Barnard City Manager Herbert W. Whitney J. R. de Leon City Attorney I. M. Singer M. P. Maldonado City Secretary T. Ray Kring W. J. Roberts Jim Young Mayor Ben F. McDonald called the meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Motion by de Leon, seconded by Barnard and passed that the absence of Commissioner Tom R. Swantner be excused for cause. Mayor McDonald announced the purpose of the special meeting was to hold public hearings on 2 zoning applications. Mayor McDonald announced the public hearing on the application of Joe V. Fernandez for a change of zoning from "B-1" Neighborhood Business Dis- trict to "B-4" General Business District on Lots 20 and 21, Block 7, La Arboleda Addition, being that property located on the Northwest corner at the intersec- tion of Dunbar Street and McArthur Street. William Anderson, Director of Zoning & Planning, located the property on the map and pointed out the land use in the area; explained that the request- ed change in zoning is for the purpose of establishing a plumbing shop on the property; that there had been 3 written returns received in favor of the change and 2 against; and that the recommendation of the Zoning & Planning Commission was that the application be denied on the basis that it is not a reasonable ex- tension of a business district. Mr. Joe V. Fernandez, the applicant, appeared in support of his re- quest, stated that he plans to build a 20 x 30 foot concrete block building for his plumbing operation, and felt that his request was reasonable since there is a saloon and garage across the street. No one else appeared to be heard. Mayor McDonald declared the hearing closed. Motion by Maldonado, seconded by Barnard and passed that the matter be taken under advisement. Mayor McDonald directed that Commissioners Maldonado and Young in- spect the property in question and report back to the Council. • Special Council Meeting April 2, 1962 Page 2 Mayor McDonald announced the public hearing on the application of Barney Kay for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on Lot 1, Unit 1, Washburn Meadows Add- ition, being that property located in the 3800 Block of South Staples Street. William Anderson located the property on the map; pointed out the surrounding land uses in the area; stated that there had been 2 written returns received in favor of the application and 2 against, and that the recommendation of the Zoning & Pienning Commission was that the request be denied for "B-1" Neighborhood Business District, but that "AB" Professional Office District be recommended for approval. Paul Ramon, realtor, representing Mr. Kay, Joe Roscoe, owner of the Hamlin Shopping Center immediately adjacent to the property in question, Mrs. Barney Kay, and Dr. William Hart, owner of Lot 3, of Unit 1, all spoke in favor of the application on the basis that the planned development will be a beneficial extension of the Hamlin Shopping Center and that the property in question is no longer suitable for residential use. Mr. & Mrs. John Kasper, 1058 Catalina, opposed the application on the basis that there is sufficient "B-1" zoning in the vicinity, and that it will depreciate the value of their residential homes across the street. No one else appeared to be heard. Mayor McDonald declared the hearing closed. Motion by de Leon that the Council concur in the recommendation of the Zoning & Planning Commission, and that the request be denied for "B-1" zoning, but that "AB" Professional Office District zoning be approved for Lot 1, Unit 1, Washburn Meadows Addition. The foregoing motion died for lack of a second. Motion by Roberts, seconded by Young and passed, with Commissioner de Leon voting "Nay" on roll call vote, that the request for "B-1" zoning on Lot 1, Unit 1, Washburn Meadows Addition, be approved. Simon Grossman, developer of Carmel Village, presented a letter he has received from City Engineer Obie Etheridge, which was read, to the effect that water connections cannot be authorized in the subdivision until the required im- provements on Barry Street and Grossman Drive have been completed. Mr. Grossman requested a time extension of at least 6 months in this respect on the basis that • Special Council Meeting April 2, 1962 Page 3 Biel's Store is completed and ready to open on the 10th of this month, that the water and sewer construction has been completed, and that he was not aware that the street paving had to be completed before Biel's could open. Mayor McDonald stated that he wanted it clearly understood that all re- quirements must be complied with, but that this condition of the zoning would be deferred, thereby permitting taps and utility connections, for not more than 9 months, or until the City requires the street. Mayor McDonald reminded th.e Council that the matter of the Duke rezon- ing request onrollihar Road has not yet been resolved, and requested that Com- missioners Maldonado and Young inspect the area and report back to the Council as soon as possible. There being no further business to come before the Council, the special meeting was adjourned.
