Humble Gabe Lozano, Sr. REGULAR COUNCIL MEETING March 1, 1961 2:00 P. M. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor Ellroy King called the meeting to order. The Invocation was given by Father Boniface Burgler, Teacher of Civics at Corpus Christi College Academy. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Barnard, seconded by Humble and passed that the minutes of the Special Council Meeting of February 17; Special Council Meeting of February 20, and Regular Council Meeting of February 22, 1961, be approved. Mayor King recognized and expressed the pleasure of the Council for the presence in the audience of thirty-one students representing the Senior Class o£ Civics from the Corpus Christi College Academy, headed by Father Boniface, teacher of the class. Motion by Pat Dunne, seconded by Humble and passed that the recommenda- tions of the City Manager be accepted and approved as follows: a. That Section 21-68 of the Corpus Christi Code be amended, deleting all existing reference to "State Highway 358" and substituting therefor the words "Lexington Boulevard", and amending the speed limits on said Lexington Boulevard as follows: Lexington Boulevard (S.H.358), from a point 1320 feet north of Chapman Ranch Road (S.H.286) to a point 900 feet south of Everhart Road - 45 miles per hour at all times; from a point 900 feet south of Everhart Road to the south City Limits 50 miles per hour at all times; b. That the date of March 22, 1961, be set for public hearingson 4 zon- ing applications, and that the date of March 29, 1961, be set for public hearings an'4 coning applications. ORDINANCE NO. 6081 DETERMINING THE NECESSITY FOR AND ORDERING THAT THE PORTION OF MORGAN STREET FROM THE WESTERLY BOUNDARY LINE OF PORT AVENUE TO THE EASTERLY BOUNDARY LINE OF AIRPORT ROAD BE IMPROVED; AND REQUIRING THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE PLANS AND SPECIFICATIONS FOR THE PROPOSED IMPROVEMENTS; REQUIRING THE CITY SECRETARY TO FILE • Regular Council Meeting March 1, 1961 Page #2 A NOTICE IN THE OFFICE OF THE COUNTY CLERK OF NUECES COUNTY OF THE ACTION HEREIN; PROVIDING HOW SUCH IMPROVEMENTS SHALL BE PAID, AND DECLARING AN EMERGENCY. ORDINANCE NO. 6082 APPROVING AND ADOPTING THE DIRECTOR OF PUBLIC WORKS' WRITTEN STATEMENT AND REPORT OF THE ESTIMATES OF THE VARIOUS COSTS FOR THE IMPROVEMENT OF A PORTION OF MORGAN STREET FROM THE WESTERLY BOUNDARY LINE OF PORT AVENUE TO THE EASTERLY BOUNDARY LINE OF AIR- PORT ROAD, AND THE STATEMENTS OF THE NAMES OF THE APPARENT OWNERS, DESCRIPTIONS AND NUMBER OF FRONT FEET OF ABUTTING PROPERTY ON SAID STREET WITHIN SAID LIMITS; DETERMIN- ING AND FIXING THE PORTION OF SAID COSTS, AND THE RATE THEREOF, TO BE PAID BY AND ASSESSED AGAINST SAID ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF, AND THE PORTION THEREOF TO BE PAID BY THE CITY OF CORPUS CHRISTI, TEXAS; DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF, FOR THE PART OF SAID COST APPORTIONED THEM: ORDERING AND SETTING A HEARING TO BE HELD AT 3:00 O'CLOCK P.M., ON THE 15TH DAY OF MARCH, 1961, IN THE COUNCIL CHAMBERS OF THE CITY HALL IN CORPUS CHRISTI AS THE TIME AND PLACE FOR HEARING OF THE REAL AND TRUE OWNERS OF SAID ABUTTING PROPERTY, AND ALL OTHERS INTERESTED IN SAID PROPERTY OR IN SAID PROCEEDINGS CONCERNING SAID ASSESSMENTS AND PROCEEDINGS; DIRECTING. ORDINANCE NO. 6083 SETTING UP, CREATING AND DIVIDING THE CITY OF CORPUS CHRISTI, TEXAS, INTO SEVENTY- SIX (76) WARDS; DESCRIBING SAID WARDS; REPEALING ALL ORDINANCES AND PART OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. Regular Council Meeting March 1, 1961 Page #3 ORDINANCE NO. 6084 DIVIDING THE CITY OF CORPUS CHRISTI, TEXAS, INTO SEVENTY-SIX (76) ELECTION PRECINCTS FOR AND IN WHICH ALL MUNICIPAL ELECTIONS SHALL HEREAFTER BE HELD IN AND FOR SAID CITY AND SAME SHALL BE KNOWN AS ELECTION PRECINCTS NUMBERS ONE (1) THROUGH SEVENTY- SIX (76), INCLUSIVE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter rule was suspended by the following vote: All Council members present and voting "Aye.". The foregoing ordinance was passed by the following vote: All Council members present and voting "Aye". ORDINANCE NO. 6085 CALLING AN ELECTION FOR MAYOR AND SIX (6) COMMISSIONERS IN THE CITY OF CORPUS CHRISTI TO BE HELD ON THE FIRST TUESDAY IN APRIL, 1961, DESIGNATING PLACES OF HOLING SUCH ELECTION; NAMING THE OFFICERS THEREFOR; P'" SCRIBING THE FORM OF NOTICE OF ELECTION, AND ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. The foregoing ordinance was passed by the following vote: All Council members present and voting "Aye". 0 INANCE N0. 