Mayor Pro Tem Swantner called the meet ::: to order, alcd announced the
purpose of the special meeting was to hold public hearings on 3 zoning ;applica-
tions.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by de Leon, seconded by Barnard and passed that the absence of
Mayor Ben F. McDonald be excused for cause.
Mayor Pro Tem Swantner announced. the peblic hearing on the application
of Oscar Garza for a change of zoning from "R -1B" One -family Dwelling District
to "R-2" Two-family Dwelling District on Lots 1 enf 2, Block 3, High Terrace
Addition, being that property located on the Southeast corner of the intersec-
tion of Alamo Drive and Lamar Street.
J. T. Dunkin, Senior Planner, located the property on the map as be-
ing 2 lots with a total frontage along Alamo Drive of approximately 70'; pointed
out the vacant lots, and the surrounding land uses; and explained that the recom-
mendation of the Zoning & Planning Commission was that the application be approved.
Oscar Garza, Jr., spoke in support of the application on the basis that
the corner lot being too small for a residence, they want to construct a duplex unit
on the 2 lots together.
Mayor Pro Tem Swantner noted that there had been 3 written returns re-
ceived in favor of this application and none against.
No one appeared in opposition to the application.
Mayor Pro Tem Swantner declared the hearing closed.
Motion by Maldonado, seconded by de Leon and passed that the recommend-
ation of the Zoning & Planning Commission be concurred in, and that the zoning
on Lots 1 and 2, Block 3, High Terrace Addition, be changed from "R -1B" to "R-2".
Mayor Pro Tem Swantner announced the public hearing on the application
of Young -Wise Garden Center for a change of zoning from "R -1B" One -family Dwell-
ing District to "B-1"' Neighborhood Business District on Lots 19, 20, 21, and 22,

Block 11, Gardendale No. 3 Addition, being that property located on the Northeast
corner of the intersection of South Staples Street and Williams Drive.
Commissioner Young disqualified himself with respect to this applica-
tion due to personal interest, and was excused from the Council table for this
hearing.
J. T. Dunkin located the property on the map; pointed out the surround-
ing land uses; explained that the property had previously been zoned for business
use; that the property on both sides is vacant; and that the recommendation of
the Zoning & Planning Commission was that the application be approved.
J. B. Trimble, attorney representing the applicants, spoke in support
of the application on the basis that it would amount to an extension of the ex-
isting "B-1" district, that South Staples is more and more becoming a business
area, and that there is a definite need for additional business development in
this area.
Mayor Pro Tem Swantner noted that there were 3 written returns received
in favor of this application and none against, and that no one had appeared in
opposition to the application.
Motion by Roberts, seconded by Maldonado and passed that the hearing
be closed, and the recommendation of the Zoning & Planning Commission be con-
curred in, and that the zoning on Lots 19, 20, 21, and 22, Block 11, Gardendale
No. 3 Addition, be changed from "R -1B" to "B-1".
Mayor Pro Tem Swantner announced the public hearing on the application
of Mrs. Frances Nelson for a change of zoning from "R -1B" One -family Dwelling
District to "B-1" Neighborhood Business District on Lot 10, Block 1, Bay View
#4 Addition, being that property located on the Southeast corner of the inter-
section of 19th Street and Craig Street.
City Manager Whitney introduced a letter dated May 12, 1962, received
on May 14, 1962, signed by Mrs. Frances Nelson, the applicant, to the Mayor and
City Council, serving notice that she wished to withdraw her zoning application,
and requesting the return of her deposit. He pointed out to the Council that
City Secretary Kring had already informed the applicant in writing of receipt
of her letter of withdrawal, and that since all of the expenses involved in
the public hearings on this application have been incurred, that the refund can
not be made.

Toga Lake, Zoning Coordinator, explained that the application had been
withdrawn by the applicant on the advice of her lawyer since there are deed re-
strictions on the property which still have some years to run.
Mayor Pro Tem Swantner ordered that the minutes reflect that the
application of Mrs. Frances Nelson for a change of zoning from "R -1B" to "B-1"
on Lot 10, Block 1, Bay View #4 Addition, was withdrawn at the written request
of the applicant.
There being no further business to came before the Council, the special
meeting was adjourned.
