Council Members and City Manager Zanoni discussed the following topics: TxDOT does not have resources to maintain landscape on SPID; a Council Member believes that a sustainability department would pay for itself with grants; the City recommends keeping the financial reserve at $77.9 million; and a Council Member's concem about the water and wastewater rate increase in the Capital Improvement Plan (CIP). b. City Manager Comments: 1. 23-1209 Introduction of CCRTA new CEO Derrick Majchszak City Manager Peter Zanoni introduced the new Corpus Christi Regional Transportation Authority's (CCRTA) Chief Executive Officer Derrick Majchszak. His first day as CEO was July 1. Mr. Majchszak joined the CCRTA in 2017 as Director of Transportation. 2. 23-1210 TxDOT Quarterly Update to include the Harbor Bridge Mayor Guajardo referred to Item 2. TxDOT Area Engineer Ernest Longoria presented information on the following topics: the 1-37 Nueces River Bridge reconstruction project is progressing; night time lane closures continue as the bridge is getting built; the completion date is scheduled for 2027; the bridge maintenance work on JFK Causeway is underway; no further daytime lane closures during the summer are expected; the bridge deck will be resurfaced and will require lane closures; the SPID ramp reversal project eastbound lanes from Ayers to Airline is completed; the westbound lanes are being repaved at night; and repaving on the access road of the westbound side will begin starting at the end of the year. Council Members, City Manager Peter Zanoni, and Mr. Longoria discussed the following topics: a Council Member requested that TxDOT provide a schedule to the community; a desire for TxDOT to improve communication with the Council and the community; AEP is responsible for their own traffic control on Park Road 22; the ramp reversal project from City of Corpus Christi Page 2 Printed on 8/4/2023 City Council Meeting Minutes July 25, 2023 Staples to Nile will be out for bid in May 2024; and TxDOT is in the process of hiring a consultant for the environmental study for the future Regional Parkway. TxDOT Corpus Christi District Director of Construction and Harbor Bridge Project Manager Joseph Briones presented information on the following topics: this district covers 10 counties; footing modifications have taken place on the Harbor Bridge; permanent cable stays will be installed on the north side of the bridge and temporary cable stays on the south side; the towers will grow to 538 feet; three spans remain of the North Beach area approach; the south approach is complete; the southern interchange is about 85 percent complete; Leopard Street Bridge will open this fall; and the estimated completion date of the Harbor Bridge is Spring 2025. Council Members and Mr. Briones discussed the following topics: Flat Iron Dragados will provide an update on the amount of potholes repaired at North Beach; completion of the bridge is phase 1 and demolition is phase 2, which will take about a year to complete; and the chunks of concrete falling off the bridge is not a structural issue and will be easily repaired. F. PUBLIC COMMENT Mayor Guajardo opened public comment. Stephen Klepper, 317 Sunset Ave., spoke about the City's water and wastewater rates versus San Antonio's rates. Michael de la Garza, 5034 Merganser Dr.; Dara Rittgers, 5918 S. Oso Parkway; Amanda Guerra, 2610 Windhollow Dr.; Pat Craig, 5925 Tapestry Dr.; and John Bradshaw, 2921 Airline Rd, spoke in opposition to eliminating the six City Marshal positions: Francisco Dao, 804 Elizabeth St., spoke about the shortage of doctors in the coastal bend and the lack of kiteboarding launches. Shawn Flanagan, 4218 Herndon St., stated his concern about how certificates of obligation are utilized and opposition to an environmental and sustainability department. Mary McLaughlin, 233 Indiana Ave., expressed concern with the noise from the Airbnb next door to her. Rachel Caballero, 522 Hancock Ave., expressed concern about water and wastewater rates and high tax rates. John Weber, 609 Naples St., spoke about ethics reports being improperly filled out. Silvia Jimenez de la Garza, 3009 Charles Dr., spoke about the lack of infrastructure in Annaville. Colby Wiltse, 7929 Vishal Dr., Orlando Sims, 5757 Wooldridge Rd., and Victoria Holland, 235 Ohio Ave., spoke in opposition to an environmental and sustainability department. Eduardo Canales, 7021 Bevington Dr., spoke about a transparent process for the selection of a new CEO for the Port of Corpus Christi. Pastor C.E. Richardson, 6301 Old Brownsville Rd., spoke in support of a pavilion at the Dr. H.C. Dilworth Park. Adam Rios, 7301 Tangled Ridge Court, spoke in support of X Games for Corpus Christi. Isabel Araiza, 326 Poenisch Dr., stated that she serves on the Crime Control and Prevention District and voted no on the budget because she feels that the money is not being utilized for crime control or prevention. Errol Summerlin, 1017 Diomede Dr., Portland, TX, spoke in support of the Mayor in the selection process of hiring a new CEO for the Port of Corpus Christi. Shirin Delsooz, 6030 Tapestry Dr., spoke about adding protected bike paths to the budget. BOARD & COMMITTEE APPOINTMENTS: (NONE) H. EXPLANATION OF COUNCIL ACTION: BUDGET RELATED ITEMS: (ITEMS 3 - 5) 3. 