Roberts Jim Young REGULAR COUNCIL MEETING September 6, 1961 2:00 P.M. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor Ben F. McDonald called the meeting to order. The Invocation was given by Reverend L. Birnbaum, Pastor of St. John Lutheran Church. City Secretary T. Ray Kring called the roll of those in attendance. Mayor McDonald officially welcomed back Commissioner Maldonado who has been on temporary sick leave. Motion by de Leon, seconded by Young that the minutes of the regular meeting of August 30, 1961, be approved as furnished to the Council. Mayor McDonald expressed the Council's appreciation and pleasure of working on civic and military matters with Capt. Dale K. Peterson, Chief of Staff, N.A.A.T.C., aad presented him with an Honorary Citizen Certificate and a symbolic Key to the City with the hope that he would return to make this his permanent home. In accepting the tokens, Capt. Peterson remarked that this has been the finest Navy town in his 24 years of Navy service, and introduced his replacement, Capt. P. J. Knapp, whom the Council welcomed, as well as Comdr. W. J. Slone, Public Information Officer, who accompanied them. Mayor McDonald announced the opening of bids. Bids were opened and read on a 3 -year contract for Elevator Maintenance Servide for La Retama Library and International Airport from the following: Hunter - Hayes Elevator Co. of Corpus Christi and Houston; and Emco Elevator Service. Motion by Young, seconded by Maldonado and passed that the foregoing bids be tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation. Bids were opened and read on the Repair and Painting of 4 Water Tanks from the following: Chicago Bridge & Iron Co., Houston; Industrial Painters & Sand Blasters, Dallas; Lankford Co., Inc., Corpus Christi; Virginia Erection Co., Pitts- burgh, Pa.; Claud Boatright, Corpus Christi; and W. J. Redrick Co., Corpus Christi. Regular Council Meeting September 6, 1961 Page 2 The foregoing bids were tabled for 48 hours as required by the City Charter, aad referred to the City Manager for tabulation aad recommendation. Mayor McDonald called for the City Manager's Reports. Motion by Barnard, seconded by de Leon and passed that the recommenda- tions and requests of the City Manager be approved and granted ee follows, with the exception of Item "b" which vas deferred till next week pending a report from Commissioner Roberts: a. That authority to advertise for bids to be received on September 20, 1961, en Lease of approximately 35 acres of farm lead located adjacent to 0. N. Stevens Filtration Pleat for the period of October 1, 1961, through September 30, 1963, be granted; c. That the award of bid on 4 classes of Ready -Mix Concrete be made to Gulf Materials Co. on the basis of low bid meeting specifications, for a total of $4,718.75; (See Bid Tabulation #42 in File) d. That the award of bid on an estimated year's supply of Policemen's Uniforms for the period beginning September 1, 1961, and ending August 31, 1962, be made to Best Tailors, Inc., oa the basis of the low bid meeting specifications, for a total of $7,197.75; (See Bid Tabulation #43 in File) e. That the award of bid on a year's cextract for testing approximate- ly 44,000 cu. yds. of Caliche Base be made to John R. Clarke & Associates en the basis of low bid meeting specifications, as follows: 1 to 1000 cu. yds. per day at $.036 per cu. yd.; 1001 to 2000 cu. yds. per day at $.035 per cu. yd.; 2001 plus cu. yds. per dayy at $.034 per cu. yd.; (See Bid Tabulation #44 in File) f. That all bids received on the Greenwood Drive Improvements, Port to Horne Road, be rejected; that the plass aad specifications be revised; and that the project be re -advertised for bids. THIRD READING OF AN ORDINANCE ESTABLISHING A NEW SCHEDULE OF GAS RATES FOR CUSTOMERS (OTHER THAN INDUSTRIAL CUSTOMERS) OF HOUSTON NATURAL GAS CORPORA- TION, OPERATING INSIDE THE CITY OF CORPUS CHRISTI, TEXAS; ENACTING A PROVISION REGARDING MINIMUM BILLS: PROVIDING AN EFFECTIVE DATE; AND PROVIDING A SAVINGS CLAUSE. Motion by Swantner, seconded by Barnard and uaaaimously passed that the foregoing ordinance be amended to provide for the repeal of Section 38-44 of the City Code, 1958, in its entirety, thereby eliminating the right of private utili- ties to charge a delayed payment penalty. Regular Council Meeting September 6, 1961 Page 3 • ORDINANCE NO. 6272 • ESTABLISHING A NEW SCHEDULE OF GAS RATES FOR CUSTOMERS (OTHER THAN INDUSTRIAL CUSTOMERS) OF HOUSTON NATURAL GAS CORPORATION, OPERATING INSIDE THE CITY OF CORPUS CHRISTI, TEXAS; ENACTING A PROVISION REGARDING MINIMUM BILIS; PROVIDING AN EFFEC- TIVE DATE; AND PROVIDING A SAYINGS CLAUSE; REPEALING SECTION 38-44 OF THE CORPUS CHRISTI CITY CODE, 1958. The foregoing ordinance was read for the third time, as amended, and passed