SPECIAL COUNCIL MEETING
July 11, 1962

Mayor Pro Tem Swantner called the Special Meeting to order at 4:00 P.M.,
for the purpose of public hearings on 6 zoning applications.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor McDonald resumed the Chair and explained the procedure to be followed,
and announced the public hearing on the application of Antonio Trevinio for a
change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood
Business District on Lot 52, Block 4, Airport Park located at 1013, Post Street.
Tom Lake, Zoning Coordinator, located the property on the map and pointed
out the surrounding zoning and land uses in the area. Earl Goetacla,Senior Planner,
read the recommendation of the Zoning & Planning Commission that the request for
"B-1" Neighborhood Business District be denied but that a Special Permit under
Article 25, Section 25-4, Sub -section 12, of the Zoning Ordinance, be approved
because of hardship due to the applicant's personal disability, and subject to cer-
tain restrictions.
Mr. E. L. Laird, owner of the property described in the request and ad-
joining Lot 53, spoke in favor of this application. He stated that he was speaking
for the applicant, Mr. Trevinio, who rents the house located on Lot 52. He
pointed out that Mr. Trevinio 1.01 an amputee, sixty years old, and unable to locate
suitable employment to support his wife and thirteen year old son. He further
stated that he wished the property re -zoned so that he could operate a small
grocery store in the front room of the house to avoid the prohibitive expense of
taxicab transportation, and also stated that many of the neighboring property
owners had signed a petition in favor of Mr. Trevinio's request.
No one appeared in opposition to the foregoing zoning application.
Motion by Maldonado, seconded by Roberts and passed that the recommenda-
tion of the Zoning & Planning Commission be concurred in, with the exception of condi
tion No.b,and the request be denied to change the zoning from "R -1B" One -family
Dwelling District to "B-1" Neighborhood Business District on Lot 52, Block 4,

Airport Park, located at 1013 Post Street, but that a Special Permit under Article
25, Section 25-4, Sub -section 12, of the Zoning Ordinance be approved because of
hardship due to the applicant's personal disability, and subject to the following
conditions:
(1)
That the southeast room of the residence, which is located
on the property described in this request, be used for
retail grocery sales and that this use be restricted to
that specific location within the existing residence;
(2) That the sale of beer and other acoholic beverages be
prohibited at this location;
(3) That the property described in the request be maintained
in the manner compatible to the surrounding neighborhood;
(4) That outdoor advertising or identification signs be
restricted to not more than 6 square feet in area, be
non -illuminated, non -flashing, and attached to the front
wall of the existing building;
(5)
That if the applicant, Antonio Trevinio, for any reason
terminates the proposed use or ceases to be the operator
and proprietor of this proposed use, the Special Permit
shall be voided.
Mayor McDonald announced the public hearing on the applications of
Mr. and Mrs. E. 0. Rippee, for change of zoning from "R -1B" One -family Dwelling
District to "A-1" Apartment House District on Lot 5, Block 1, Alameda Estates;
application of C. L. Casale and Mrs. Lula Hood for change of zoning from "R -1B"
One -family Dwelling District to "B-4" General Business District on all of Lots 1
and 2, Block 1, Alameda Estates, located on the northeast corner of the intersec-
tion of South Alameda Street and Eldon Drive; and application of Mr. and Mrs. R.R.
Blankert, D. F. Sparks, and Mrs. A. D. Campbell for change of zoning from "R -LB"
One -family Dwelling District to "A-1" Apartment House District on all of Lots 3,
3A, and 4, Block 1, Alameda Estates.
Tom Lake located these properties on the map, and explained that because
of the similarity of zoning usage and the fact that they are adjacent and front on
Eldon Drive and Alameda Street, that the Zoning & Planning Commission had considered
them simultaneously, and made recommendation to the Council that the request of C. L.
Casale and Mrs. Lula Hood for "B-4" General Business District be denied, but that
"A-1" Apartment House District be approved, and that the requests of Mr. and Mrs.
E. 0. Rippee and Mr. and Mrs. R. R. Blankert, Mr. D. F. Sparks and Mr. and Mrs.
A. D. Campbell, for "A-1" Apartment House District, be approved, making the entire

area in question zoned as "A-1".
Mayor McDonald announced that the applications would necessarily have
to be heard separately and announced he would now hear from the proponents in con-
nection with the application of Mr. and Mrs. E. O. Rippee.
Mrs. Rippee appeared and stated that they wanted to sell the property
but that it would not sell zoned as One -family Dwelling District.
Mrs. R. R. Blankert, owner of the southwest half of Lot 3 and the northeast
half of Lot 4, Block 1, Alameda Estates, and D. F. Sparks, owner of the southeast
half of Lot Number 4, Block 1, Alameda Estates, appeared and spoke in favor of this
application, stating that they, as adjacent owners, are attempting to work out a
solution to the problem; that there is not enough land for a roadway to subdivide
for "R-1" and too large for single residences; that the unkempt rear portion of
the deep lots shelter snakes and other pests, and the high weeds are a dangerous
fire hazard.
W. D. Elliott, Harold Ducate and Les Young, appeared and spoke in opposi-
tion to the application in question, stating that they had invested large amounts
of cash and had purchased their property with a clear understanding that it was for
single family use; that Apartment House zoning would cause deterioration of all the
adjoining residential area, and that they are strongly opposed to a zoning change
from "R -1B".
Mayor McDonald announced the Council would next consider the application
of C. L. Casale and Mrs. Lula Hood.
Mayor McDonald read the recommendation of the Zoning & Planning Com-
mission that the request in question be denied, but that "A-1" Apartment House
District zoning be approved.
Paul Hamon, real estate agent representing the applicants, spoke in favor
of this application, stating that the applicants had purchased this property as an
investment; that they have firm commitments that a four-story building will be built
with retail shops on the first level; and that in his opinion this would offer
efficient use of the land. He further stated that "B-1" zoning would be acceptable
but that "A-1" Apartment House District zoning does not offer a solution to their
problem.

