HomeMy WebLinkAbout033300 ORD - 02/13/2024One -reading ordinance waiving Unified Development Code ("UDC") § 3.2, §8.5.1.0 and UDC §8.5.2.E to allow LM & JM Investments, LLC to be eligible for an arterial transmission and grid mains construction and reimbursement agreement after the start of construction of Water Arterial Transmission & Grid Main related to London Ranch Estates Subdivision so long as such construction is not completed prior to execution of such agreement, to allow MPM Development, LP to be eligible for a Wastewater Trunk System Construction and Reimbursement agreement after the start of construction of Wastewater Trunk line related to Haven Road Subdivision so long as such construction is not completed prior to execution of such agreement, to allow Saratoga 400 Partners, LLC to be eligible for a Wastewater Trunk System Construction and Reimbursement agreement after the start of construction of Wastewater Trunk line related to Saratoga Ridge Subdivision so long as such construction is not completed prior to execution of such agreement; and repealing Ordinance 033246 approved on December 12, 2023 titled "One - reading ordinance authorizing a Water Arterial Transmission and Grid Main Construction and Reimbursement Agreement up to $1,486,159.43 with LM & JM Investments, LLC to construct a 12-inch water arterial transmission grid main line for the proposed development located off CR 22 and CR 49, also known as London Ranch Estates Subdivision; and authorizing future transfer and appropriation of Water and Wastewater Trust Fund revenue up to $1,486,159.43 to reimburse the developer in accordance with the agreement." WHEREAS, the Water and Wastewater Trust Funds collectively have a debt of $5.7 WHEREAS, anticipated development could substantially increase the debt of the Trust WHEREAS, cessation of approval of unfunded reimbursement agreements is necessary for the solvency of the Water and Wastewater Trust Funds; million; Funds; WHEREAS, developers listed herein are the most recent applicants for trust fund reimbursements; and WHEREAS, waiver of UDC § 3.2, §8.5.1.C, and UDC §8 5 2 E is necessary to avoid delay of the developments listed herein. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. The City's Unified Development Code ("UDC") § 3.2 is waived to allow the waiver of UDC §8.5.1.0 and UDC §8.5.2. E , herein. SECTION 2. The City's UDC §8.5.1. C.1.d is waived to allow LM & JM Investments, LLC to start construction of a Water Arterial Transmission & Grid Main (12" water line) related to the London Ranch Estates Subdivision prior to City Council approval of a reimbursement agreement. LM & JM Investments, LLC will be eligible for a reimbursement agreement so long as (1) the construction of the Water Arterial Transmission & Grid Main is not completed prior to the approval of the agreement by the City Council and execution thereof, and (2) the aforesaid 12-inch water line is added to the City s Water Master Plan. The order of reimbursement will be determined according to the date the reimbursement agreement is approved by the City Council. The estimated cost of the water infrastructure is $1,486,159.43. S ECTION 3. The City's Unified Development Code ("UDC") §8.5.2. E. 1.d. is waived to allow MPM Development, LP to start construction of a wastewater trunk line related to the Haven Road S ubdivision prior to City Council approval of a reimbursement agreement. MPM Development, LP will be eligible for a reimbursement agreement so long as (1) such wastewater trunk line is not completed prior to the approval of the agreement by the City Council and execution of such agreement, and (2) aforesaid wastewater trunk line is consistent with the City's applicable Wastewater Master Plan. The order of reimbursement will be determined according to the date the reimbursement agreement is approved by the City Council. The estimated cost of the wastewater infrastructure is $1,978,937.16. SECTION 4. The City's Unified Development Code ("UDC") §8.5.2. E. 1.d. is waived to allow Saratoga 400 Partners, LLC to start construction of a wastewater trunk line related to the Saratoga Ridge (12" water line) prior to City Council approval of a reimbursement agreement. 400 Partners, LLC will be eligible for a reimbursement agreement so long as such wastewater trunk line is not completed prior to the approval of the agreement by the City Council and execution of such agreement, and (2) aforesaid wastewater trunk line is consistent with the City's applicable Wastewater Master Plan. The order of reimbursement will be determined according to the date the reimbursement agreement is approved by the City Council. The estimated cost of the wastewater infrastructure is $5,700,000. S ECTION 5. Corpus Christi Ordinance #033246 is repealed. S ECTION 6. This ordinance takes effect upon passage. S ECTION 7. This section constitutes a written request by the mayor or majority of the members of the Council for this ordinance to be passed finally on the date of introduction due to emergency. The City Council finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs; and suspends the City Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure.