6086 AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND DELIVER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AN AGREEMENT WITH DR. McIVER FURMAN, PRESTON PITTMAN AND T. S. SCIBIENSKI, TRUSTEES OF ROBERT DRISCOLL, JULIA DRISCOLL AND ROBERT DRISCOLL, JR. FOUNDATION, OWNER OF THE ROBERT DRISCOLL HOTEL, PROVIDING FOR THE BEAUTIFICATION OF THE SIDEWALK AREA BY THE PLANTING OF T ES ON THE SOUTH SIDE OF THE 600 BLACK OF ANTELOPE STREET, ADJACENT TO THE ROBERT DRISCOLL HOTEL, A COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMER- GENCY. ORDINANCE NO. 6088 AUTHORIZING CONDEMNATION PROCEEDINGS BY THE CITY OF CORPUS CHRISTI TO CONDEMN CERTAIN REAL ESTATE IN NUECES COUNTY, TEXAS, AND IMPROVEMENTS THEREON, DESCRIBED AS A ONE- SEVENTH INTEREST IN AND TO LOTS 3 AND 4, BLOCK 4, JONES ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY VOL. 3, PAGE 17, MAP RECORDS OF NUECES COUNTY, TEXAS, OWNED BY AVA DAVIS, JOSEPH DAVIS, JOSEPH DEAN DAVIS, RICHARD DAVIS, AND JANE DAVIS CARROLL AND HER HUSBAND, FRANK CARROLL, TO BE CONDEMNED FOR THE USE IN CROSS-TOWN EXPRESSWAY PROJECT AS A PART OF THE STREET AND SIDEWALK AREAS; WHICH SAID LAND IS MORE PARTICULARLY DESCRIBED HEREIN; DIRECTING THE CITY ATTORNEY TO INSTITUTE PROCEEDINGS TO CARRY OUT THE INTENTION OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. Mayor King announced the Council would next hold a public hearing on an appeal of Cecil Proctor from a decision of the Building Standards Commission regard- ing the demolition of improvements on property known as the Hall Cottages and being located at 2600 North Shoreline. He directed that Assistant City Attorney Wayland Pilcher conduct the hearing and interrogate the witnesses. Mr. Pilcher called Frank Peerman, Jr., member of the Building Standards Commission, who testified that he had inspected the premises in question and that it was his opinion that the buildings were substandard, being more than 50 percent deteriorated, and that it would be economically unfeasible to repair and is a dangerous hazard to the health, morals, safety and general welfare of the occupants and the public. Mr. William R. Anderson, Jr., attorney representing Mr. Proctor, appeared and questioned Mr. Peerman's statements regarding the condition of the buildings, stating that repairs had been made since Mr. Peerman's inspection; that in his opinion, the buildings are not beyond repair; that the Building Standards Ordinance is not being used as was originally intended and stated that the beach area is big enough for both large and small property. He further stated that the Corpus Christi Regular Council Meeting March 1, 1961 Page #5 Beach Civic Improvement Association was formed for the purpose of directing the Commission toward certain property and that some of the actions of the Commission are discriminatory. At this time Mayor King and City Secretary Kring departed from the meeting in order to appear in 117th District Court in connection with the law suit presently in progress regarding the City's Gas Supply Contract. Mayor Pro Tem Barnard resumed the hearing. Lonnie Kubala, Building Inspector; F. G. Busker, Fire Inspector; and. Frank FundLing, Plumbing Inspector, were all called as witnesses by Mr. Pilcher and all corraborated the testimony of Mr. Peerman. L. S. Pockrus, City Electrical Inspector, testified that the wiring was bad and in his opinion was 40 percent deteriorated. Motion by Joe B. Dunn, seconded by Pat J. Dunne and passed that the hearing be closed. Motion by Pat J. Dunne, seconded by Humble and pasaed that a decision on this matter be deferred and taken under advisement. Mayor Pro Tem Barnard invited anyone in the audience who had business with the Council to come forward and be heard. Harold Anderson appeared in connection with a letter he had received from City Manager Whitney in answer to his presentation at the Council meeting of February 22, and to his letter of February 13, 1961, in regard to taxes on his property, con- sisting of approximately 7.5 acres Located between Lexington and McArdle, which is property the City recently purchased. Mr. Anderson stated that he had signed the contract under duress; that he paid $4200.00 for it and that he feels the City has confiscated the land; that he feels the taxes levied on the property prior to the City's purchase were too high and complained that the assessed valuation was out of proportion with what he was paid for the property. Mr. Anderson was advised that the City°s only purpose in purchasing the land was to eliminate a menace to the community's health and safety; that the City Council feels its action in acquiring this property has relieved him of a serious potential liability which could not be measured in terms of monetary value, and that Regular Council Meeting March 1, 1961 Page #6 after the Sanitary Division has completed the filling of the pit on the subject property, the remainder of the property, as well as that of the surrounding area, will be significantly enhanced in value. Mrs. Ray Airheart filed with the Council an application in writing for ner name to appear on the ballot in the City election to be held on April 4, 1961, as an independent candidate for City Commissioner, There being no further business to come before the Council, the meeting was adjourned.
