Roberts Jim Young SPECIAL COUNCIL MEETING May 9, 1962 4:00 P.M. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring • Mayor Ben F. McDonald called the special meeting to order, and announced the purpose of the special meeting was for public hearing on two zoning applica- tions. City Secretary T. Ray Kring called the roll of those in attendance. Mayor McDonald explained the procedure that would be followed for the hearings, and announced the public hearing on the application of J. W. Broughton for a change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on Lot 10, Baymoor Addition, being that property located on the Northwest corner of the intersection of Baymoor Boulevard and Lawrence Drive. Earl Goetsch, Senior Planner, located the property on the map and pointed out the nature of the surrounding land uses and the present zoning; explained that the applicant wishes to operate his plumbing shop along with the existing barber shop in the existing building, which will be improved, and use the rear of the building for storage, with sheds for truck parking being erected on the rear of the property, and that there is already adequate off-street parking; and that the recommendation of the Zoning & Planning Commission was that this request for "B-4" General Business District be approved. John Morrow, real estate agent representing the applicant, and the applicant Mr. Broughton, spoke in support of the application on the basis that his present property is being taken by Interstate Highway 37 right-of-way. No one appeared in opposition to the application. Mayor McDonald declared the hearing closed. Commissioner Barnard commented that in a similar situation in another neighborhood where there were residences across the street, the Council had granted a Special Council Permit to allow the business operation with provisions that the pipe and materials be stored inside in order to protect the neighborhood, and Mr. Broughton stated that this would be satisfactory to him. • • Special Council Meeting May 9, 1962 Page 2 Motion by Barnard, seconded by Maldonado and passed that the application for a change of zoning from "B-1" to "B-4" on Lot 10, Baymoor Addition, be denied, and that in lieu a Special Council Permit be granted permitting the use of the property for a plumbing shop operation with the provision that all pipe and materials be stored and kept enclosed in a building. Mayor McDonald announced the public hearing on the application of Omaha Venetian Blind Co. for a change of zoning from "R -1B" One -family Dwelling District to "I-2" Light Industrial District on property described by metes and bounds and generally located between Lexington Boulevard and Parklane Unit #2 and extending to an approximate distance of 460' to the Southeast and to the Northwest of Calvin Drive. Earl Goetsch located the property on the map, and explained that the applicant had only requested "I-2" zoning for the rectangular portion of the property which is approximately 236' nearest to Everhart Road, which is all that the applicant owns, but that the Zoning & Planning Commission had advertised the larger area 1n order to continue the existing "I-2" zoning along Lexington Boule- vard to include the applicant's property, and that the recommendation of the Zoning & Planning Commission was that the request for "I-2" Light Industrial District be approved; and explained that all of this property will have to be platted as the need for use arises. Mr. Hawkins of the Omaha Company spoke in support of the application on the basis that the present location of the company is being acquired for Inter- state Highway 37 right-of-way, that the business is primarily retail appliances but still does venetian blind work, and that he lives in the vicinity and is not going to construct or operate anything detrimental to the neighborhood. No one appeared in opposition to the application. Mayor McDonald declared the hearing closed. Motion by Swantner, seconded by Roberts and passed that the recommenda- tion of the Zoning & Planning Commission be concurred in, and the zoning be changed from "11-1B" to "I-2" on property described as BEGINNING at a point in the Northerly right-of-way line of Lexington Boulevard said point being the Southwest corner of Lot 5, Block 4, Gray Village; 'iff NCE with the North right-of-way line of Lexington Boulevard S 61 deg 37' 30" E, 726.86 feet to a point; THENCE with the North right - of way line of Lexington Boulevard S 65 deg 54' 56" E, 110.40 feet to a point, • Special Council Meeting May 9, 1962 Page 3 said point being the Southeast corner of this tract; THENCE N 29 deg E, 391.73 feet to a point, said point being the Northeast corner of this tract and said point being on the South line of Block 1 of Parklane Unit #2; THENCE N 61 deg 37' 30" W, 441.76 feet along the South line of Parklane Unit A to a point, said point being on the centerline of Calvin Drive; THENCE S 29 deg W, 105.01 feet with the centerline of Calvin Drive to a point for an interior corner of this tract; THENCE N 61 deg 37' 30" W, 394.62 feet along the South line of Block 7, Parklane Unit #2 to a point for the Northwest corner of this tract; THENCE S 29 deg 04' 30" W, 295 feet to the point of BEGINNING. There being no further business, the Special Meeting was adjourned.