23-1146 Resolution to consider a proposed ad valorem tax rate of no more than $0.620261 per $100 valuation for Fiscal Year (FY) 2024 and taking a record vote; setting the date for the City's proposed FY 2024 budget and proposed FY 2024 ad valorem tax rate public hearings and first reading ordinances on August 29, 2023, with adoption of the FY 2024 budget and FY 2024 ad valorem tax rate on September 5, 2023. Mayor Guajardo referred to Item 3. City of Corpus Christi Page 4 Printed on 8/4/2023 City Council Meeting Minutes July 25, 2023 Interim Director of Finance and Procurement Alma Casas stated that this item sets the ad valorem tax rate of no more than $0.620261, takes a record vote, sets the date for the public hearing, and the final adoption date will be September 5, 2023. A Council Member and Interim Director Casas discussed the following topic: this rate will be no higher than $0.620261 and can still be reduced if desired by council after budget workshops. This Resolution was passed and approved with the following vote: Aye: 8 - Mayor Guajardo, Council Member Barrera, Council Member Hemandez, Council Member Pusley, Council Member Suckley, Council Member Roy, Council Member Klein and Council Member Campos Absent: 1 - Council Member Hunter Abstained: 0 Enactment No: 033104 4. 23-1141 Public Hearing and Resolution approving the Corpus Christi Crime Control and Prevention District Budget for FY 2024 with revenues in a total amount of $9,063,896.00 and expenditures in a total amount of $11,262,350.00 to fund 78 authorized Police sworn personnel, nine replacement vehicles, and equipment to support both. Mayor Guajardo referred to Item 4. Director of Management and Budget Eddie Houlihan stated that this item is to approve the Crime Control and Prevention District budget of $9,063,896 and expenditures in the amount of $11,262,350. Mayor Guajardo opened the public hearing. Mariah Boone, 710 Ponder St., stated that she serves on the Crime Control and Prevention District Board and did not support the budget. She feels that the juvenile assessment center needs to be re -implemented for crime prevention. Mayor Guajardo closed the public hearing. Council Members, City Manager Peter Zanoni, Police Chief Mike Markle, and Director City of Corpus Christi Page 5 Printed on 8/4/2023 City Council Meeting Minutes July 25, 2023 Houlihan discussed the following topics: the City has police officers dedicated to those with mental health issues of all ages; a Council Member shared her personal experience about the benefits of having a juvenile justice center; the importance of having a crime prevention program; whether the crime control prevention program has prevented crime in the past years; and current youth crime prevention programs. Council Member Hunter moved to approve the resolution, seconded by Mayor Guajardo. This Resolution was passed and approved with the following vote: Aye: 7 - Mayor Guajardo, Council Member Barrera, Council Member Hernandez, Council Member Hunter, Council Member Pusley, Council Member Suckley and Council Member Roy Nay: 2 - Council Member Klein and Council Member Campos Abstained: 0 Enactment No: 033105 5. 23-1203 Ordinance adopting the City of Corpus Christi (City) Fiscal Year 2024-2028 and U.S. Department of Housing and Urban Development (HUD) Program Year 2023-2027 Five Year Consolidated Plan (ConPlan); adopting the City Fiscal Year 2024 and HUD Program Year 2023 Annual Action Plan (AAP) for the Community Development Block Grant (CDBG) budget in the amount of $3,507,977, the Emergency Solutions Grant (ESG) budget in the amount of $235,549, and the HOME Investment Partnerships Program (HOME) budget in the amount of $1,661,130 for a total of $5,404,656 annual HUD funding; amending the Citizen Participation Plan (CPP); authorizing the execution of all necessary documents to submit the ConPlan, AAP and CPP; authorizing a staff complement of 13 positions; accepting and appropriating funding for the approved AAP projects and authorizing the execution of funding agreements, amendments and other documents necessary to implement the FY 2024-2028 PY 2023-2027 ConPlan and FY 2024 PY 2023 AAP. Mayor Guajardo referred to Item 5. Director of Planning and Community Development Daniel McGinn presented information on the following topics: five year consolidated plan; timeline; stakeholder consultations; five year priority needs; annual action plan; examples of previous projects; FY 2024 CDBG; FY 2024 ESG; and FY 2024 HOME. Council Members, City Manager Peter Zanoni, and Assistant Director of Planning and Community Development Jennifer Buxton discussed the following topics: U.S. Department of Housing and Urban Development (HUD) gave the City a line of credit which is being used for program income and reprogrammed funds; the only two organizations that applied for this grant were The Salvation Army and Hope House; affordable housing is related to helping with crime prevention; Golden Oaks Park in Flour Bluff did not qualify for improvements because it is not considered a low to moderate income area; Thanksgiving Homes does not want to utilize HUD funds; staff is working on revisions to the infill housing program that can benefit Thanksgiving Homes; the City of Corpus Christi Page 6 Printed on 8/4/2023 City Council Meeting Minutes July 25, 2023 Community Development Block Grant (CDBG) funding helps