Harold Ducate appeared and spoke in opposition to the application. He
stated that if General Business zoning were granted there would be no control on
the type of business; tnat ne nad made a survey of other businesses in the area
and that a large percent of them are not in favor of more business zoning; that if
they had any more competition in that neighborhood they would be forced out of busi-
ness.
Others appearing and opposing the application were Leslie Young and W. D.
Elliott, who concurred in the objections stated by Mr. Ducate.
Mayor McDonald announced the public hearing on the application of Mr.
and Mrs. R. R. Blankert, D. F. Sparks, and Mr. and Mrs. A. D. Campbell.
Tom Lake located the property on the map, described its uses and read the
recommendation of the Zoning & Planning Commission that the request for "fA-1"
zoning be approved.
Mrs. Blankert and D. F. Sparks appeared in support of their application
stating that the existing lots are too deep for proper single-family development and
that in their opinion development under "A-1" zoning would be a credit to the
neighborhood.
Mr. Harold Ducate objected to the change, and stated that the tenants
living in the house on the lot to the rear of his property had built an elevated
platform which they use for outdoor sleeping during the summer months, and that that
practice deprived him of his privacy and is an indication of what multi -story
apartments would be like if such were built on the property.
No one else desiring to be heard, Mayor McDonald declared the public
hearings closed on the three foregoing applications; stated that the Council would
take the applications under advisement; and that he would appoint a committee from
the Council to make a thorough investigation and make recommendation to the Council.
Mayor McDonald announced the public hearing on the application of Mrs.
Clarence Hertel and Mrs. T. E. McArdle, Jr., for a change of zoning from "R-2"
Two-family Dwelling District to "AB" Professional Office District on Lots 37, 38,
39, 40, 41 and 42 of Block 817, Port Aransas Cliffs Addition.
Tom Lake located the property and described its uses in relation to the
surrounding area.

Virgil Howard, Attorney, representing the applicants appeared and spoke
in favor of the request; stated that in his opinion the property was no longer
desirable for residential use and that the approval of the request would be a
logical extension of the existing zoning; that the applicants were both widows
and that the property would be developed by other interests.
No one appeared in opposition to the foregoing zoning application.
Motion by Barnard, seconded by Swantner and passed, that the recommenda-
tion of the Zoning & Planning Commission be concurred in, and that the application
of Mrs. Clarence Hertel and Mrs. T. E. McArdle, Jr., to change the zoning of Lots
37, 38, 39, 40, 41 and 42 of Block 817, Port Aransas Cliffs Addition, being that
property located on the Northeast right-of-way line of South Alameda Street 550
feet ii'brthwest of the intersection of South Alameda Street and Doddridge Street
extending 150 feet in a Northwesterly direction along South Alameda Street and ex-
tending to a depth of 125 feet, from "R-2" Two-family Dwelling District to "AB"
Professional Office District, be approved on the basis that it is a logical exten-
sion of the existing zoning.
Mayor McDonald announced the public hearing on the application of Hector
De Pena for a change of zoning from "R -1B" One -family Dwelling District to "B-1"
Neighborhood Business District on Lots 1, 2, and 25, Block 7, San Diego Addition,
Unit 1.
Tom Lake, Zoning Coordinator, located the property, described its present
uses and read the recommendation of the Zoning & Planning Commission that the re-
quest be approved on Lots 1 and 25 and denied on Lot 2, but that "AB" Professional
Office District be approved on Lot 2. J
Hector De Pena, the applicant, spoke in support of his application. He
stated that he had owned the property since 1946 and that he had antidipated
that Port Avenue would become a major thoroughfare; that he had filed a class suit
and obtained a declaratory judgment in District Court which lifted the deed restric-
tions on his property; that most of the neighboring property owners were in favor
of the restrictions being lifted; and stated further that the Expressway will make
the property undesirable for residential use.

No one appeared in opposition to the foregoing request.
Motion by de Leon, seconded by Roberts and passed that the recommendation
of the Zoning & Planning Commission be concurred in and approved on Lots 1 and 25
and denied on Lot 2, but that "AB" Professional Office District zoning be approved
on Lot 2.
There being no further business to come before the Council, the meeting
was adjourned.