fl..1ly by the following vote: Mayor McDonald, Commissioners Swantner, Barnard, de Leon, Maldonado, Roberts and Young voting "Aye". ORDINANCE NO. 6270 AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE, FOR AND ON HEEALF OF THE CITY OF CORPUS CHRISTI, CONSENT AGREEMENTS BY AND BETWEEN THE CITY OF CORPUS CHRISTI AND THE UNITED STATES OF AMERICA, REPRESENTED BY THE DISTRICT PUBLIC WORKS OFFICER, EIGHTH NAVAL DISTRICT, AND BY AND BETWEEN THE CITY OF CORPUS CHRISTI AND TERAS MEXICAN RAILWAY COMPANY, SAID AGUF ITS FOR TRE CONSTRUCTION AND MAINTENANCE OF A 12" WATER MAIN ENCASED INA 24" STEEL CASING ACROSS THE RAILROAD RIGHT OF WAY AT GREENWOOD DRIVE AND HOLLY ROAD AT THE LOCATION KNOWN AS RAILROAD'S ENGINEERING STATION 245 PLUS 19; AND DECLARING AN EMERGENCY. ORDINANCE NO. 6271 AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE ADOPTING AND PROVIDING FOR THE AD- MINISTRATION OF THE COMPENSATION PLAN FOR ALL POSITIONS IN THE CITY SERVICE; RE- PEALING ALL ORDINANCES IN CONFLICT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PRO- VIDING FOR AN EFFECTIVE DATE", BEING ORDINANCE NO. 3656, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 10TH DAY OF FEBRUARY, 1954, AS AMENDED, BY AMENDING SUBSECTION (E) OF SECTION 1, BY CREATING A WELFARE POSITION SERIES AND ADDING CERTAIN WELFARE POSITIONS AS HEREINAFTER LISTED TO THE SERIES; BY AMENDING SECTION 3 BY ADDING SUB- SECTION (H); PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EMERGENCY. The foregoing ordinance was read for the second time and passed to its third reading by the following vote: Mayer McDonald, Commissioners Swantaer, Barnard, de Leoa, Maldonado, Roberts and Young voting "Aye". Mayor McDonald called for petitions or information from the audience on matters not scheduled oa the agenda. D. F. Snapp presented and read a petition allegedly signed by approximate- ly 80% of the property owners on Corpus Christi Beach, and with the signature of the Guaranty Title Company, representing 92% of the property owners on the Beach within the City limits, urging that this City Council take all necessary action to provide adequate storm and hurricane protection for the Beach area as recommended by the Corps of Engineers. (See Petition #11 is File) Mr. Snapp showed pictures and de- scribed the deterioration of the beach through recent years due to erosion of the beach proper. I. M. Alexander, owner of Alexander Beach Cottages, spoke in support of the petition, and stated that since the beach is gone and most of the street, moat of the property owners are going to have to render their property at greatly depreciated values. W. B. Carter, owner of Capri Motor Inn, also spoke in support of the peti- tion; stated that in the last 20 years the City had done only three things for the Beach area, built a firehouse, took down a palm tree for him, and made promises; and suggested a breakwater exteading fresm the north breakwater all the way to the cause- way with inlets for beach water and Japanese type bridges over them, wide enough for 6 to 8 people to walk oft. Mayor McDonald explained that he had been in conference with the Command- ing General of the U. S. Corps of Engineers on the need for this hurricane protec- tion as it was holding back progress in this City and destroying property values; that a 5taff Study has been completed; that the Corps of Engineers would not approve walls on the beach but recommended something on the water with cuts through to pro- tect the beach; that the Federal Government was still ready to finance 70% of the coat, and that private interest and possibly trades in the way of right-of-ways • Regular Council Meeting September 6, 1961 Page g • could make up the balance; that a public hearing to determine the extent of the public interest and need had been planned for the very near future, but that he was of the opinion that, in view of this almost unanimous petition, he could see no reason why we should not ask for an immediate hearing by the Corps of Engineers to get their study underway. The Council agreed with Mayor McDonald's opinion, and the City Manager was directed to forthwith present to the Corps of Engineers the City's support for this project and request for iitediate action and procedure,. Mayor McDonald strongly urged the petitioners to turn out "en passe" for all hearings in the matter as evidence of their united support and cooperation. Dewey Beggett, 1603 Brownlee, speaking for himself and his neighbor, Mrs. Cleveland, both longtime residents, stated they wished to go on record as being opposed to the establishment of a mortuary or funeral home on Brownlee, on the basis that the type of business is not an asset to the property owners in the area. There being no further business to come before the Council, the meet- ing was adjourned. r