pay for code enforcement officers; the five year plan would not prohibit the City from creating a low barrier shelter; The Salvation Army and Hope House are permitted to request reimbursement from the City on emergency shelter operations and homeless prevention, however are required to provide documentation to the City of how the money was spent; and phase 2 of The Salvation Army is to provide a shelter. Mayor Guajardo opened public comment. Lisa Gerdes, 3636 Monterrey St., spoke in support of funding for Rising Tide Ministries. The organization has served over 1,400 people. This ministry provides career testing, job search, resume building, etc. The Safe at Home Program is to address safety issues for the elderly. Mayor Guajardo closed public comment. Enactment No: 033113 Consent - First Reading Ordinances 16. 23-1126 Ordinance authorizing the acceptance of a grant from the Bureau of Justice Assistance under the FY 2022 Patrick Leahy Bulletproof Vest Partnership Grant in the amount of $3,257.57 for partial reimbursement of the purchase of 20 additional pieces of body armor; and appropriating $3,257.57 in the Police Grants Fund. This Ordinance was passed on first reading on the consent agenda. 19. 23-1077 Ordinance authorizing acceptance and future amendments of Immunization/Locals (IMM/LOCALS) Grant for $241,637.00 from the Department of State Health Services (DSHS); and appropriating $241,637.00 in the Health Grant Fund to implement and operate an immunization program for children, adolescents, and adults for the period September 1, 2023, through August 31, 2024; and appropriating related program income in the estimated amount of $20,000.00 in the Health Grants Fund; and authorizing four grant positions. This Ordinance was passed on first reading on the consent agenda. 20. 23-1129 Ordinance authorizing a Wastewater Trunk System Construction Reimbursement Agreement ("Agreement") up to $1,382,148.68 with Grangefield Development, LLC ("Developer") to construct a required wastewater trunk line extension for the proposed residential development of Oso Ranch Unit 1 located in Flour Bluff and requiring construction completion within 24 months; transferring $434,396.35 collectively from the Water Trust Funds and Wastewater Collection Line Trust Fund to the Wastewater Trunk System Trust Fund; appropriating $808,539.84 from the Wastewater Trunk System Trust Fund; transferring of future revenue of $573,608.84 collectively from Water and Wastewater lot and acreage fees and pro rate fees to the Wastewater Trunk System Trust Fund; authorizing appropriation of $573,608.84 from the Wastewater Trunk System Trust Fund to reimburse the Developer per the agreement. Ordinance rezoning a property at or near 5922 Kostoryz Road from the "RM -2" Multi -Family District to the "CN -1" Neighborhood Commercial District; providing for a penalty not to exceed $2,000 and publication. (Planning Commission and Staff recommended approval of the change of zoning from the "RM -2" Multi -Family District to the "CN -1" Neighborhood Commercial District). Mayor Guajardo referred to Item 21. Director of Development Services Al Raymond presented information on the following topics: zoning and land use; public notification; staff analysis and recommendation; and planning commission and staff recommend approval. A Council Member and Director Raymond discussed the following topic: the CN -1 zoning allows for a multi -family retail or a small restaurant. Mayor Guajardo opened the public hearing. INDIVIDUAL CONSIDERATION ITEMS: (ITEMS 22 - 27) 22. 23-1215 Motion declaring the intent to include an item on the November 2023 election ballot replacing the existing Type A sales tax with the adoption of a two -eighths of one percent sales and use tax (maintaining the current level of sales and use tax) for the promotion and development of new and expanded business enterprises to be administered by the Corpus Christi Business and Job Development Corporation (Type A Corporation) under Chapter 504 of the Texas Local Government Code, with the use of the proceeds specifically to be used for the convention center complex, including maintenance and operation costs for the life thereof, design, construction, maintenance and repair of commercial and City of Corpus Christi Page 11 Printed on 8/4/2023 City Council Meeting Minutes July 25, 2023 industrial streets, and design, construction, maintenance, and operation of regional parks within the City. On January 10th, the Mayor said the federal and state money received to address homelessness was handed over to the Salvation Army as Part of Phase 1. However, upon making several requests for information about the status of Phase 1 from the Salvation Army, I was unable to obtain a status report. The people we spoke with were unaware of the status of Phase 1 or its existence. This further exemplifies why the City needs to create a city -run open -entry shelter. This allows the City to track spending, create transparency and hold people accountable. If the City wishes to invest in tourism, as highlighted in the FY2024 Budget Proposal, then they need to address homelessness. The growing number of unhoused people at tourist destinations will not stop even if you conduct a sweep. Please consider the long-term impacts neglecting homelessness will have on our economic growth.
