident of the previous zoning map being altered in support of his remarks con- cerning this made at the foregoing public hearing to the effect that the map should be done in India ink, and the data regarding the purchase of certain construction materials which he offered in substantiation of his remarks on this matter made at the same public hearing which he alleged was done in violation of the City Charter. Mrs. Harold Stagg, 4002 Redwood, protested the assessment for the Weber Road Street Improvements against her property on the basis that they could not pay the amount. She explained that they are service people who have been out of the country for some years and came back home to find that their home which had been rented while they were gone was in dire need of extensive and expensive repairs besides several mortgage payments which had not been made during their absence and which they had had to make in order not to lose their home. Mrs. Stagg was referred to Obie Etheridge, City Engineer, and Charles Cart- wright, Assistant City Attorney, to see what can be done to help her work out her problem. There being no further business to come before the Council, the meeting was adjourned.
