statutory exception to purchase up to 15 trucks from various
unidentified regional dealerships in an amount not to exceed
$686,488.44, with funding from the Fleet Equipment Replacement
Fund.
WHEREAS, construction inspections are necessary to monitor the progress of
construction of the City's capital improvement program's ongoing projects;
WHEREAS, State law requires that procurements are subject to statutory
requirements, including competitive bids, unless an exception applies;
WHEREAS, there is a statutory exception for this procurement in Local
Government Code, Section 252.022(a)(2), as this purchase is necessary to preserve or
protect the public health or safety of the City's residents;
WHEREAS, construction inspectors require vehicles to make site visits and
inspect the construction process, and vehicle availability for purchase in the current
market is volatile and scarce; and
WHEREAS, given the necessity for the purchase of these vehicles, the City
Council finds that it is in the best interest of the City's residents to make purchases from
regional dealerships to secure vehicles for the construction inspectors in order to avoid
delays and any interruption in the City's inspection of the capital improvement program's
ongoing projects, which is deemed necessary to preserve and protect the public health
or safety of the City's residents.
Be it resolved by the City Council of the City of Corpus Christi, Texas:
Section 1. The City Council specifically finds that the foregoing statements included in
the preamble of this resolution are true and correct and adopts such findings for all intents
and purposes related to the authorization of this procurement.
Section 2. The City Manager, or his designee, is authorized to execute all documents
necessary to purchase up to 15 trucks from various unidentified regional dealerships, in
an amount not to exceed $686,488.44, with funding from the Fleet Equipment
Replacement Fund.
